JANUARY 30, 1991
The Lansing Town Board met in Special Session at the
Lansing Town Hall on January 30, 1991 at 7 :00 P.M. with
Supervisor Kirby presiding.

The bids were then given to Mr. Larson to check over. He
will give the Board his recommendation at a later date. Mr. Larson
did state that he had the truck to-possib-ily be trader in-appraised

Proof of Notice having been furnished, the Public Hearing
to consider an amendment to Local Ordinance No.-5 of 1966 -
Tax Ememption for Senior Citizen's was called to order at 7:03 P.M.
No one appeared voicing any objection to the proposed
Amendement to Ordinance No. 5 of 1966, all persons desiring to
be heard, having been heard, the Public Hearing was terminated at
7:04 P.M.
RESOLUTION offered by Mr. Emmick who moved its adoption,
seconded by Mr. Tvaroha:
WHEREAS, a Public Hearing has been held on January 30, 1991
at 7 :03 P.M. in the evening thereof on proposed Amendement to
Ordinance No. 5 of the year 1966, and
WHEREAS, no one appeared voicing any objection, now therefore
be it
RESOLVED, that said Amendement to Ordinance No. 5 of the
year 1966 be and the same is hereby duly adopted. Copy of same
attached hereto and made a part thereof.

Proof of Notice having been furnished, the Public Hearing
on Proposed Local Law No. 1 for the year 1991, which Local Law
entitled "Veteran's Exemption for Real Property Taxes" was called
to order at 7:15 P.M.
Mr. John Myskow stated that other Towns in Tompkins County
are giving larger exemptions than the Town of Lansing has proposed.
Mrs. Kirby stated that she will look into this and get back
to the Board Members.
All persons desiring to be heard, having been heard, the
Public Hearing was terminated at 7:17 P.M.

RESOLUTION offered by Mr. Cleveland who moved its adoption,
seconded by Mr. Emmick:
RESOLVED that the Town Board of the Town of Lansing hereby appoints
Larry Tvaroha to the Tompkins County Hospital Board for a two year
term which begins April of 1991.
Carried.
The Uhrovick situation was discussed. The Town Board and Mr.
Larson will meet again at the Uhrovick property to discuss this
before they go through the abandoment procedure.
The Town Clerk presented Mr. Thaler with the deed to the Jim
Bower property in Myers. He now has this in his office.
A discussion was held in regard to Town employees using
Town owned vehicles for personnel use. It was stated that the tax
law has changed. The law now reads that when an employee uses
a vehicle that is made available for official business, and he or
she keeps it all the time you either have to pay an amount that would
cover your portion of the use of the vehicle to the municipality
on a monthly basis or the employees would have to take a portion as
income on their W -2 form. The liability factor was also discussed.
Mr. Thaler felt the Town should have a policy in regard to this
situation. No action was taken at this time.

Mrs. Kirby will be
meeting with Ted

Wixom in regard to this and
some other problems
in
the
system.
Mr. Thaler informed Mr. Totman that NO certificates of
occupancy ),.are to be issed to anyone in the Lake Watch Development
until the water situation is settled.
Mrs. Kirby will inform Mrs. Juracka that there will be a 70'
radius turn -a -round that will have to be placed in her front lawn
in order for the Town to fix Bill George Road.

resolution.
BE IT RESOLVED, that the intersection of Warren Road with New
York State Route 13 is located within the Town of Lansing; and
Said intersection has continous and heavy traffic passing
through it and utilizing the roads which intersect on their way'
through the Town of Lansing; and
Recognizing that the weather conditions in and about said
intersection mandate that warning be given to vehicles approaching
the intersection from all four directions in a manner which will
insure that the warning is visible and recognizable to the traveling
public at all times and under all conditions,
The Town of Lansing requests that the State of New York and /or
the County of Tompkins erect such warning devices as are necessary
to give appropriate notice to motorists using New York State Route
13 and Warren Road of the intersection at a sufficient distance from
said intersection as will alert said motorists to the condition with
which they are about to be confronted; and
The Town of Lansing, through its Board, respectfully request
that it be kept advised as to what types of signage or warning
devices the State and /or County intends to use.

AMENDMENT TO TOWN OF LANSING ORDINANCE NO. 5
FOR THE YEAR 1966
Ordinance No. 37
The Ordinance of the Town of Lansing known as Ordinance No. 5
entitled ORDINANCE OF THE TOWN OF LANSING, PROVIDING FOR A PARTIAL
TAX EXEMPTION OF REAL PROPERTY OWNED BY CERTAIN PERSON.; WITH
LIMITED INCOME WHO ARE 65 YEARS OF AGE OR OVER, which Ordinance was
adopted on August 9, 1966 and thereafter amended on November 30,
1970, March 11, 1975, February 14, 1978, June 27, 1979, September
9, 1980, July 30, 1982, March 13, 1984, February 11, 1987,
and August 15, 1990 is hereby further amended.
SECTION 1. The provision of the Ordinance of the Town of
Lansing adopted August 9, 1966, as amended from time to time, is
hereby further amended to read as follows:
Section it This Ordinance is enacted pursuaant to
Section 467 of the Real Property Tax Law of the State of New York
as amended by Chapters 588 and 287 of the Laws of 1989.
Section 2. Pursuant to the provisions of Section 467 of
the Real Property Tax Law of the State of New York, real property
located in the Town of Lansing, County of Tompkins, owned by one or
more persons, each of whom is 65 years of age or over, or real
property owned by husband and wife, one of whom is 65 years of age
or over, shall be partially exempt from taxation by said Town for
the applicable taxes specified in Section 467 based upon the income
of the owner or combined income of the owners. A person otherwise
qualifying for such exemption shall not be denied such exemption
if such person becomes 65 years of age after the appropriate
taxable status date and before December 31 of the same year.

This
partial exemption
provided
by
this Ordinance shall,
however,
be limited to such
property
and
persons as meet the
conditions, qualifications, exclusions and limitations set forth in
Section 467 of the Real Property Tax Law of the State of New York.
This Local Law shall be administered in accordance with said
sections
of the Real
Property Tax Law,
as now adopted, and
as
they
may be
amended from
time to time,
and the provisions
of
said
sections
as provided
in Section 467
shall be applicable
to
the
effectuation of the exemption provided for in this Ordinance.
Section 3. Application for such exemption must be made
by the owner or all of the owners of the property on forms
prescribed
by the
State Board
to be
furnished
by the Tompkins
County Assessment
Department and
shall
furnish the
information and
be executed in a manner required or prescribed in such foams and
shall be filed in the Assessment Department Office on or before the
appropriate taxable status date.
Section
4.
Any conviction
of
having made a
willful
false statement
of
the application
for
such exemption
shall
be

punishable by a fine of not more than $100.00 and shall disqualify

the applicant or applicants from further exemption for a period of

five (5) years.
Section S. This ordinance shall, in accordance with the
provisions of Section 2 of Chapter 588 of the laws of 1989, be
applicable to the town tax for the year 1992, and the provisions of
said law shall govern the granting of an exemption under Section
467, notwithstanding any contrary provisions of the section.
SECTION 2. This ordinance shall be effective immediately.
SECTION 3. This ordinance shall be entered in the minu-Ces of
the Town Board and published in the Ithaca Journal and a copy
thereof posted on a sign board maintained by the Town Clerk of the
Town of Lansing pursuant to Subdivision 6 of Section 30 of the Town
Law and affidavit of publication and posted filed with the Town
Clerk.
