BOARD RESOLUTION OF TOWN BOARD FOR PERMANENT FINANCING
OF THE CONSTRUCTION OF LANSING WATER DISTRICT NO. 9
At a meeting of the Town Board of the Town of Lansing,
Tompkins County, New York, held at the Town Hall on the 30th day of
October, 1989, at 8:00 o'clock in the afternoon, Eastern Daylight
Saving Time.

The following resolution was offered by Councilman Larry
Tvaroha, who moved its adoption, seconded by Councilman Lewis
Emmick, to wit:
BOND RESOLUTION DATED OCTOBER 30, 1989, A RESOLUTION AUTHORIZING
THE ISSUANCE OF $735,000, SERIAL BONDS OF THE TOWN OF LANSING, NEW
YORK, FOR THE CONSTRUCTION OF APPROXIMATELY 17,200 FEET OF 10", 8"
AND 6" DIAMETER DUCTILE IRON WATER MAINS TOGETHER WITH VALVES, FIRE
HYDRANTS, WATER SERVICES TO STREET RIGHT -OF -WAYS AND OTHER RELATED
AND NECESSARY APPURTENANCES IN AND FOR THE LANSING WATER DISTRICT
N0, 9 OF THE TOWN OF LANSING, TOMPKINS COUNTY, NEW YORK AT A
MAXIMUM ESTIMATED COST OF $735,000.
WHEREAS, after a public hearing had been duly called, held and
conducted on the 5th day of April, 1989, the Town Board of the Town
of Lansing adopted a resolution on the 5th day of April, 1989,
authorizing and approving the establishment of Water District No. 9
for the Town of Lansing and the construction of said water district
therein, and
WHEREAS, pursuant to proceedings heretofore had and taken in
accordance with the provisions of Article 12 -A of the Town Law of
the State of New York and more particularly in an Order dated April
5, 1989, the Town of Lansing, Tompkins County, New York has
established Lansing Water District No. 9 of the Town of Lansing, and
WHEREAS, it is now desired to provide for the issuance of
$735,000 serial bonds to pay the cost of the installation and
construction of Water District No. 9 in said Town pursuant to the
Order of the Town Board, and
WHEREAS, all conditions precedent to the financing of the
capital project described in the Town Board Order of April 5, 1989
including compliance with the State Environmental Quality Review
Act have been performed,
NOW, THEREFORE, BE IT
RESOLVED by the Town Board of the Town of Lansing, Tompkins
County, New York, as follows:
Section 1. For the purpose of paying the. cost of the
construction of said improvements as discussed in the aforesaid
proceedings of Lansing Water District No. 9 in and for the Town of
Lansing, Tompkins County, New York, there are hereby authorized to
be issued, pursuant to the Local Finance Law, serial bonds of the
Town of Lansing, Tompkins County, New York, in the principal amount
of $735,000.
Section 2. The estimated maximum cost of such object or
purpose is $735,000. The plan of financing the same consists of
the issuance of said serial bonds.
Section 3. All other matters except as provided herein
relating to such bonds shall be determined by the Supervisor. Such
bonds shall contain substantially the recital of validity clause
provided for in Section 52.00 of the Local Finance Law and shall
otherwise be in such form and contain such recitals, in addition to
those required by Section 1.00 of the Local Finance Law, as the
Supervisor shall determine.
Section 4. It is hereby determined that subdivision 1 of
paragraph a. of Section 11.00 of the Local Finance Law applies to
such object or purpose and that the period of usefulness thereof is
20 years computed from the date of the issuance of the first serial
bond or the first bond anticipation note issued therefore. It is
hereby further determined that the maximum maturity of the serial
bonds herein authorized will exceed five years.
Section 5. The faith and credit of the Town of Lansing,
Tompkins County, New York, are hereby irrevocably pledged to the
payment of the principal
of and
interest
on such bonds as the same
become due and payable.
There
shall be
annually apportioned and
assessed upon the several
lots
and parcels
of land in said Lansing

Water District No. 9 especially benefited by said improvements in
proportion to the amount of benefit which said improvements shall
confer upon the same, and in the manner provided in Section 202 -a
of the Town Law for the assessment of the cost of maintenance in a
water district, an amount sufficient to pay the principal and
interest of said bonds as the same becomes due. In the event that
the annual collection of such assessments shall be less than the
amount required to pay the principal and interest of said bonds as
they shall become due, the Town Board shall direct that surplus
moneys not otherwise appropriated by applied.
Section 6. The powers and duties of advertising such bonds
for sale, conducting the sale and awarding the bonds, are hereby
delegated to the Supervisor who shall advertise such bonds for
sale, conduct the sale and award the bonds in such manner as he
shall deem best for the interests of said Town, provided, however,
that in the exercise of these delegated powers she shall comply
fully with the provisions of the Local Finance Law and any order or
rule of the State Comptroller applicable to the sale of municipal
bonds. The receipt of the Supervisor shall be a full acquittance
to the purchaser of such bonds who shall not be obliged to see to
the application of the purchase money.
Section 7. The validity of such bonds or any bond
anticipation note or notes issued thereon in anticipation of the
sale of said bonds pursuant to this bond resolution may be
contested only if such obligations were authorized for an object or
purpose for which the Town of Lansing, Tompkins County, New York is

not authorized to expend money or if the provisions of law which
should have been complied with as of the date of publication of
this notice were not substantially complied with, and. an action,
suit or proceeding contesting such validity is commenced within
twenty days after the date of publication or such obligations were
authorized in violation of the provisions of the Constitution.
Section 8. This resolution, which takes effect immediately,
shall be published in full in the Ithaca Journal, which is hereby
designated as the official newspaper of said Town for such purpose,
together with a notice of the Town Clerk in the form as provided in
Section 81.00 of the Local Finance Law.
The question of the adoption of the foregoing resolution was
- - duly put to a vote on roll call which resulted as follows:

Town of 'Lansing adopted a resolution on the 7th day of September,
1988, authorizing and approving the establishment of Water District
No. 14 for the Town of Lansing and the construction of said water
district therein, and
WHEREAS, pursuant to proceedings heretofore had and taken in
accordance with the provisions of Article 12 -A of the Town Law of
the State of New York and more particularly in an .Order dated
September 7, 1988, the Town of Lansing, Tompkins County, New York
has established Lansing Water District No. 14 of the Town of
Lansing, and
WHEREAS, it is now 'desired to provide for the issuance of
$550,000 serial bonds to pay the cost of the installation and
construction of Water District No. 14 in said Town pursuant to the
Order of the Town Board, and
WHEREAS, all conditions precedent to the financing of the
capital project described in the Town Board Order of September 7,
1988 including compliance with the State Environmental Quality
Review Act have been performed,
NOW, THEREFORE, BE IT
RESOLVED by the Town Board of the Town of Lansing, Tompkins
County, New York, as follows:
Section 1. For the purpose of paying the cost of the
construction of said improvements as discussed in the aforesaid
proceedings of Lansing Water District No. 14 in and for the Town of
Lansing, Tompkins County, New York, there are hereby authorized to
be issued, pursuant to the Local Finance Law, serial bonds of the
Town of Lansing, Tompkins County, New York, in the principal amount
of $550,000.
Section 2. The estimated maximum cost of such object or
purpose is $550,000. The plan of financing the same consists of
the issuance of said serial bonds.
Section
3.
All
other
matters except
as
provided
herein
relating to
such
bonds
shall be
determined by
the
Supervisor.
Such
bonds shall
contain substantially

in Section 52.00
of
the
Local
Finance Law
and
shall
. otherwise be in such form and contain such recitals, in addition to
those required by Section 1.00 of the Local Finance Law, as the
Supervisor shall determine.
Section 4. It is hereby determined that subdivision 1 of
paragraph a. of Section 11.00 of the Local Finance Law applies to
such object or purpose and that the period of usefulness thereof is
20 years computed from the date of the issuance of the first serial
bond or the first bond anticipation note issued therefore. It is
hereby further determined that the maximum maturity of the serial
bonds herein authorized will exceed five years.
Section 5. The faith and credit of the Town of Lansing,
Tompkins
County, New York,
are
hereby irrevocably
pledged to
the
payment
of the principal of
and
interest
on such bonds as the
same
become due and payable. There shall be annually apportioned and

assessed upon the several lots and parcels of land in said Lansing
Water District No. 14 especially benefited by said improvements in
proportion to the amount of benefit which said improvements shall
confer upon the same, and in the manner provided in Section 202 -a
of the Town Law for the assessment of the cost of maintenance in a
water district, an amount sufficient to pay the principal and
interest of said bonds as the same becomes due. In the event that
the annual collection of such assessments shall be less than the
amount required to pay the principal and interest of said bonds as
they shall become due, the Town Board shall direct that surplus
moneys not otherwise appropriated by applied.
Section 6. The powers and duties of advertising such bonds
for sale, conducting the sale and awarding the bonds, are hereby
delegated to the Supervisor who shall advertise such bonds for
sale, conduct the sale and award the bonds in such manner as he
shall deem best for the interests of said Town, provided, however,
that in the exercise of these delegated powers she shall comply
fully with the provisions of the Local Finance Law and any order or
rule of the State Comptroller applicable to the sale of municipal
bonds. The receipt of the Supervisor shall be a full acquittance
to the purchaser of such bonds who shall not be obliged to see to
the application of the purchase money.
Section 7. The validity of such bonds or any bond
anticipation note or notes issued thereon in anticipation of the
sale of said bonds pursuant to this bond resolution may be
contested only if such obligations were authorized for an object or
purpose for which the Town of Lansing, Tompkins County, New York is
not authorized to expend money or if the provisions of law which
should have been complied with as of the date of publication of
this notice were not substantially complied with, and an action,
suit or proceeding contesting such validity is commenced within
twenty days after the date of publication or such obligations were
authorized in violation of the provisions of the Constitution.
Section 8. This resolution, which takes effect immediately,
shall be published in full in the Ithaca Journal, which is hereby
designated as the official newspaper of said Town for such purpose,
together with a notice of the Town Clerk in the form as provided in
Section 81.00 of the Local Finance Law,

WHEREAS, after a public hearing had been duly called, held and
conducted on the 5th day of April, 1989, the Town Board of the Town
of Lansing adopted a resolution on the 5th day of April, 1989,
authorizing and approving the establishment of Water District No.
15 for the Town of Lansing and the construction of said water
district therein, and
WHEREAS, pursuant to proceedings heretofore had and taken in
accordance with the provisions of Article 12 -A of the Town Law of
