April 5, 1989
The Lansing Town Board met in a Special Meeting at the Lansing Community
Center and at the Lansing Town Hall to hold three Public Hearings and to consider
and act on any other business that may come before said Board. Said meeting was
held on April 5, 1989 at 6:30 P.M.

The Supervisor called the Meeting to order having the clerk take the Roll
Call.
Proof of Notice having been furnished by the Town Clerk,the Public Hearing
on Proposed Lansing Water District No. 9 was called to order at 6:30 P.M.
No one appeared voicing any objection to the Proposed Lansing Water District
No. 9, and the following Resolution was offered:
RESOLUTION offered by Mr. Emmick who moved its adoption, seconded by
Mr. Cleveland:
RESOLVED that the Public Hearing on Proposed Lansing Water Disrtict No. 9
be terminated at 6:50 P.M.

No one appeared voicing any objection to the Proposed Lansing Water District
No. 13, and the following Resolution was offered:

The Supervisor called the meeting to order at 8:00 P.M. having the clerk
take the Roll Call.
Visitors: Deputy Town Clerk, Debbie Crandall, John Kaminsky, Richard John,
Cal Warren, Ann Colt Dave Herrick and one other Lansing Resident.
Mr. Terry Garahan from LeRoy Ave. in Myers approached the Board in regard
to the State land in Myers. He suggested putting up a locked gate on the east
side of the railroad track to eliminate vehicular traffic to the lake shore.
The Town Board would like to have this property patrolled first and at a later date
may consider a gate.

The Board discussed the problem of people hooking up to Water Districts
that have been in existance for a period of time. The Water Board will
discuss this further and bring their recommendation back to the Town Board.

,:WHEREAS, a map, plan and
`.report have been prepared in
such manner and in such de-
tail as has heretofore been
determined by the Town
Board of the Town of Lansing,
I relating to the establishment
of a proposed water district in
the Town; and f
WHEREAS, such map, plan
and report hove been duly
filed in the Town Clerk's Of-
fice in said Town; and
WHEREAS, said maps, plans
and report were prepared by
T. G. Miller & Associates, P.C.,
Engineers and Surveyors, Itha-
ca, New York, who are duly li-
censed by the State of New
York, which showed the
boundaries of the proposed
district, a general plan of the
water system and a report of
the proposed improvements,
the estimated expense of
these improvements, the pro -
posed method of financing,
which map, plan and report
are on file in the Town Clerk's
Office 'for public inspection,
and all other matters required
by law to be stated; and
WHEREAS, the map shows the
proposed water district, water
mains, fire hydrants and other
related and necessary appur-
tenonces and
WHEREAS, an Order was
passed on March 21, 1989,
designating April 5, 1989 at
6:30 p.m. at the Lansing Town
Hall Annex (Community Cen-
ter), in Lansing, New York, to
consider the plans, maps an
report and to hear all persons
interested in this matter and to'
take action as required by
low; and
WHEREAS, the said Order was
published and posted as re-
quired by law; and
WHEREAS, a public hearing on
the matter was held by the
Town Board on April 5, 1989,
at the Lansing Town Hall An-
nex (Community Center) as
aforesaid, at 6:30 p.m. and
the matter was fully discussed
and all interested parties and
persons were heard.
UPON the evidence given at
the public hearing and upon a
motion duly made by Coun-
cilman Cleveland, seconded ,
by Councilman Emmick, the
following resolution is unani-
mously adopted.
It is hereby determined that:
(a) The notice of hearing was
published and posted as re- .
quired by law, and it is other-
wise sufficient.
(b) All the property and prop-
erty owners within the pro-
posed district are benefited
thereby.
(c) All the property and prop-
erty owners benefited are in-
cluded within the limits of the
proposed district.
(d) The establishment of this
district is In the public interest.
It is further determined and
resolved that the district as set
forth in the map, plan and re-
port be approved, that the re-
quested improvement be con -
);tructed and that the %
necessary easements and
lands be acquired upon the
required funds being made
available and provided for.
It is further resolved that this
district shall be known as the
Water District 9 in the town of
Lansing and shall be bounded
and described as follows: see
Exhibit A attached.
It is further resolved that the I
proposed improvement, in- i
eluding construction costs, cost j
of acquisition of lands and
easements, legal and engi-
neering fees, and all other ex- j
penses, be financed by the is- %
suonce of serial bonds of the
Town of Lansing to mature in a
number of annual instal-
lments not exceeding twenty i
(20) years as may be deter- I
mined by the Town Board, the
cost of constructing Water Dis-
trict 9 to be assessed by the
Town Board in as close a ro-
portion to the benefit tow ich
each lot or parcel which de-
rive from the improvement as
