The Supervisor called the meeting to order having the clerk take Roll Call. The Supervisor presented her monthly report. Helen Howell spoke on the cost of a land fill and also talked to the board about a Resolution that will be coming up at a County Meeting. The Resolution would give the County a chance to express their feelings and suggestions on any major - subdivision that would come before the Lansing Planning Board. Mr. Thaler will look into this and get back to the Board members. RESOLUTION offered by Mr. Emmick, who moved its adoption, seconded by Mr. Beckwith: RESOLVED that the Town of Lansing hereby accepts as deeded, the extension of Horizon Drive easterly from its previous terminus to the end of the original Horizon subdivision and a continuation of Allesandro Drive into Laura Lane, Laura Lane into Rosina Drive, and the termination of Rosina Drive at Laura Lane. The bids were opened at advertised. (Aye) Jeannine Kirby, Supervisor A discussion was held concerning the paving of roads in new districts. The Planning Board, Town Board and Mr. Groat will get together at a later date to discuss this matter in more detail. Mr. Philip Munson Jr. stated that he would be filing another proposal to the D.E.C. for sludge. Said sludge will come from breweries and wineries. Mr. Munson will supply the Town and /or Town Attorney with a copy of the application as soon as he files it with the D.E.C. office. A discussion was held by the board concerning four Resolutions that the Planning Board had given to the Town Board. No action was taken at this time. Mrs. Kirby presented each board member with a copy of a letter from the Tompkins County Health Department concerning the sewer problems in Lansing. A discussion was held concerning the Drost Lighting District. RESOLUTION was offered by Mr. Emmick who moved its adoption, seconded'by Mr. Cleveland:; RESOLVED that the Town will hold a Public Hearing on August 3, 1988 at 7:30 P.M. at the Lansing Town Hall boardroom concerning the Drost Lighting District and BE IT FURTHER RESOLVED that the Town Clerk is hereby authorized and directed to advertise said Public Hearing. i Carried. AUDIT RESOLUTION was offered by Mr. Beckwith who moved its adoption, seconded by Mr. Emmick: RESOLVED that General Fund Bills # 425 through # 492 in the amount of $ 36,902.46 and Highway Fund Bills # 230 through # 275 in the amount of $ 31,082.24 are hereby approved for payment. Carried, J U C i i 1 ORDER AND RESOLUTION OF THE TOWN BOARD, TOWN OF LANSING ESTABLISHING WATER DISTRICT NO. 13 At a meeting of the Town Board of the Town of Lansing held at the Town Hall on July 20, 1988 at 8:00 p.m. Present: Jeanine Kirby, Supervisor Louis Emmick, Councilman Jeffrey Cleveland, Councilman Larry Tvaroha, Councilman Herbert Beckwith, Councilman In the matter of the establishment of Lansing Water District No. 13, Town of Lansing, County of Tompkins, State of New York, pursuant to Article 12 -A of the Town Law. WHEREAS, a map, plan and report have been prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Lansing, relating to the establishment of a proposed water district in the Town; and WHEREAS, such map, plan and report have been duly filed in the Town Clerk's Office in said Town; and WHEREAS, said map, plan and report was prepared by T. G. Miller & Associates, P. C., Engineers and Surveyors, Ithaca, New York, who are duly licensed by the State of New York, which showed the boundaries of the proposed district, a general plan of the water system and a report of the proposed improvements, the estimated expense of these improvements, the proposed method of financing, which map, plan and report are on file in the Town Clerk's Office for public inspection, and all other matters required by law to be stated; and WHEREAS, the map shows the proposed water district, water mains, fire hydrants and other related and necessary appurtenances; and WHEREAS, an Order was passed on June 15, 1988, designating July 7, 1988, at 7:00 p.m. at the Lansing High School, Room 101, in Lansing, New York, to consider the plan, map and report and to hear all persons interested in this matter and to take action as required by law; and WHEREAS, the said Order was published and posted as required by law; and WHEREAS, a public hearing on the matter was held by the Town Board on July 7, 1988, at the Lansing High School as aforesaid, at 7:00 p.m. and the matter was fully discussed and all interested parties and persons were heard. Upon the evidence given at the hearing and upon a motion duly made by Councilman Cleveland, seconded by Councilman Beckwith, the following resolution was unanimously adopted. It is hereby determined that: (a) The notice of hearing was published and posted as required by law, and it is otherwise sufficient. (b) All the property and property owners within the proposed district are benefited thereby. (c) All the property and property owners benefited are included within the limits of the proposed district. (d) The establishment of this district is in the public interest. 2 1 It is further determined and resolved that the district as set forth in the map, plan and report be approved, that the requested improvement be constructed and that the necessary easements and lands be acquired upon the required funds being made available and provided for. It is further resolved that this district shall be know as the Water District 13 in the Town of Lansing and shall be bounded and described as follows: see Exhibit A attached. It is further resolved that the proposed improvement, including construction costs, cost of acquisition of lands and easements, legal and engineering fees, and all other expenses, be financed by the issuance of serial bonds of the Town of Lansing to mature in a number of annual installments not exceeding twenty (20) years as may be determined by the Town Board, the cost of constructing Water District 13 to be assessed by the Town Board in as close a proportion to the benefit to which each lot or parcel which derive from the improvement as is possible.
