FINAL ORDER OF THE TOWN BOARD, TOWN OF LANSING
ESTABLISHING WATER DISTRICT NO. 15 IN THE TOWN OF LANSING

TOMPKINS COUNTY, NEW YORK
An Engineer's Report dated February, 1989 having been prepared
by the Town of Lansing Engineer and a map, plan and report for
providing the facilities, improvements and services in a portion of
the Town of Lansing wherein a water district hereinafter described
was proposed to be established, and said map, plan and report
having been duly filed in the Office of the Town Clerk on February
1, 1989 -, and an Order having been duly adopted by said Town Board
on the 21st -day of March, 1989 reciting the description of the
boundaries of the proposed district, the maximum amount proposed to
be expended for the improvement,. and the proposed method of
financing to be employed, the fact that a plan, map and report
describing the same are on file in the Town Clerk's Office for
public inspection and specifying that said Town Board shall meet at
the Lansing Town Hall Annex (Community Center) on the 5th day of
April, 1989 for the purpose of conducting a public hearing on such
proposal to establish the Water District 15 with the specified
improvements and to hear all persons interested in the subject
thereof concerning the same, and a hearing having been duly held by
said Board at such time and place, and it having been duly resolved
and determined following such hearing that the notice of hearing
was published and posted as required by law and otherwise
- sufficient, that all of the property and property owners within the
proposed district were benefited thereby, that all property and
property owners benefited were included within the limits of the
proposed district and that it was in the public interest to grant
in whole the relief sought, and it having been then and there
further duly resolved that the establishment of` such district as
proposed be approved, subject to permissive referendum in the
manner provided in Article 7 of the Town Law, and a Certificate of
the Town Clerk having been duly filed pursuant to Subdivision 4 of
Section 209 -E of the Town Law certifying that no Petition was filed
requesting such a referendum, and application having been
thereafter duly made in duplicate to the Department of Audit and
Control at Albany, New York for permission to create such district
as more fully provided for by Town Law, Section 209 -F, and the
State Comptroller having duly made an Order in duplicate dated May
22, 1989 granting permission for the creation of the district in
all respects as petitioned for and approved by the Town Board as
aforesaid, and one copy of such Order having been duly filed in the
Office of the State Department of Audit and Control at Albany, New
York and the other in the office of the Town Clerk of this Town,
and the Town Clerk having duly presented such Order to this Board
at this meeting, being its first meeting held after the said Order
was filed with her; it is hereby
ORDERED, that Water District 15 be established in the said
Town of Lansing, Tompkins County, New York as described in the
Order of the State Comptroller to be designated as Water District
15 of the Town of Lansing and to be of the following description
and boundaries, to wit:

Lansing, County of Tompkins, State of New York being described as
follows:
Beginning at a point in the south boundary of Lansing (T)
Water District No. 7; said point being located on the centerline of
North Triphammer Road 326.5 feet, more or less, south of the south
line of Peruville Road;

consist of some 4,300 feet of 10 inch ductile iron watermains,

and 2300 feet of 8. and 6 ductile watermains, together with valves,
fire hydrants, services to street right of ways and other related
and necessary appurtenances; and it is further
ORDERED, that the proposed improvements, including costs of
rights of way, construction costs, legal fees and other expenses
shall be financed as follows: by the issuance of bonds, bond
anticipation notes, capital notes, budget notes, and it is further
ORDERED, that the Town Clerk of the Town of Lansing is hereby
authorized and directed to cause a certified copy of this Order to
be duly recorded in the Office of the Clerk of the County of
Tompkins in which the Town of Lansing is located within ten (10)
days after the adoption of this Order; and it is further

1989 for the purpose of conducting a public hearing on such

proposal to establish the Water District 9 with the specified
improvements and to hear all persons interested in the subject
thereof concerning the same, and a hearing having been duly held by
said Board at such time and place, and it having been duly resolved
and determined following such hearing that the notice of hearing
was published and posted as required by law and otherwise
sufficient, that all of the property and property owners within the
proposed district were benefited thereby, that all property and
property owners benefited were included within the limits of the
proposed district and that it was in the public interest to grant
in whole the relief sought, and it having been then and there
further duly resolved that the establishment of such district as
proposed be approved, subject to permissive referendum in the
manner provided in Article 7 of the Town Law, and a Certificate of
the Town Clerk having been duly filed pursuant to Subdivision 4 of
Section 209 -E of the Town Law certifying that no Petition was filed
requesting such a referendum, and application having been
thereafter duly made in duplicate to the Department of Audit and
Control at Albany, New York for permission to create such district
as more fully provided for by Town Law, Section 209 -F, and the
State Comptroller having duly made an Order in duplicate dated May
22, 1989 granting permission for the creation of the district in
all respects as petitioned for and approved by the Town Board as
aforesaid, and one copy of such Order having been duly filed in the
Office of the State Department of Audit and Control at Albany, New
York and the other in the office of the Town Clerk of this Town,
and the Town Clerk having duly presented such Order to this Board
at this meeting, being its first meeting held after the said Order

Village of Lansing water district located along New York State

POPULATION TO BE SERVED - The present population to be
served in the proposed area is 12 persons.
WATER SUPPLY - Treated water requirements, estimated not to
exceed an average of 1,200 gallons per day, will be purchased from
the Southern Cayuga Lake Intermunicipal Water Commission (Bolton
Point Water Supply). The Town of Lansing is a member of the
Commission and the capacity of the Bolton Point supply is
considered more than adequate to supply this area.
FACILITIES TO BE CONSTRUCTED - The project consists of the
construction of approximately 1,375 feet of 8" diameter ductile
iron water main, together with valves, fire hydrants and other
related and necessary appurtenances along East Shore Drive (New

differential of 77 p.s.i. Within the next year, when the oaiarnue
of the water district system construction is completed, the Town
water pressure in the area of the town - Village line will be

the subject thereof concerning the same and to take such action
thereof as is required or authorized by law.

WHEREAS, a map,, plan and report have been prepared
in such manner and in such detail as has heretofore been
determined by the Town Board of Lansing, relating to the
establishment of a proposed water district in the Town, and
WHEREAS, such map, plan and report dated May 22,
1989 have been duly filed in the Town Clerk's Office in
said Town on June 7, 1989, and
WHEREAS, said map, plan and report were prepared by
T. G. Miller & Associates, P. C., Engineers and Surveyors,

SERVICE AREA - As shown on the map filed in the
Town Clerk's Office and described_ in Exhibit A the
proposed water district will include approximately 223
acres of land, more or less, which encompass 7 existing
homes, 3 residential' subdivisions totalling 107 lots,
houses on some of the lots are under construction, and
approximately 24 acres of undeveloped land located between
two of the subdivisions'.
POPULATION TO BE SERVED - The present population
is 18 persons. The maximum population to be served in the
proposed district is 375.
WATER SUPPLY Treated water requirements,
estimated not to exceed an average of 37,500 gallons per
day, will be purchased from the Southern Cayuga Lake
Intermunicipal Water Commission (Bolton Point Water
Supply), The Town of Lansing is one of the municipalities
who own the system. The capacity of the Bolton Point
supply is considered more than adequate to supply this
district.
WATER SYSTEM TO BE CONSTRUCTED - As shown on the
map filed with the' Town Clerk, the facilites to be
constructed will ultimately consist of some 19,000 feet of
8 inch and 6 inch diameter ductile iron water mains
together with valves, fire hydrants and other related and
necessary appurtenances. Three main -line pressure reducing
vaults will also be constructed. Individual water services
for all existing homes and future lots will be installed
to street right -of -ways.
CONSTRUCTION CONDITIONS _ The watermains will be
constructed within existing road right of way or acquired
easements. No unusual soil and /or construction conditions
are anticipated to be encountered in the construction.
Traffic will not be interrupted. Test borings will be
taken to determine the; extent and depth to rock and this
information will be made available to bidders.
PRELIMINARY ESTIMATE OF

legal, and administrative costs is $835,000. This estimate
is based on prices received by the Town for other water
projects bid during the past two years. Of this cost,

be constructed by the subdivisions.

WHEREAS, the operation will be as follows:
METHOD OF OPERATION - The proposed water system
extension will be connected at two locations on New York
State Route 34 (East Shore Drive) to the existing Town of
Lansing Water District No. 7 distribution system. Pressure
will be provided by the 1 MG capacity Town water tank,
approximate overflow elevation 1189, located at Village
Circle South east of Warren Road. Water is pumped to this
tank by the Town pumping station located at Burdick Hill
and North Triphammer Roads. The source of supply for the
pumping station is the adjacent SCLIWC water tank.
Due to changing topography and a wide variation in
ground surface elevations, water main pressures in the
existing Lansing water system at lower elevations are
controlled by main line pressure reducing stations. Ground
surface elevations in the proposed water district vary by
approximately 400 feet and static water main pressures
regulated by main line pressure reducing valves, will
range between 30 and 115 p.s.i. Individual pressure
reducing valves will be required to be installed on each
house service so pressures can be maintained in the 30 to
60 p.s.i. range; And
WHEREAS, the method of financing will be as follows:
METHOD OF FINANCING - The $82,000 project cost of
the water district improvement is planned to be financed
by the issuance of serial bonds to mature in annual
installments, and said annual installments, which include
repayment of principal and interest, shall be assessed by
a proposed formula as follows:

Road and N. Triphammer Road and is approximately 70 p.s.i.
Individual pressure reducing valves will be required on each
service connection to maintain household pressure on the 35 -60
p.s.i. range; And

subdivider. No temporary or permanent financing by the

will be borne entirely by the subdivider, who will recover his
cost as the lots are sold, and any future watermain extensions

RESOLUTION offered by Mr. Emmick who moved its adoption, seconded
by Mr. Tvaroha:
RESOLVED that the Town Board appoints Abraham Abraham to the Lansing
Water Board to fill Alex Cima's unexpired term. Effective immediately and
ending December 31, 1989.
Carried.
The Board discussed a resolution concerning Bacon Road and Van Ostrand
Road on speed limits and signage.
Upon receiptsof a Petition by the residents of the Town of Lansing
who reside on Bacon Road and Van Ostrand Road,, and after due deliberation
and discussion of the subject matter, the following Resolution and Order
was made by the Town Board of the Town of Lansing.
RESOLUTION offered by Mr. Beckwith who moved its adoption, seconded
by Mr. Tvaroha:
RESOLVED that the Petition of the residents of Bacon Road and
Van "Ostrand Road be forwarded to the Commissioner of the Department of
Motor Vehicles together with the Town Board's request for a review of
the speed limits on the sections of Bacon Road and Van Ostrand Road, as
shown in the Petition, and an appropriate reduction of the speed limit
from 55 miles per hour.
BE IT FURTHER RESOLVED that the Town Board direct the Town Superintendent,
of Highways to inspect the sections of Bacon Road and Van Ostrand Road
as shown in the Petition, and that the Town Superintendent of Highways put
appropriate signage on these roads to indicate the presence of children
and a legally blind person.
Carried.
The new baseball field will be dedicated to Fred Christopher at 2:30 P.M.
on .June 10, 1989.
A copy of the minutes of May 17, 1989, having been furnished to all
Board Members beforehand, the Supervisor asked for a motion to make
any corrections or to accept same as submitted.
