January 16, 1991
The Lansing Town Board met in Regular Session with
Supervisor Kirby presiding at 7:00 P.M. at the Lansing Town
Hall Boardroom.

VISITORS: Pete Larson, George Totman and David Herrick.
The Supervisor called the meeting to order and had the
clerk take the Roll Call.
Mr. Emmick thanked Mr. Larson on behalf of the residents
at Woodsedge for the nice job the Highway Department has
done for them.
Mr. Larson reported the following:
1. The County has told Mr. Larson that the Town is still
responsible for the deck and sub deck on the Myers
Bridge. Mr. Larson had a 1989 and a 1990 engineers
report that,stated no major maintenance should be done to
the bridge in Myers as the rest of the bridge is not
capable of carring more than 10 tons.
Mr. Thaler stated that sec. 2348 of the Highway Law
could put the County in charge of repairs if the Town
can show that the whole structure of the bridge is not
in good condition.
2. Bolton Point recommended that the Highway Department
purchase 3" pump with hose and a portable generator
to do water main maintenance. Mr. Larson felt this
should be purchased out of the maintenance of water
lines account. He did not feel that the total should
exceed $ 3,000.000
3. The specifications are written up and available at the
Highway Department for a new ten wheeler truck. The
bid opening will be held on January 30, 19910
4. Pete is painting the offfice at the Highway Department.
50 The salt storage building is now functioning and will
contain 300 ton of salt soon.
Mrs. Kirby stated that she had received a letter stating
that the speed limit reduction has been approved for Algerine
Road, Lansing Station Road, Triphammer Terrace and Armstrong
Road
Dave Herrick, Town Engineer reported the following.
1. Water District No. 16: Mr. Thaler will do a final draft
of the proposed agreement between the Village and the
Town and send it to Randy Marcus (Attorney for the Village)
for his approval.
2. Mr. Thaler has written a letter to Mr. Swearingen and is
waiting for his reply.
3. Bolton Point has .requested the Town Engineer and the, Town
Code EnforcementiOfficer to assist them with turning off
a customers water service if they are not in compliance
with state building codes or the State Health department
codes. The Town Engineer, Code Enforcement Officer and the
Town Board did not agree with this approach. Dave Herrick
will respond. to Bolton Point in regard to this matter.
4. Mr. Herrick went over his llpage report on his evaluation
of sewerage options with the Board Members. He will give
Mr. Noel Desch a copy of said report and have him compare
his figures with Mr. Herrick's. The Town Board felt it
would be far to expensive for any homeowner and could not
consider
it
at this time.

Mr. Totman gave his monthly report. He also compared the
totals to other Towns. Mr. Totman stated that he would like to
amend the Junk Yard Ordinance to include the following:
A Junk Yard owner would be required to:
1. Remove batteries form all cars
2. Remove all gas tanks
3. Keep a record of all incoming and outgoing cars.
Mr. Thaler and Mr. Totman will get together to discuss any
proposed additions and /or changes to the Junk Yard Ordinance and
will then get back to the Board members to set a Public Hearing_
date.
RESOLUTION offered by Mr. Emmick who moved its adoption.,
seconded by Mr. Beckwith:
RESOLVED, that the Town Board of the Town of Lansing hereby
approves the sub division rules and regulations.
Carried.
Mr. Thaler has sent Mr. Leathers and Cheryl Nickels a letter
stating that unless an approved time table for the corrections
of the defects established the road will be closed for public use.
Mr. Herrick received a phone call from Mr. Leather's office stating
that they had received the letter and would be responding to it.
Mrs. Kirby, Mr. Herrick, Mr. Larson and Mr. Thaler will_ meet
with Mr. Phil Winn, Mrs, Kym, George Schlecht and'1their contractor
to discuss the location of the road and the location of the water
line.
RESOLUTION offered by Mr. Emmick who moved its adoption,
seconded by Mr. Beckwith:
RESOLVED that the Town Board of the Town of Lansing will hold
a Public Hearing on the proposed Veteran's Exemption on January
30, 1991 at 7:15 P.M.
Carried.
Copy of said Resolution attached hereto and made a part
thereof.
RESOLUTION offered by Mr. Beckwith who moved its adoption,
seconded by Mr. Emmick:
RESOLVED that the Town Board of the Town of Lansing will hold
a Public Hearing on January 30, 1991 at 7:00 P.M. on the proposed
Senior Citizen's tax exemption.
Carried.
Copy of said Resolution attached hereto and made a part
thereof.
RESOLUTION offered by Mr. Beckwith who moved its adoption,
seconded by Mr. Beckwith:
RESOLVED that the Town :Board hereby appoints Viola Miller
Mullane to the Lansing Planning Board beginning January 1, 1991
through December 31, 19970
Carried,
Richard Thaler will prepare a deed in regard to the James Bower
property. He will report to the Board at a later date.
Mr. Emmick stated that the minutes of January 9, 1991 ;should
state =: that they were taken by Supervisor Kirby and transcribed by
' the Town Clerk before they could be approved.
AUDIT RESOLUTION offered by Mr. Emmick who moved its adoption,

AMENuMENT,TO TOWN OF LANSING ORDINANCE NO. .5
FOR THE YEAR 1966— ORDINANCE NO. 37
The Ordinance, of the Town of Lansing known as Ordinance
No. 5 entitled ORDINANCE OF THE TOWN OF LANSING, PRO-
VIDING FOR A PARTIAL TAX EXEMPTION OF REAL PROPERTY
OWNED BY CERTAIN PERSONS WITH LIMITED INCOME WHO
ARE 65 YEARS OF ' AGE OR OVER, which Ordinance was )
adopted on August 9, 1966 and thereafter amended on No- I
vember 30, 1970, March 11, 1975, February 14, 1978, June 27,
1979; September 9, 1980, July 30, 1982,' March 13, 1984; Feb- i
ruary 'll, 1987 and August 15, 1990 is hereby further j
amended.
SECTION 1. The provision of the Ordinance of the Town of Lan- j
sing adopted August 9, 1966, as amended from time to time, }
is hereby further amended to read as follows:
Section 1. This Ordinance is enacted pursuant to Section 467 of {
the Real Property Tax Law of the State of New York as {
amended by Chapters 588 and 287 of the Laws of 1989.
Section 2. Purusont to the provisions of Section 467 of the Real
Property Tax Low of the State of New York, real property lo-
cated in the Town of Lansing, County of Tompkins, owned by
one or more persons, each of whom is 65.years of age or
over, or real property owned by husband and wife, one of
whom is 65 years of age or over, shall be partially exempt
from taxation by said Town for the applicable taxes specified j
in Section 467 based upon the - income of the owner or com-
bined incomes of the owners. A person otherwise qualifying -,,
for such exemption shall not be denied such exemption if
such person becomes -65 years of age after the appropriate
taxable status date. and. before December 31, of the some
year.

This partial exemption provided by this Ordinance shall, how-
ever, be limited to such'property and persons as meet the con-
ditions, qualifications, exclusions and limitations set forth in
.Section 467 of the Real Property Tax Law of the State of New C
York. This Local Law shall be administered in accordance with.
said sections of the Real Property Tox,Law, as now adopted, i
and as they maybe amended from time to time, and the pro -'
visons of said sections as provided in Section 467 shall be ap-
plicable to the effectuation of the exemption provided for in I
this Ordinance.
Section 3. Application for such exemption must be made by
the owner or all of the owners of the property on forms pre-
scribed by the State Board to be furnished by the Tompkins i
County Assessment Department and shall furnish the informa-
tion and be executed in a manner required or prescribed in t
such forms and shall be filed in the Assessment Department
Office on or before the appropriate taxable status date.'
Section 4. Any conviction of having made a willful false
statement of the application for such exemption shall be pun -
ishobie by a fine of not more than $100.00 and shall disqualify
the applicant or applicants from further exemption for a peri-
od of five (5) years.
Section 5. This Ordinance shall, in accordance with the provi-
sions of Section 2. of Chapter 588,of the laws of 1989, be ap-i
plicable to the town tax for the year 1992, and the provisons
of said law shall govern the granting of an exemption under
Section A67, notwithstanding contrary provisions of the' sec-
tion. I
SECTION 2. This ordinance shall be effective immediately. }'r
SECTION 3. This ordinance shall be entered in the minutes of 1
the Town Board and published in the Ithaca Journal and a {
copy thereof posted on a sign board maintained by the Town'
Clerk of'the Town of Lansing pursuant to Subdivison 6 of, Sec-
lion 30 of the Town Law and affidavit of publication and-post-
ed filed with the Town,Clerk.
