A RESOLUTION AUTHORIZING THE ISSUANCE OF $19,150.00 SERIAL BONDS OF
THE TOWN OF LANSING, TOMPKINS COUNTY, NEW YORK, TO PAY THE COST OF
THE INCREASE AND IMPROVEMENT OF THE FACILITIES OF WATER DISTRICT
N0. 10 OF SAID TOWN.
WHEREAS, pursuant to proceedings heretofore duly had and taken
in accordance with the provisions of Section 202 -b of the Town Law,
and more particularly an Order, dated June 26, 1987, the Town Board
of the Town of Lansing, Tompkins County, New York has determined
it to be in the public interest to increase and improve the
facilities of Water District No. 10 of said town, at a maximum
estimated cost of $19,150.00; and
WHEREAS, pursuant to a Resolution of the Town Board of the
Town of Lansing, Tompkins County, New York dated August 21, 1987,
the Town authorized the issuance of $19,150.00 Serial Bonds of the
Town for the payment of said improvements; and
WHEREAS, pursuant to said Bonding Resolution, a Bond
Anticipation Note, 1988, No. X in the amount of $19,150.00
was executed and issued to the Tompkins County Trust Company in
Ithaca, New York by the terms of which the Town agreed to pay said
Note on the 3rd day of October, 1988; and
WHEREAS, it is now desired to provide funding to pay such Note
and to authorize the issuance of a Bond Anticipation Note in the
amount of $19,150.00 pursuant to the terms and conditions of the
Note, a copy of which is attached hereto.
NOW THEREFORE BE IT, resolved by the Town Board of the Town of
Lansing, Tompkins County, New York as follows:
Section 1. For the specific object or purpose of paying
Bond Anticipation Note, 1988, number Jo in the amount of
$19,150.00, the proceeds from which were used for the specific
object or
purpose
of
paying
the cost
of
the
increase
and
improvement
of the
facilities
Order establishing
of Water District
or
purpose
No. 10 in
the
Town of Lansing, Tompkins County, New York, consisting of the
purchase and installation of approximately 620 feet of six inch
ductile iron water main together with valves and fire hydrants,
and other related
necessary
appurtenances,
for
aid Lansing
Water
District No.
10 as
more fully
set forth in
the
Order establishing
aforesaid specific object
said Lansing Water District No. 10, including incidental expenses
in connection therewith, there are hereby authorized to be issued
$19,150.00 Serial Bonds of said Town pursuant to the provisions
of the Local Finance Law.
Section
2.
It is hereby determined
that
the plan
for
the
financing
of
the
aforesaid specific object
or
purpose
is
by
the
issuance of the $19,150.00 Serial bonds• of said Town authorized to
be issued pursuant to this Bond Resolution. Further details
pertaining to said Bonds will be prescribed in a further
Resolution or Resolutions of this Town Board.
Section 3. It is hereby determined that the period of
probable usefulness of the aforesaid specific object or purpose is
ten years, pursuant to subdivision 1 of paragraph a of Section
11.00 of the Local Finance Law. It is further determined that the
maximum maturity of the Serial Bonds herein authorized will exceed
five years.

Section 4. Subject to the provisions of the Local Finance
Law, the power to authorize the issuance of and to sell Bond
Anticipation Notes in anticipation of the issuance and sale of the
Serial Bonds herein authorized, including renewals of such notes,
is hereby delegated to the Supervisor, the chief fiscal
officer. Such notes shall be of such terms, form and contents, and
shall be sold in such manner, as may be prescribed by said
Supervisor, consistent with the provisions of the Local Finance Law,
Section 5.
The
faith
and
credit
of said Town of Lansing,
Tompkins County,
New
York,
are
hereby
irrevocably pledged to the
payment of the principal of and interest on such obligations as the
same respectively become due and payable. An annual appropriation
shall be made in each year sufficient to pay the principal of and
interest on such obligations becoming due and payable in such year.
Section 6. The validity of such Bonds and Bond Anticipation
Notes may be contested only if:
1)
Such
obligations are
authorized for an object or purpose
which
takes effect
immediately
shall be published
in
for which
said
Town is not authorized to expend money,
or
the official
2)
The
provisions of
law which should be
complied
with
at the date
of
publication of
this resolution are not
substantially
complied
with,
and an action,
suit or proceeding contesting
such
validity
is commenced within
twenty days after the
date of
such
publication, or
3) Such obligations are authorized in violation of the
provisions of the Constitution.
Section 7. This
resolution
which
takes effect
immediately
shall be published
in
full
in
The
Ithaca Journal,
the official

newspaper, together with a notice of the Town Clerk in
substantially the form provided in Section 81.00 of the Local
Finance Law.
The question of the adoption of the foregoing resolution was
duly put to a vote on roll call, which resulted as follows:

ORDER AND RESOLUTION OF THE TOWN BOARD, TOWN OF
LANSING ESTABLISHING WATER DISTRICT NO. 14
At a meeting of the Town Board of the Town of Lansing held at
the Lansing High School on September 7, 1988 at 7:30 p.m.
Present: Jeanine Kirby, Supervisor
Louis Emmick, Councilman
Jeffrey Cleveland, Councilman
Larry Tvaroha, Councilman
Herbert Beckwith, Councilman
In the matter of the, establishment of Lansing Water District
No. 14, Town of Lansing, County of Tompkins, State of New York,
pursuant to Article 12 -A of the Town Law.
WHEREAS, a map, plan and report have been prepared in such
manner and in such detail as has heretofore been determined by the
Town Board of the Town of Lansing, relating to the establishment of
a proposed water district in the Town, and
WHEREAS, such map, plan and report have been duly filed in the
Town Clerk's Office in said Town; and
WHEREAS, said map, plan and report was prepared by T. G.
Miller & Associates, P. C., Engineers and Surveyors, Ithaca, New
York, who are duly licensed by the State of New York, which showed
the boundaries of the proposed district, a general plan of the
water system and a report of the proposed improvements, the
estimated expense of these improvements, the proposed method of
financing, which map, plan and report are on file in the Town
Clerk's Office for public inspection, and all other matters
required by law to be stated; and
WHEREAS, the map shows the proposed water district, water
mains, fire hydrants and other related and necessary appurtenances;
and
WHEREAS, an Order was passed on August 17, 1988, designating
September 7, 1988, at 7:30 p.m. at the Lansing High School, Room
101, in Lansing, New York, to consider the plan, map and report and
to hear all persons interested in this matter and to take action as
required by law; and
WHEREAS, the said Order was published and posted as required
by law; and
WHEREAS, a public hearing on the matter was held by the Town
Board on September 7, 1988, at the Lansing High School as
aforesaid, at 7:30 p.m. and the matter was fully discussed and all
interested parties and persons were heard.
Upon the evidence given at the hearing and upon a motion duly
made by Councilman Cleveland, seconded by Councilman Beckwith,
the following resolution was unanimously adopted.
It is hereby determined that:
(a) The notice of hearing was published and posted as
required by law, and it is otherwise sufficient.
(b) All the property and property owners within the proposed
district are benefited thereby.
(c) All the property and property owners benefited are
included within the limits of the proposed district.
(d) The establishment of this district is in the public
interest.

It is further determined and resolved that the district as set
forth in the map, plan and report be approved, that the requested
improvement be constructed and that the necessary easements and
lands be acquired upon the required funds being made available and
provided for
It is further resolved that this district shall be know as the
Water District 14 in the Town of Lansing and shall be bounded and
described as follows: see Exhibit A attached.
It is further resolved that the proposed improvement,
including construction costs, cost of acquisition of lands and
easements, legal and engineering fees, and all other expenses, be
financed by the issuance of serial bonds of the Town of Lansing to
mature in a number of annual installments not exceeding twenty (20)
years as may be determined by the Town Board, the cost of
constructing Water District 14 to be assessed by the Town Board
in as close a proportion to the benefit to which each lot or parcel
which derive from the improvement as is possible.
It is further resolved that this resolution is subject to
permissive referendum as provided in Town Law, Section 209 -E in the
manner provided in Article 7 of the Town Law.

iron water main together with valves and fire hydrants, and
other related necessary appurtenances for said Lansing Water
District No. 8 as more fully set forth in the Order establishing
said Water District No. 8, including incidental expenses in
connection therewith, there are hereby authorized to be issued
$53,500.00 Serial Bonds of said Town pursuant to the provisions
of the Local Finance Law.
Section 2. It is hereby determined that the plan for the
financing of the aforesaid specific object or purpose is by the
issuance of the $53,500.00 Serial bonds of said Town authorized to
be issued pursuant to this Bond Resolution. Further details
pertaining to said Bonds will be prescribed in a further
Resolution or Resolutions of this Town Board.
Section 3. It is hereby determined that the period of
probable usefulness of the aforesaid specific object or purpose is

OF THE TOWN OF LANSING, TOMPKINS COUNTY, NEW YORK, TO PAY THE COST
OF THE INCREASE AND IMPROVEMENT OF THE FACILITIES OF WATER DISTRICT
NO. 2 OF SAID TOWN.
WHEREAS, pursuant to proceedings heretofore duly had and taken
in accordance with the provisions of Section 202 -b of the Town Law,
and more particularly a Resolution, dated September 7, 1988, the
Town Board of the Town of Lansing, Tompkins County, New York has
determined it to be in the public interest to increase and improve
the facilities of Water District No. 2 of said town, at a maximum
estimated cost of $150,000.00; and
WHEREAS, pursuant to a Resolution of the Town Board of the
Town of Lansing, Tompkins County, New York dated February 11, 1987,
which was renewed on June 28, 1988 for a period to expire October
2, 1988 by bond 1988, number 1, the Town authorized the issuance of
$150,000.00 Serial Bonds of the Town for the payment of said
improvements; and
WHEREAS, pursuant to said Bonding Resolution, a Bond
Anticipation Note, 1988,No. 1 in the amount of $150,000.00 was
executed and issued to the Tompkins County Trust Company in Ithaca,
New York by the terms of which the Town agreed to pay said Note on
the 3rd day of October 1988; and
WHEREAS, it is now desired to provide funding to pay such Note
and to authorize the issuance of a Bond Anticipation Note in the
amount of $150,000.00 pursuant to the terms and conditions of the
Note, a copy of which is attached hereto.
NOW THEREFORE BE IT, resolved by the Town Board of the Town of
Lansing, Tompkins County, New York as follows:

iron water main to connect to existing main at Brickyard Hill Road
to the existing main at the intersection of Myers Road and Route
34B and approximately 600 feet of six inch ductile iron water main
in Ludlowville Road to provide a connection to Water District No.
10, together with a pressure reducing valve and fire hydrants,
including incidental expenses in connection therewith, there are
hereby authorized to be issued $150,000.00 Serial Bonds of said
Town pursuant to the provisions of the Local Finance Law.
Section 2. It is hereby determined that the plan for the
financing of the aforesaid specific object or purpose is by the
issuance of the $150,000.00 Serial bonds of said Town authorized to
be issued pursuant to this Bond Resolution. Further details
pertaining
to
said Bonds
will be
prescribed in a further
Resolution
or Resolutions
of
this Town
Board,
Section 3. It is hereby determined that the period of
probable usefulness of the aforesaid specific object or purpose is
ten years, pursuant to subdivision 1 of paragraph a of Section
11.00 of the Local Finance Law. It is further determined that the

maximum maturity of the Serial Bonds herein authorized will exceed
five years.
Section 4. Subject to the provisions of the Local Finance
Law, the power to authorize the issuance of and to sell Bond
Anticipation Notes in anticipation of the issuance and sale of the
Serial Bonds herein authorized, including renewals of such notes,
is hereby delegated to the Supervisor, the chief fiscal
officer. Such notes shall be of such terms, form and contents, and
shall be sold in such manner, as may be prescribed by said
Supervisor, consistent with the provisions of the Local Finance Law.

Section 5. The faith and credit of said Town of Lansing,
Tompkins County, New York, are hereby irrevocably pledged to the
payment of the principal of and interest on such obligations as the
same respectively become due and payable. An annual appropriation
shall be made in each year sufficient to pay the principal of and
interest on such obligations becoming due and payable in such year.
Section 6. The validity of such Bonds and Bond Anticipation
Notes may be contested only if:
1) Such obligations are authorized for an object or purpose
for which said Town is not authorized to expend money, or
2) The provisions of law which should be complied with
at the date of publication of this resolution are not substantially
complied with, and an action, suit or proceeding contesting such
validity is commenced within twenty days after the date of such
publication, or
3) Such obligations are authorized in violation of the
provisions of the Constitution.

Section 7. This resolution which takes effect immediately
shall be published in full in The Ithaca Journal, the official
newspaper, together with a notice of the Town Clerk in
substantially the form provided in Section 81.00 of the Local
Finance Law.
The question of the adoption of the foregoing resolution was
duly put to a vote on roll call, which resulted as follows:

The other members of the Board, Louis Emmick, Councilman, and

The Lansing Town Board met in Special Session at the Lansing High School,
Room 101 at 7:30 P.M. on September 7, 1988 for the purpose of holding a Public
Hearing on proposed Lansing Water District No. 14 and to consider and act on
any other business that may come before said Board.

The Supervisor called the meeting to order having the clerk take the Roll
• Call.
Visitors: Tom Miller, David Herrick, John Kaminsky, John Horky, Mr. and
Mrs. Richard Pinney, Mr. Ralph Barnard, Anne Hauta.niemi, and about 50 other
Lansing residents.
Mr. John Kaminsky presented the proposed Water District No. 14 to the
people who attended the meeting.
The main concern the residents had was the length of time it would take
for the water district to be formed.
All persons desiring to be heard, having been heard, the Public Hearing
was terminated at 8 :15 P.M.
Mr. Charles Nedrow from the Lansing Fire Department present their 1989
Budget and explained the contents of it. He also stated that they urgently
need volunteers. Mr. Jack Ettinger stated that the fire department authorized
Mr. Oplinger to sign a letter stating that the Lansing Fire Department appproved
a driveway owned by Mr. Barnard. He then stated that this was recinded due to
the fact that the Fire Department had no authority to make such a statement.
The Town Board discussed the abandonment of part of
