HomeMy WebLinkAbout1995-02-15• Regular Board Meeting February 15, 1995 The Lansing Town Board met in Regular Session at the Lansing Town Hall Board Room at 7:00 p.m. with Supervisor Kirby presiding. Jeannine Kirby Herbert Beckwith Paul Butler Jeffrey Cleveland Larry Tvaroha Bonita Boles Richard John ROLL CALL Supervisor Present Councilman Absent Councilman Absent Councilman Present Councilman Present Town Clerk Present Town Attorney Present VISITORS: George Totman, David Herrick, Pete and.-Jackie Larson, John Farkas and Curtis Ogden. - - - The Supervisor called the meeting to order and had the clerk take the Roll Call. Proof of Notice having been furnished, bids were publicly opened at 7:00 p.m. for one Double Drum Vibratory Compactor. The bids were as follows. Mr. John Farkas approached the Board with concerns regarding the might classes that the Lansing School used to give. He was mainly concerned about the wood working class that was given two (2) hours per-week. He stated that when he asked Andrea Price, the School Superintendent; she informed him that it was now in the hands of the Town Board and not the School. The Town Board had NO knowledge of this and suggested he go back to the School Board for further information. Mr. Larson informed the Board of the following$ 1-. ' • He has researched computers for use in the Highway Garage. He has three bids in at the moment and is waiting for one more before he makes a decision. 2. The mapping is back on the Salmon Creek area. He feels it is now too late to clean out the creek but he should be able to make the necessary repairs in the section of the creek that is washed out. He will also try to correct the water flow in the channel. Mr. Herrick stated that he spoke to Mr. John-Marion from the DEC and that he stated to him that the DEC would have allowed the Town to go in -wi-th nothing more than a phone call notice to reline what has been washed out instead of going all the way back -up to where the channel used to be. Mr. Larson stated that the DEC told himself and-Steve Colt that they absolutely COULD NOT go into the creek'without a permit even on an emergency basis. Mr. Herrick will try to get a letter from the DEC stating that they would allow the Town to aline what is there now. RESOLVED, that the Town Board hereby authorizes and directs the Highway Superintendent to purchase one Rubber Tire Excavator from L.B. Smith, Inc. who was the low bidder. Mr. Herrick stated that he was disappointed in the turn- around -time from Lockwood mapping regarding Salmon Creek dredging. He stated that once a permit is issued it is good for two to three years but he will apply for a five year one from the Army Corp of Engineers. 3. Mr. Herrick stated that the Horky property has been sold and the new owner will be building Barden Homes on this property. Mr. • Larson was very concerned about the proposed exit road on to Hillcrest Road. He was very much against this, along with the Board should attend Members. as these. The drainage problem was also discussed. Mr. Tvaroha suggested they might look into a drainage district. It was noted that the Lansing Planning Board will be holding a special meeting on February 27, 1995 to discuss the proposed road situation. It was also stated that NO CERTIFICATE OF OCCUPANCY will be issued to any of these homes until the road is completed and that the developer should be aware of this up front. Mr. Curtis Ogden from the Learning Web approached the Board regarding a program he is overseeing which is a community project which involves nine (9) students between ninth grade and twelfth grade. These students are volunteering their time after school and he asked the Board if the Town had any projects the kids might be interested in taking on. The Board suggested he contact Steve Colt. He..informed the Board that they were welcome to contact him at any time if they had any questions or concerns. He also stated that he would bring the students to a future Board Meeting to observe it. Mr. Rich John reported that he has talked to Mrs. Gay Nicholson concerning the Trailways project. She told him that the Church, the School and the Fire Department were all in agreement. He also stated that she still has NOT received permission from the Sobol's, Mr. Barnard or Mr. Conlon regarding easements. Mr._ John has prepared the easement the State requires to keep the process going. -The Town needs to state that they want to see the project go forward. It was the feeling of the Town Board that the .easements need.-to be- obtained before they can agree on anything further. Mr. Cleveland was concerned about the process of asphalting the..trail as he was worried that it .would not hold up when the 15 ton truck loaded with 10 tons of asphalt was to go over it. Mr. Tvaroha stated that he has not heard overwhelming community support. Mr. Cleveland felt that maybe it should go to a referendum. It was felt that a Public Informational• Meeting should take place before anything further happens. Mrs. Kirby will contact Gay Nichol.son and try to set up a Public Meeting at the Lansing High School room 101 on March 8, 1995. Mrs. Kirby will also send letters to the six main people • concerned, inviting them to the meeting. The Town Board also questioned the "Trailways Committee" and who.appointed them. George Totman - Code Enforcement Officer, reported the following: 1. ..He handed out his monthly report and stated that he was four (4) permits ahead of last year and $ 435,000.00 ahead of last year. 2. The County is planning a Planning Seminar. Mr. Totman asked that the. Town Board send letters to the Planning Board Members stating they should attend seminars such as these. ]94 continued February 15, 1995 RESOLUTION, offered by Mr. Tvaroha and seconded by Mr. Cleveland. RESOLVED, that the Town Board of the Town of Lansing does hereby reappoint Jeannine Kirby to the Tompkins County Hospital Board to a two year term. Carried. RESOLUTION, offered by Mr. Cleveland and seconded by Mr. Tvaroha: WHEREAS, the Hickory Knolls Subdivision within Water District 7 of the Town of Lansing contains land either wholly or partially within an Agriculture District, and WHEREAS, the New York State Department of Agriculture and Markets has requested, in connection with granting approval of the water system in the Hickory Knolls Subdivision within Water water system located either wholly or partially within an agricultural district, that the Town of Lansing agree to certain Conditions for water transmission mains Special Permit Conditions of the Department of Agriculture and Markets for the construction and use of a water system within an agriculture district; therefore, it is not include RESOLVED, that the Town of Lansing, in connection with the New York State Department of Agriculture and Market's approval of the water system in the Hickory Knolls Subdivision within Water District 7 that lies either wholly or partially within an agriculture district, agrees to the following Special Permit Conditions for water transmission mains located wholly or partially within an agriculture district. has been designated in an official not apply 1. Prior to the initiation of construction of the project's right -of -way (public or private), the permittee shall submit a plan that addresses the procedures and practices to be used in constructing all water /sewer lines that affect agriculture lands or appurtenant agricultural drainage facilities. This plan shall adhere to the Construction Standards for Water Transmission Mains Located Wholly or Partially in an Agriculture District. No construction shall be commenced prior to the approval of the plan by this Department. 3. If, after the construction of the water lines, a conflict arises between the water lines and an agricultural drainage project, the permittee shall bear all expenses associated with relocating the water line or drainage system. The expense shall be limited to a one -time accommodation of drainage projects that are designed in accordance with Soil Conservation Service and County Soil and Water Conservation District Standards. 4. The permittee shall not provide water to any new, non- agricultural customers who located within the agricultural district Larry Tvaroha, Councilman after the date of this permit. Such customers may later be served if the agricultural district boundaries are modified to exclude them. (This future service restriction shall not apply to agriculturally related structures or to lands or structures that have been approved by the involved governing body prior to the filing of the Notice of Intent with the New York State Department of Agriculture and Markets to construct the water line.) Vote of Town Board (Aye) Jeffrey Cleveland, Councilman Vote of Town Board (Aye) Larry Tvaroha, Councilman Vote of Town Board (Aye) Jeannine Kirby, Supervisor EJ • continued February 15, 1995 RESOLUTION, offered by Mr. Tvaroha and seconded by Mr Cleveland: WHEREAS, the Town of Lansing operates under the New York State Civil Service Law for the hiring and promotion of individuals for Town employment, and WHEREAS, the New York State Civil Service Law currently has a if rule of three" which requires the Town of Lansing to only consider for employment the individuals with the three highest Civil Service exam scores, and WHEREAS, the current system unduly ability to consider factors other than attitude, personality, speaking ability, motivation, and restricts the Town's test scores, such as personal grooming and WHEREAS, the New York State Personnel Officer's Association is proposing a change to a "rule of ten" to allow municipalities to choose among the individuals with the top ten scores on the Civil Service Exam rather than the top three, and has requested support for this proposal, therefore, it is RESOLVED, that the Town of Lansing indicates its support for the proposal of the New York State Personnel Officer's Association for a change to a rule of ten to allow municipalities to choose among the individuals with the top ten scores on the Civil Service Exam rather than the top three. Vote of Town Board (Aye) Jeffrey Cleveland, Councilman Vote of Town Board (Aye) Larry Tvaroha, Councilman Vote of Town Board (Aye) Jeannine Kirby, Supervisor Mrs. Kirby reported on the Mini Bus fund. She stated that some of the Senior Citizen's approached her regarding the $ 2,500.00 the Town donates to them each year. Some felt this money was being use to subsidize out -of -town senior citizens. The handicapped bus is quite large and they are looking into buying a car to transport Senior's to doctor's appointments, etc. Mrs. Kirby stated that maybe the $ 2,500.00 could be allocated to go towards a car. The Town Board felt priority should be with the Lansing citizen's first and then outsiders. Rich John questioned if LOAP had a written policy on what a vehicle could be used ofor and if they do not have one, they should obtain one. Mr. Tvaroha will check into used cars at Cornell University and get back to the Board at a later date. Mr. John stated that he sent the resolution regarding the road abandonment to the Town of Caroline. This was regarding minimum maintenance roads. The Town Board felt this could be helpful in the Town of Lansing. WHEREAS, the Town of Lansing receives a share of sales tax revenue through the County of Tompkins; and WHEREAS, Mrs. Kirby stated that the State DOT had sent her a letter for a plan that this back for a light at the Rogues Harbor intersection. She stated the State DOT, the Town of Lansing and Cargill could approach in a joint venture. Mr. John will contact Bob Mulvey and get to the Board with his findings. RESOLUTION, offered by Mr. Tvaroha and seconded by Mr Cleveland. WHEREAS, the Town of Lansing receives a share of sales tax revenue through the County of Tompkins; and WHEREAS, the sales tax revenue received from the County of Tompkins prior to 1993 was credited towards the Town of Lansing real property levy, and ($ 67,000.00) and agrees WHEREAS, since 1993 the Town of Lansing has received the sales tax revenues in cash rather than credit, WHEREAS, payments made there is an in years prior agreed upon lability to 1993 due to arising the from credit County of Tompkins from the Town of Lansing in the amount of Sixty -Seven Thousand and 00/100 Dollars ( $ 67,000.00); and and 00/100 Dollars ($ WHEREAS, the Town of Lansing and the County of Tompkins have agreed to a repayment schedule of the above mentioned liability over eight calendar quarters with at least fifty percent repaid in the first year, therefore, be it RESOLVED, that the Town of Lansing acknowledges an agreed upon debt to the County of Tompkins in the amount of Sixty -Seven Thousand and 00/100 Dollars ($ 67,000.00) and agrees to repay that amount to the County of Tompkins over eight calendar quarters with at least fifty percent repaid in the first year.
