HomeMy WebLinkAbout1989-02-011 1 f ORDER AND RESOLUTION OF THE TOWN BOARD, TOWN OF LANSING ESTABLISHING WATER DISTRICT NO. 15 At a meeting of the Town Board of the Town of Lansing held at the Lansing Town Hall on February 1, 1989 at 8:00 p.m. Present: Jeanine Kirby, Supervisor Louis Emmick, Councilman Jeffrey Cleveland, Councilman Larry Tvaroha, Councilman Herbert Beckwith, Councilman In the matter of the establishment of Lansing Water District No. 15, Town of Lansing, County of Tompkins, State of New York, pursuant to Article 12 -A of the Town Law. WHEREAS, maps, plans, including two alternatives (entitled Alternative A and Alternative B) and a report including the two alternatives have been prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Lansing, relating to the establishment of a proposed water district in the Town; and WHEREAS, such maps, plans and report have been duly filed in the Town Clerk's Office in said Town; and WHEREAS, said maps, plans and report were prepared by T. G. Miller & Associates, P. C., Engineers and Surveyors, Ithaca, New York, who are duly licensed by the State of New.York, which showed the boundaries of the proposed district, a general plan of the water system and a report of the proposed improvements, the estimated expense of these improvements, the proposed method of financing, which map, plan and report are on file in the Town Clerk's Office for public inspection, and all other matters required by law to be stated; and r 1 1 f ORDER AND RESOLUTION OF THE TOWN BOARD, TOWN OF LANSING ESTABLISHING WATER DISTRICT NO. 15 At a meeting of the Town Board of the Town of Lansing held at the Lansing Town Hall on February 1, 1989 at 8:00 p.m. Present: Jeanine Kirby, Supervisor Louis Emmick, Councilman Jeffrey Cleveland, Councilman Larry Tvaroha, Councilman Herbert Beckwith, Councilman In the matter of the establishment of Lansing Water District No. 15, Town of Lansing, County of Tompkins, State of New York, pursuant to Article 12 -A of the Town Law. C., Engineers and Surveyors, Ithaca, New York, who are duly licensed by the State of New.York, which showed the boundaries of the proposed district, a general plan of the water system and a report of the proposed improvements, the estimated expense of these improvements, the proposed method of financing, which map, plan and report are on file in the Town Clerk's Office for public inspection, and all other matters required by law to be stated; and r 1 WHEREAS, the map shows the proposed water district, water mains, fire hydrants and other related and necessary appurtenances; and WHEREAS, an Order was passed on December 28, 1988, designating January 18, 1989, at 7:00 p.m. at the Lansing Town Hall Annex (Community Center), in Lansing, New York, to consider the plans, maps and report and to hear all persons interested in this matter and to take action as required by law; and WHEREAS, the said Order was published and posted as required by law; and WHEREAS, a public hearing on the matter was held by the Town Board on January 18, 1989, at the Lansing Town Hall Annex (Community Center) as aforesaid, at 7:00 p.m. and the matter was fully discussed and all interested parties and persons were heard. UPON the evidence given at the public hearing and upon a motion duly made by Councilman Beckwith seconded by Councilman Cleveland the following resolution is unanimously adopted. It is hereby determined that: (a) The notice of hearing was published and posted as required by law, and it is otherwise sufficient. (b) All the property and property owners within the proposed district are benefited thereby. (c) All the property and property owners benefited are included within the limits of the proposed district. (d) The establishment of this district is in the public interest. 2 It is further determined and resolved that the district as set forth in the map, plan and report entitled Alternative A be approved, that the requested improvement be constructed and that the necessary easements and lands be acquired upon the required funds being made available and provided for. It is further resolved that this district shall be known as the Water District 15 in the Town of Lansing and shall be bounded and described as follows: see Exhibit A attached. It is further resolved that the proposed improvement, including construction costs, cost of acquisition of lands and easements, legal and engineering fees, and all other expenses, be financed by the issuance of serial bonds of the Town of Lansing to mature in a number of annual installments not exceeding twenty (20) years as may be determined by the Town Board, the cost of constructing Water District 15 to be assessed by the Town Board in as close a proportion to the benefit to which each lot or parcel which derive from the improvement as is possible. It is further resolved that this resolution is subject to permissive referendum as provided in Town Law, Section 209 -E in the manner provided in Article 7 of the Town Law. It is further resolved that this resolution is subject to review by the New York State Department of Audit and Control. Box 777 • Ithaca, New York 14851 I r 1 ~ 3.3 I� 13 February 1, 1989 The Lansing Town Board met in Special Councilman Session on February 1, 1989 at the Lansing Town Hall Boardroom at 8:00 P.M. with Supervisor Kirby presiding. Jeannine Kirby Herbert Beckwith Jeffrey Cleveland Larry Tvaroha Richard John Bonita Boles ROLL CALL Supervisor Present Councilman Present Councilman Present Councilman Present Town Attorney Present Town Clerk Present Visitors: Deputy Town Clerk, Debbie Crandall, John Kaminsky, Roy Moore and Dave Eastman, The Supervisor called the meeting to order having the clerk take the Roll Call. Mr. Roy Moore asked the Town Board for permission to extend Lansing Water District No. 7 and allow him to contract with the Town to hook up three (3) additional lots. Mrs. Kirby will contact Bolton Point in regard to this matter and get back to Mr. Moore. The Board was in favor of these connections. Mr. David Eastman presented a petition to the Board concerning the speed limit on Warren Road between Asbury and Farrell Roads. He stated that 100 % of the residents signed the petition to lower the speed limit. After a brief discussion, the following Resolution was offered: RESOLUTION offered by Mr. Beckwith who moved its adoption, seconded by Mr. Tvaroha: BE IT RESOLVED, that the Petition of the residents of Warren Road be forwared to the Commissioner of the Department of Motor Vechiles together with the Town Board's request for a review of the speed limits on this section of Warren Road and an appropriate reduction of the speed limit from 55 miles per hour. Carried. RESOLUTION offered by Mr. Beckwith who moved its adoption, seconded by Mr. Cleveland: i RESOLVED, that the Town Board of the Town of Lansing hereby approved LANSING WATER DISTRICT N0, 15 ALTERNATE A. RESOLUTION offered by Mr. Tvaroha, who moved its adoption, seconded by Mr. Beckwith: RESOLVED that the Town Board hereby accepts Sunset Drive as a Town road pursuant to Mr. Thaler receiving the additional papers in regard to said Road. RESOLUTION offered by Mr. Cleveland who moved its adoption, seconded by Mr. Beckwith: RESOLVED that the Town Board hereby exempts any Lansing student classes from any fees in conection with the Lansing Park. The discussion will continue at a later date. The date of February 25, 1989 at 8:00 A.M. was set for the Town Board to audit the Town records. A copy of the minutes of January 18, 1989 having been furnished to the Board members before hand, the Supervisor asked for a motion to propose corrections or to accept same as submitted. Mason, Chairman of the County Board of Representatives, together with Resolution # 376 of the Tompkins County Board of Representatives urging municipalities to voluntarily extend the review and comment process of the General Municipal Law to include all significant development, and after due deliberation and discussion of the subject matter, the following Resolution was made by the Town Board of the Town of Lansing in response to County Board Resolution # 3766 RESOLUTION offered by Mr. Beckwith who moved its adoption, seconded by Mr. Tvaroha: RESOLVED, that the Town of Lansing declines at this time to voluntarily submit to the County Commissioner of Planning the review and comment authority for all those zoning and subdivision actions which exceed a certain scale and potential community impact and for the abolishing of the 500 foot rule, and BE IT FURTHER RESOLVED, that the provisions of Section 239 -L, - M, and -N remain applicable to zoning and subdivision action within the Town of Lansing, and BE IT FURTHER RESOLVED, that the Town of Lansing continue to provide reports to the County Assessment Office.
