Matter of Juracka, Index No. 89 -1001 Dear Sir /Madam: October 24, 1989 etc. v. Town of Lansing et al. This letter is being sent pursuant to the request of Ms. Nancy Joch, the Supreme Court Clerk, to inform you that the pending Petition will be reviewed on a submission basis, and that Judge Ellison is not scheduled to hear oral argument on November 6, 19890 As you are aware the Juracka's have instituted a petition to have the attempted abandonment of the above - referenced roadway declared unlawful, and to compel this Board to recognize the legal standing of the roadway as a public highway. No motion for a Temporary Restraining Order was made due to the fact that we were assigned to Judge Ellison, who will not be able to hold a hearing in this matter until sometime in early December. We hereby request that the Town and Town Board of Lansing maintain the roadway for the period during which this suit is pending. We request that the roadway be plowed and repaired as is necessary. We also request that the Town Board so resolve at the meeting which next occurs after the receipt of this letter. The Juracka's will waive any claim that this maintenance will be used to show past maintenance by the Town. We are willing to enter into any stipulation to protect the Town's rights, if they will maintain the roadway. 5 0 In the event that the Town will not maintain the roadway, as we allege was done in the past, we will have no choice than to bring an order before Judge Rose for a temporary restraining order.
