RESOLUTION offered by Mr. Beckwith who moved its adoption, seconded by Mr. Cleveland: RESOLVED, that Central New York H & E Co., Inc., of 146 York Street, Auburn, New York is the successful bidder to perform the contract for the installation of Lansing [dater District No. 15 with a total bid of $ 184,640.50 and BE IT FURTHER RESOLVED, that the bid subject to the Town Attorney & To Vote of Town Board . . . . October 16, 1989 The Lansing Town Board met in Special Session at the Lansing Town Hall Boardroom on October 16, 1989 at 5:00 P.M. with Supervisor Kirby presiding. After the Town Board assessed the damage throughout the Town that was caused by the storm that took place on October 14, 1989 the Board made the following Resolution. RESOLUTION At a Special Meeting of the Town Board of the Town of Lansing held at the Town Hall on October 16, 1989 at 5:00 P.M. and after discussion of the damage and emergency situation caused by the storm of October 14, 1989, and upon advice of the Town Attorney, the Town Board, upon a resolution duly made by Louis Emmick and seconded by Larry Tvaroha, unanimously passed the following Resolution. BE IT RESOLVED, that as a result of the storm which struck the Town of Lansing on October 14, 1989 and the emergency situation which the citizens of the Town of Lansing have experienced as a result of the storm, the Town Board requests the Supervisor to declare a state of emergency pursuant to Section 24 of the Executive Law of the State of New York for a Period of five (5) days to commence on October`17, 19890 BE IT FURTHER RESOLVED, that the Supervisor is hereby authorized in the name of the Town to execute an Order declaring such state of emergency. (Aye) Larry Tvaroha, Councilman RESOLUTION At a Special Meeting of the Town Board of the Town of Lansing held at the Town Hall on October 16, 1989 at 5:00 p.m. The purpose of the meeting was to discuss and take action on the conditions in the Town of Lansing as a result of.the severe storm which struck the Lansing area on l t*3 64 continued October 16, 1989 October 14, 1989. During the discussion it was determined that the damage to property in the Lansing area was severe in certain areas with trees being down, uprooted or torn apart, outbuildings and residences being severely damaged. As a result of the discussion, a determination was made by the Board that it was in the best interest of the citizens' safety,health, welfare and a proper use of the police power that a state of emergency be declared. After the discussion was concluded, the following resolution was duly made by Councilman Larry Tvaroha, seconded by Louis Emmick and unanimously passed. BE IT RESOLVED, that although the General Municipal Law dictates that competitive bidding be used in the purchasing of equipment by a municipality, Section 103, Subdivision 4 of the General Municipal Law allows the Town Board, under certain circumstances to waive the competitive bidding mandates as a result of the state of emergency and the emergency created in the Town by the storm of October 14, 1989. It is in the interest of the citizens of the Town of Lansing that the provisions of the General Municipal Law be waived, allowing the Town to make an immediate purchase of a piece of equipment known as a chipper. The Town Supervisor is hereby authorized to purchase such a piece of equipment at the lowest cost possible for the Town without the necessity of the bidding process mandated by the General Municipal Law. BE IT FURTHER RESOLVED, that this piece of equipment be purchased as quickly as possible and be utilized to alleviate the emergency damage experienced by the Town of Lansing. Vehicles may be inspected at the Town of Lansing High - way Garage, Monday through Friday from 6a.m. to 2:30p.m. Said bids will be opened at the regular meeting of the Lansing Town Board, Lansing Town Hall, on October 18, 1989 at 8:00 p.m. The right to reject all bids is expressly reserved.
