The Supervisor called the meeting to order and had the clerk take the Roll Call. Proof of Notice having been furnished by the Town Clerk, the Public Hearing on the PROPOSED TOWN BUDGET FOR THE YEAR 1992 was called to order at 7:30 P.M. No one appeared voicing any objection to the Proposed Budget for the year 1991, and all persons desiring to be heard, having been heard, the Public Hearing was terminated at 8:10 p.m. Barbara Berry thanked the Board for their continued confidence in the Community Council and Youth Programs. Mr. Dan Buchanan, Sam Myers, and Doug Volbrecht, representatives from NYSE &G addressed the Board requesting an easement to go across Town property and install service to a storage building located on rear portion of parcel 30.71 -23.. This would be more feasible for the customer than to install service off of Peruville Road. It was the consensus of the Board to have the customer attend the next Board meeting to further clarify the request. The Supervisor presented her monthly report. RESOLUTION offered by Mr. Beckwith who moved its adoption, seconded by Mr. Cleveland. The Town automatic document feed, 10 bin collator, and enlargement capabilities, standard and legal of 80,000 to 90,000 copies per year.. (Aye) Jeannine Kirby, Supervisor RESOLUTION offered by Mr. Beckwith who moved its adoption, seconded by Mr. Tvaroha: WHEREAS, the Town Board of the Town of Lansing, Tompkins County, ,J New York, in conjunction with the Village of Lansing and the Village of Cayuga Heights, and the Towns of Dryden and Ithaca, has determined and agreed to participate in the provision of a joint water project for zebra mussel control and to contract joint indebtedness therefor in accordance with Section 15.00 of the Local Finance Law pursuant to a Supplement to Agreement of Municipal Cooperation for Construction, Financing and Operation of an Inter - Municipal Water Supply and Transmission System dated as of October 15, 1991 (the "Intermunicipal Agreement Supplement "); and WHEREAS, the Town Board of the Town of Lansing, Tompkins County, New York, has had under consideration for said purpose the joint increase and improvement of the facilities of the McKinney Water District, Borg Warner Water District, Cima Water District Nos. 5 and 6 and Lansing Water District Nos. 2,7,9,10,11,13,14 and 15 in and for said Town, consisting of the purchase and installation of a sodium hypochlorite chemical feed system at the Raw Water Pump Station at Bolton Point in the Village of Lansing, together with approximately 400 linear feet of 6 -inch carrier pipe containing 1 -inch chemical feed and sample lines, chlorine defuser rings, a protective shroud mounted on the intake screen structure and other incidental improvements and expenses necessary in connection therewith; and WHEREAS, a map, plan and report including an estimate of cost, relating to said joint increase and improvement of facilities has been duly prepared; and WHEREAS, the maximum estimated cost to said Districts of such joint increase and improvement is initially determined to be $30,591, it being further determined that the remaining $269,409 of the maximum estimated cost of this project shall be initially apportioned and allocated to the Village of Lansing and Cayuga Heights and water districts in the Town of Dryden and a water improvement area in the Town of Ithaca and that joint indebtedness shall be issued therefor and that the ultimate share of the cost to be allocated to the Town of Lansing pursuant to the aforedescribed Intermunicipal Agreement Supplement shall be determined on the basis of benefits received or conferred or to be received or conferred from the aforesaid improvement; and WHEREAS, the actual cost shall be annually apportioned among such Districts by said Town Board and the amounts so apportioned shall be annually assessed upon all the taxable real property in each such District at the same time and in the same manner as other Town charges, in an amount sufficient to pay said principal and interest as the same become due and payable, but if not paid from such source, all the taxable real property within said Town shall be subject to the levy of ad valorem taxes without limitation as to rate or amount sufficient to pay the principal of and interest on said bonds; and WHEREAS, the aforesaid project has been determined to be an Unlisted Action pursuant to the regulations_ of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act, the implementation of which as proposed, the Town Board has determined will not result in any significant environmental effects; and WHEREAS, it is now desired to call a Public Hearing on said proposed joint increase and improvement and the map, plan and report including estimate of cost pursuant to Section 202 -b of the Town Law; NOW, THEREFORE, BE IT ORDERED, by the Town Board of the Town of Lansing, Tompkins County, New York, as follows. SECTION 1. A meeting of the Town Board of the Town of Lansing Tompkins County, New York, shall be held at the Town Hall in Lansing, New York, in said Town, on the 20th day of November, 1991 at 7:45 o'clock p.m., prevail=ing time, for the purpose of conducting a Public Hearing on the proposed joint increase and improvement of the facilities of the McKinney Water District, Borg Warner Water District, Cima Water District Nos. 5 and 6 and Lansing Water District No's. 2,7,9,10,11,13,14 and 15 in said Town and the map, plan and report including estimate of cost as described in the preambles hereof, at 184 November 06, 1991, continued which time and place said Town Board will hear all persons interested in the subject thereof concerning the same. SECTION 2. The Town Clerk is hereby authorized and directed to cause a notice of said Public Hearing to be published in the Ithaca Journal, the official newspaper of said Town, and posted in the manner prescribed by law, which notice shall be in substantially the following form, to wit: NOTICE OF PUBLIC HEARING PLEASE TAKE NOTICE that the Town Board of the Town of Lansing, Tompkins County, New York, will meet at the Town Hall, in Lansing, New York, in said Town, on the 20th day of November, 1991, at 7 :45 o'clock p.m., prevailing time, for the purpose of conducting a Public Hearing relating to the proposed joint increase and improvement of the facilities of the McKinney Water District, Borg Warner Water District, Cima Water District Nos. 5 and 6 and Lansing Water District Nos. 2,7,9,10,11,13,14 and 15 in said Town, consisting of the purchase and installation of a sodium hypochlorite chemical feed system at the Raw Water Pump Station at Bolton Point, together with approximately 400 linear feet of 6 -inch carrier pipe containing 1 -inch chemical feed and sample lines, chlorine defuser rings, a protective shroud mounted on the intake screen structure and other incidental improvements and expenses necessary in connection therewith, at an initial maximum estimated cost to said Districts of $30,591, at which time and place said Town Board will hear all persons interested in the subject thereof concerning the same. The remaining $269,409 of the intial maximum estimated cost of this project shall be intially apportioned and allocated to the Villages of Lansing and Cayuga Heights and water districts in the Town of Dryden and a water improvement area in the Town of Ithaca. Joint indebtedness shall be issued for this project. The maximum estimated cost of this joint project is $300,000. The actual cost shall be annually apportioned among such Districts by said Town Board and the amounts so apportioned shall be annually assessed upon all the taxable real property in each such District in the Town at the same time and in the same manner as other Town charges, in an amount sufficient to pay said principal and interest as the same become due and payable, but if not paid from such source, all the taxable real property within said Town shall be subject to the levy of ad valorem taxes without limitation as to rate or amount sufficient to pay the principal of and interest on said bonds. (Aye) Jeannine Kirby, Supervisor RESOLUTION offered by Mr. Beckwith who moved its adoption, seconded by Mr. Emmick: BE IT RESOLVED, that a Public Hearing beheld at Room 101 of the Lansing High School on December 04, 1991 at 7:00 p.m. for the purposes of discussing with all interested parties the establishment of a water storage and distribution district and for the funding of the cost thereof and the payment for any bonds of the town which are used for the capital improvement in said district. Copies of the proposed methods of payment have been provided in the news letter and shall be on file in the Town Clerk's Office for anyone desiring to look at the proposals prior to said meeting. The district would include all properties within the benefit area and the benefit area would include only those areas of the Town now served by public water as well as any water district to be formed in the future. The Town Board urges all residents to attend the Public Hearing and to participate in the decision as to this proposed new district. Vote of the Town Board . . . In the matter of the establishment of a Town water storage and distribution district pursuant to the Town Law of the State of New York, the following resolution was discussed and duly passed upon motion being made by Herbert Beckwith and seconded by Louis Emmick, BE IT RESOLVED, that a public hearing be had at Room 101 of the Lansing High School on December 4, 1991 at 7:00 p.m, for the purposes of discussing with all interested parties the establishment of a water storage and distribution district and for the funding of the cost thereof and the payment for any bonds of the Town which are used for the capital improvement in said district.
