A copy of the Minutes of April 19, 1989, having been furnished to all
Board Members beforehand, the Supervisor asked for a motion to make any
corrections or to accept same as submitted.
RESOLUION offered by Mr. Cleveland who moved its adoption, seconded by
Mr. Emmick:
RESOLVED that the minutes as submitted by the clerk are hereby approved.
Carried.
On motion, the meeting was adjourned at the call of the Supervisor.

Visitors: Richard John,'David Herrick, John Kaminsky, Howard Groat,
Helen Howell, Ernie Bailes-and two other Lansing residents.
The Supervisor called the meeting to order having the clerk take the Roll
Call,
The Supervisor presented her monthly report.
Helen Howell stated that TomTran should be transporting Lansing Residents
by July of 1989.
Mrs. Howell questioned the interest Lansing residents might have in a
Reading Center. She also stated that the County will be giving free floride
to childern between the ages of newborn to 10 years old.
She also discussed the problem of havizig;-; hazardous waste materials in
the County and Town.
David Herrick stated that the Village of Cayuga Heights does not want any
part in the expansion of a new sewer plant to accomodate other
municipalities.
Mr. Herrick also stated that the Freedman subdivision was presented at the
last planning board meeting and that Mr. Freedman was interested in finding out
the location of possible future sewer mains. Mr. Herrick will look into this
and report back to the Town Board at a later date.
RESOLUTION offered by Mr. Emmick who moved its adoption, seconded by
Mr. Tvaroha:
RESOLVED, that the Town Board of the Town of Lansing hereby appoints
Mr. Tom Jerram to the Lansing Water Board effective immediately and to
expire on May 17, 1993.
Carried.
Mr. Groat, the Highway Superintendent presented his monthly report and
explained the road conditions in Lansing.
Mr. Thaler reported to the Board that the contract between Vestal Asphalt
and the Town of Lansing was completed and'signed by both parties. He also
stated that Mrs. Kirby had signed the agreement between the Town and Mr. Leathers
and Cheryl Nichols concerning the North /South road in the Eastlake development.
Mr. Richard John discussed the possibility of deleting Sec. 262A in the
Town -,Law that states that a portion of Lansing, New York is zoned. It was the
Board's feeling that this should remain in the law books.

°RESOLUTION offered by Mr. Cleveland, who moved its adoption, seconded by
Mr. Tvaroha:
WHEREAS, the Town of Lansing has, over the past year, participated in
discussions with the Village of Lansing,Town of Ithaca, Town of Dryden, Village
of Cayuga Heights and the City of Ithaca concerning the problems of sewer
waste disposal and intermunicipal cooperation concerning the same; and
WHEREAS, the Village of Lansing has undertaken a
study of waste water treatment options for the Village
preliminary
of Lansing
feasibility
as set
forth in a report by Hunt
Engineers and Architects,P.C.
dates June
7, 1988; and
WHEREAS, the Village of Lansing has passed a Resolution No. 1908 entitled
Intent to Proceed with Construction of New Sewer Treatment Plant dated March 7,
1989; and
WHEREAS, said feasibility study includes areas within the Town of Lansing
as well as the Village of Lansing and Town of Dryden; and
WHEREAS, the Town of Dryden has passed a Resolution No. 87 -1989 endorsing
the concept of an intermunicipal agreement between the Town of Dryden and the
Village of Lansing; and
' WHEREAS,
the
growth of development
in
the Town of Lansing, bounded on the
south by the
Town
of Lansing town line
and
on the north by New York State
Route 34B, on
the
west by Cayuga Lake
and
on the east by the town line of the
Town of Lansing,
has been enormous and
all
indications seem to be a contin-
uance of the
same;
and
WHEREAS,, in said area of development there have been septic system
failures creating health hazards; and
WHEREAS, in the southern part of the Town of Lansing some development,
both commercial and residential are presently serviced by the Village of
Cayuga Heights sewer plant; and
WHEREAS, the Town of Lansing has received a letter dated May 8, 1989,
from Ronald Anderson, Mayor of the Village of Cayuga Heights, indicating
refusal by the Village of Cayuga Heights to participate in joint sewer construction
to relieve the sewer crisis ;•aud
WHEREAS,
there has been
and
is an increasing demand
from
commercial
interests and
individuals to
be
connected with and to a
public
sewer system; and
WHEREAS, it is determined by this Board that it is in the public interest,
including but not limited to the interests of public health, safety and welfare
for all residents, be they individual or commercial, in the Town of Lansing to
have said portion of the Town of Lansing to be served by public sewers if
the same is"_fdasbleaand?prdctcable.
NOW THEREFORE, be it resolved by the Town Board of the Town of Lansing:
1. The Town of Lansing endorses the concept of an intermunicipal
agreement between the Village of Lansing, the Town of Dryden, the Town of
Ithaca, the Village of Cayuga Heights and the City of Ithaca or any of them
wishing to enter into such agreement for the construction of new and
additional waste water, sewer facilities to serve the citizens of their
respective municipalities.
2. The Town of Lansing designates that the study area for such
intermunicipal agreement include all of that geographical area of the Town of
Lansing bounded on the north by New York State Route 34B, on the west by

Cayuga Lake, on the south by the Town line between the Town and Village of
Lansing and on the east by the Town line between the Town and the Town of Dryden.
3. The Town of Lansing undertakes and commits itself, upon the
execution of the necessary documents and upon the appropriate budgeting therefore
the expense of an amount not to exceed One Hundred Fifty Zhokusand Dollars
( $150,000.00 ) or the pro rata share allocated to the Town of Lansing, which-
ever is lower, for the preperation of such plans, reports and maps as are
required for the completion of the feasibility study.
4. The expense incurred shall be a charge on the area of the Town
outside of the Village and shall be assessed, levied and collected in the same
manner as other Town charges.
5. In the event that the Town shall thereafter make such sewer improve-
ment, the cost of this study, including the maps, plans and reports shall be
deemed a part of cost of such sewer improvement and the Town shall be reimbursed
for such portion of that amount, if any, which the Town Board, at a public
hearing held pursuant to Section 209 -q of the Law shall allocate against
such benefited area.

WHEREAS, the Town of Lansing has, and will in the future, formed water
improvement districts within the Town boundaries in order to provide water
supply to the residents of the Town of Lansing; and
,WHEREAS, the Town of Lansing has, and will in_- thefuture, formed extensions
to the water improvement districts in order to accommodate additional users
to the original water improvement districts; and
WHEREAS, Town Law §'202 subdivision 5 provides that the Town Board may
authorize an assessment against an extension in order to pay a proportionate
share of the original water improvement district costs in proportion to the
benefit received by the extension froin'the"'original water improvement district;
and
