The Lansing Town Board met in Special Session at 7:00 p.m. at
the Lansing Town Hall Board Room with Supervisor Kirby presiding.

VISITORS: David Herrick, Bob Supko, Peter and Jackie Larson.
The Public Hearing on proposed Water District No.. 18 was
called to order at 7:00 p.m. The proposed district was discussed.
All persons desiring to be heard, having been heard, the
Public Hearing was terminated at 7:11 p.m.
Discussion was held concerning the condition of Whispering
Pines Drive and Arrowood Lane. Mr. Larson, Lansing Highway
Superintendent offered several suggestions on how to repair the
roads. The Town Board and Highway Superintendent decided to pave
from Hillcrest Lot # 3 with two inches of hot asphalt, 540 feet by
20 feet. This is probably the worst part of the road. 150 ton at
$4500 plus one day paver rental at $ 1200 - Total $ 5,7000000
Shoulder will have to be built up in the area paved.
One spot on Whispering Pines needs to be dug out 80 feet long,
22 feet wide, one foot deep and 18 inches put back in to raise the
road to take out the dip. Two days, 3 men, 2 trucks, and gradall to
dig out and fill back in and put fabric down. Estimate gravel at
200 ton. This is scheduled to be done in June.
If Arrowood is to be paved, there is a bad spot that will need
to be dug out 60 feet by 22 feet. This will take approximately two
days to do.
Mrs. Kirby will send Mr. Kemple a letter informing him of the
work Superintendent Larson will be performing.
Discussion was held regarding the sewer permits allowed to the
Town of Lansing. In Horizon Estates, three (3) are needed for
vacant lots. Eleven (11) lots with septic systems will have first
refusal. This will leave 6 remaining.
Mr. Herrick discussed the large landowners in the proposed
Water District No. 17. Mr. Herrick stated that he has informed
them that because of lower water pressure on some of their land
that they or a developer will have to build additional
infrastructure to correct the low water pressure.
The following people approached the Town Board regarding Bill
George Road:
Eric Trotter, Mr. Campbell, Mr. Jewett, Mr. and Mrs. Cook, Mr.
and Mrs. Swayze, Mrs. Juracka, and Attorney's Charles Guttman and
Chris Michaels.
Attorney Rich John discussed the fact that Bill George
extension is a very narrow road and that it would be impossible to
bring the road up to Town specifications. He offered the residents
to improve the extension at least to be as good as Bill George
Road. Also, money in the amount of a $ 20,000.00 range was offered
to help out with a Homeowner's Association after Bill George
Extension has been abandoned. Nothing was settled at this time.
The Attorneys will meet again in the near future to settle this
situation. If this cannot be settled, it will go to court.

ORDER AND RESOLUTION OF THE TOWN BOARD, TOWN OF LANSING
ESTABLISHING WATER DISTRICT NO. 18

WHEREAS, a map. plan, and report have been prepared in such
manner and in such detail as has heretofore been determined by the
Town Board of the Town of Lansing, relating to the establishment of
a proposed water district in the Town; and
WHEREAS, such map, plan and report have been duly filed in the
Town Clerk's Office in said Town; and
WHEREAS, said map, plan and report were prepared by T.G.
Miller, P.C. David A. Herrick being duly licensed by the State of
New York, which showed the boundaries of the proposed district, a
general plan of the water system and a report of the proposed
improvements, the estimated expense of these improvements, the
proposed method of financing, which map, plan and report are on
file in the Town Clerk's Office for public inspection, and all
other matters required by law to be stated; and
WHEREAS, the map shows the proposed water district, water
mains, fire hydrants and other related and necessary appurtenances;
and

WHEREAS, said Order was published and posted as required by
law, and
WHEREAS, a public hearing on the matter was held by the Town
Board on May 11, 1994 at 8:00 p.m. and continued on May 18 and May
26, 1994, and the matter was fully discussed and all interested
parties and persons were heard.
Upon the evidence given at the hearing and upon a motion duly
made by Councilman Larry Tvaroha, seconded by Councilman Paul
Butler, and the following resolution was unanimously adopted.
It is hereby determined that:
(a) The notice of hearing was published and posted as required
by law, and it is otherwise sufficient.
(b) All the property owners within the proposed district are
benefited thereby.
(c) All the property and property owners benefited are
included within the limits of the proposed district.
(d) The establishment of this district is in the public
interest.
IT IS RESOLVED that the district as set forth in the map, plan
and report be approved, that the requested improvement be
constructed and that the necessary easements and lands be acquired
upon the required funds being made available and provided for.
IT IS FURTHER RESOLVED, that this district shall be known as
Water District 18 in the Town of Lansing and shall be bounded and
described as follows: see Exhibit A attached.
IT IS FURTHER RESOLVED, that the proposed improvement,
• including construction costs, cost of acquisition of lands and
easements, legal and engineering fees, and all other expenses, be
financed by the issuance of serial bonds of the Town of Lansing to
mature in a number of annual installments not exceeding twenty (20)
years as may be determined by the Town Board, the cost of
constructing Water District 18, to be assessed by Town Board in
accordance with an Inducement Agreement entered into by and between
the Town of Lansing and Marvin Eastman, Tom Besemer, Cayuga Crushed
Stone, Inc. and Cargill, Inc.
IT IS FURTHER RESOLVED that this resolution is subject to
permissive referendum as provided in Town Law, Section 209 -E in the
manner provided in Article 7 of the Town Law.
IT IS FURTHER RESOLVED that the establishment of Water
District 18 is subject to approval by the New York State Department
of Audit and Control.
