On motion, meeting adjourned at the call of the Superviosr at 11 :10 P.M. The Lansing Town Board met in Special Session at the Lansing Town Hall Boardroom on July 03, 1990 at 8:00 Town Clerk P.M. with Supervisor Kirby presiding. RESOLUTION offered by Mr. Tvaroha, who moved its adoption, seconded by Mr. Emmick: RESOLVED that the Lansing Town Board approve one voucher for the baseball tournament fee in Moravia. (Aye) Jeannine Kirby, Supervisor 1 FINAL ORDER OF THE TOWN BOARD, TOWN OF LANSING ESTABLISHING EXTENSION #6 OF LANSING WATER DISTRICT NO. 7 An Engineer's Report dated March 21, 1990 having been prepared by TG Millers & Associates, P.E., L.S., Ithaca, New York and a map, plan and report for providing the facilities, improvements and services in a portion of the Town of Lansing wherein extension #6 of Water District No. 7 hereinafter described was proposed. to be established, and said map, plan and report having been duly filed in the Office of the Town Clerk on March 21, 1990 and an Order having been duly adopted by the Town Board of the Town of Lansing on March 21, 1990 reciting the description of the boundaries of the proposed district, the maximum amount proposed to be expended for the improvement, the fact that a plan, map and report describing the same are on file in the Town Clerk's Office for public inspection specifying that said Town Board shall meet at the Town Hall in the Town of Lansing on the 11th day of April, 1990 at 8:00 p.m. for the purpose of conducting a public hearing on such proposal to establish extension #6 of Water District No. 7 with the specified improvements and to hear all persons interested in the subject thereof concerning the same, and a hearing having been duly held by said Board at such time and place, and it having been duly resolved and determined following such hearing that the notice of hearing was published and posted as required by law and otherwise sufficient that all of the property and property owners within the proposed district were benefited thereby, that all property and property owners benefited were included within the limits of the r i 1 f W proposed district and that it was in the public interest to grant in whole the relief sought, and it having been then and there further resolved that the establishment of such district as proposed be approved, subject to permissive referendum in the manner provided in Article 7 of the Town Law, and that subject to the permission of the Comptroller for Extension #6 of Water District No. 7 pursuant to Section 209 -F of the Town Law, it is hereby ORDERED, that Extension #6 of Lansing Water District: 7 be established in the Town of Lansing, Tompkins County, New York and be designated as Extension #6 of Lansing Water District 7 of the Town of Lansing and to be of the following description and boundaries to wit: All that tract or parcel of land situate corner of tax of Lansing (T) in the Town of Lansing, County of Tompkins, State of New York being described as follows: Beginning at a point in the northwest corner of tax parcel 30 -1- 16.12, 30 -1 -15, District and No. said point being the northeast also being in the east boundary 7, Extension No. 2; corner of tax of Lansing (T) parcel Water Thence, distance east of along the north boundary of tax parcel 30 -1 -16.12 1266.5 feet, more or less, to the northeast a corner thereof; Thence, south along the east boundary of said parcel a distance of 915 feet, more or less, to the northeast corner of tax parcel 30 -1 -21; Thence, west a distance of 544.5 feet, more or less, to the northwest corner of tax parcel 30 -1 -17; Thence, south along the west boundary of tax parcel 30 -1 -17 a distance of 200 feet, more or less, to the centerline of Peruville Road; 2 f i Thence, west along the centerline of Peruville Road a distance of 660 feet, more or less, to a point being in the east boundary of Lansing (T) Water District No. 7, Extension No. 2; Thence, north along the east boundary of Lansing (T) Water District No, 7, Extension No. 2 a distance of 760 feet, more or less,, to a point in said boundary; Thence, westerly along the boundary of Lansing (T) Water District No. 7, Extension No. 2 a distance of 318.5 feet, more or less, to the point or place of beginning. The above described parcel containing an area of 26 acres, more or less. And it is further ORDERED, that the following improvements in said District be constructed in two phases upon the required funds being made available or provided for: the first phase of the project consists of the construction of approximately 1,000 feet of 8" diameter ductile iron water main, together with valves, fire hydrants and other related and necessary appurtenances and the second phase consists of the construction of approximately 970 feet of 8" diameter ductile iron water main, together with valves, fire hydrants and other related and necessary appurtenances; and, it is further ORDERED, that the proposed improvements, including the costs of right of way construction costs, legal fees and other expenses of phase one of the project shall be financed by the issuance of a bond anticipation note by the Town of Lansing, the cost of phase two of the project shall. be wholly financed by the owners of the Crossroads Square Mall and at no cost to the Town or its tax payers; and it is further 3 i�-' ORDERED, that the Town Clerk of the Town of Lansing is hereby authorized and directed to cause an application for the approval of extension #6 to Water District No. 7 together with the documents required pursuant to Town Law Section 209 -F to be sent to the State Department of Audit and Control at Albany, New York within ten (10) days after the adoption of this Order.
