HomeMy WebLinkAbout1988-06-15t'• June 15, 1988 The Lansing Town Board met in Regular Session with Supervisor Kirby presiding on June 15, 1988 at 8 :00 Present P.M. in the Lansing Town Hall Boardroom. Supervisor Kirby called the meeting to order having the clerk take the Roll Call. The Supervisor presented her monthly report. Tom Miller reported on the Water.Districts. Gary Wood approached the Town Board concerning Junk cars in the Lansing area. He also stated that the Town Board should be looking to hire a clerk for the Planning and Zoning Office in the future. No Action was taken. After a very long discussion between the Board and Mr. Leathers, the following requests were made by the board before they would approve his PDA. 1) A letter of Credit from Mr. Leather's bank. 2) A letter from Howard Groat stating that the road is to his satisfaction. 3) A description and a title to the road that will be dedicated to the Town. 4) A letter of approval from the Planning Board with the additional triangular piece mentioned. 5) The Tompkins County Health Departments approval and stamp. 6) A Letter from Mr. Leather's stating that the Town of Lansing will not be obligated towards the maintenance of any dock or lake frontage in the Leather's sub - division. This must also be recorded in every buyers title and filed in the Tompkins County Clerk's office.(Recordable form) 7) A letter from Gary Wood stating that he approves the project. The following restrictions will be brought up at a later date. The Town board will require the Planning Board to give them a letter to amend the Drost approval. This will be done at the next Regular Meeting._ Eric Trotter asked the Town to either accept the Bill George Road as a Town road or to post "Private Road" signs. Mr. Thaler will look into this matter. John Kaminsky asked the Board to set the time and date for a Public Hearing on the Proposed Water District No. 130 RESOLUTION offered by Mr. Cleveland wno movea -LLs CLUUP �=., Mr. Beckwith: RESOLVED that the Town Board will hold a Public Hearing on the Proposed Lansing Water District No. 13 on July 71 1988 at 7:00 P.M. at the Lansing High School in Room 101. BE IT FURTHER RESOLVED that the Town Clerk is hereby directed to post and avdertise for said Public Hearing. Carried. WHEREAS that Town of Lansing has need for the part -time services of Town Constables and; WHEREAS the public safety will be enhanced by the employment of such part -time Town Constables, RESOLUTION is offered by Mr. Beckwith and seconded by Mr. Tvaroha: RESOLVED That the Town Clerk shall publish the intention of the Town Board to pass a local law establishing the office of Town Constable and further RESOLVED that the Town Clerk shall publish a notice advertising that the Town wishes to have applicants submit their qualifications to the Town Board for consideration in the event said local law is enacted, and further RESOLVED that the Supervisor is authorized to employ temporary Town Constables to assist the Town in maintaining public order during the remainder of the year. (Aye) Jeannine Kirby, Supervisor C r I 1 ORDER OF TOWN BOARD SPECIFYING TIME AND PLACE.OF PUBLIC HEARING ON ESTASLIS#MENT OF LANSING (T) WATER DISTRICT .NO. 13 At a meeting of the Town Board of the Town of Lansing held at the Town Hall in the Town of Lansing, Tompkins County, New York, on the 15th day of June, 1988, at 7:30 p.m. PRESENT: Jeannine Kirby, Supervisor Louis Emmick, Councilman Jeffrey Cleveland, Councilman Larry Tvaroha, Councilman Herbert Beckwith, Councilman In the matter of the establishment of Lansing Water District No. 13, Town of Lansing, County of Tompkins, State of New York, pursuant to Article 12 -A of the Town Law. WHEREAS, a map, plan and report have been prepared in such manner and in such detail as has heretofore been determined by the Town Board of Lansing, relating to the establishment of a proposed water district in the Town, and WHEREAS, such map, plan and report have been duly filed in the Town Clerk's Office in said Town, and WHEREAS, said map, plan and report were prepared by T. G. Miller & Associates, P. C., Engineers and Surveyors, Ithaca, New York, duly licensed by the State of New York, showing the boundaries of the proposed district, a general plan of the water system and a report of the proposed method of operation, and WHEREAS, said map shows the proposed water district, water mains, fire hydrants and other related and necessary appurtenances, and It, 1 WHEREAS, the boundaries of the proposed district are described in Exhibit "A" attached hereto and made a part hereof, "Ml WHEREAS, the improvements proposed are as follows: SERVICE AREA - As shown on the attached map and described in Exhibit A the proposed water district will include approximately 53 existing residences and approximately 30 acres of undeveloped land located along Asbury and Horvath Drives and Triphammer Terrace from Asbury Drive north to a point about 1000 feet north of Horvath Drive district is 81.5 + acres. The area of the proposed water POPULATION TO BE SERVED - With ultimate development, the maximum population to be served in the proposed district is estimated at approximately 220 persons. WATER SUPPLY - Treated water requirements, estimated not to exceed an average of 22,000 gallons per day, will.be purchased from the Southern Cayuga Lake Intermunicipal Water Commission (Bolton Point Water Supply). The Town of Lansing is a member of the Commission and the capacity of the Bolton Point supply is considered more than adequate to serve this district. FACILITIES TO BE CONSTRUCTED - As shown on the attached Map and Plan of the proposed water district, the facilities to be constructed will consist of approximately 5,450 feet of 8 inch diameter ductile iron watermains together with valves, fire hydrants, services to street R.O.W.'s and other related and necessary appurtenances. CONSTRUCTION CONDITIONS - The watermains will be constructed within existing road right of way or acquired easements. No unusual soil and /or construction conditions are anticipated to be encountered in the construction. Traffic will not be interrupted. Test. borings will be taken to determine the extent and depth to rock and this information will be made available to bidders, and WHEREAS, the estimate of project cost are as shown below: PRELIMINARY ESTIMATE OF PROJECT COST - As shown below, the preliminary estimate of project cost, including an allowance for contingencies, engineering, technical, legal and administrative costs is $250,000.00. This estimate is based on prices received by the Town for other water projects bid during the past two years. Total Project Cost $250,000.00. i WHEREAS, the operation will be as follows: METHOD OF OPERATION - The proposed water main extension will connect at two locations to the existing Town of Lansing Water "District No. 7 distribution system on North Triphammer Road. Pressure will be provided by the 1 MG capacity Town water tank, approximate overflow elevation 1189, located at Village Circle South to the east of Warren Road. Water is pumped to this tank by the Town pumping station located at Burdick Hill and North Triphammer Roads. The source of supply is the SCLIWC water tank which is located near the pumping station. Due to changing topography and a wide variation in ground surface elevations, water main pressures in the existing Lansing Water system at lower elevations are controlled by main line pressure reducing stations. Ground surface elevations in the proposed water district vary by approximately 70 feet and static water main pressures will range between 75 and 105 p.s.i. Individual pressure reducing valves will be required to be installed on each house service so pressures can be maintained in the 40 to 60 p.s.i. range, and WHEREAS, the method of financing will be as follows: METHOD OF FINANCING PROJECT COST - The $250,000 project cost of the water district improvement is planned to be financed by the issue of serial bonds to mature in annual installments, and that said annual installments, which include repayment of principal and interest, shall be assessed by a proposed formula as follows: 1. Existing Dwellings Fronting on Water Mains a. Parcels 2 acres or less: Assessed one (1) unit per dwelling and one (1) unit for the dwelling lot. b. Parcels greater than 2 acres: Assessed one (1) unit for the dwelling and one (1) unit for the dwelling lot. If enough frontage exists, additional one acre lots with a minimum of 150 foot frontage will be assessed one (1) unit for each lot. Any remaining unimproved rear land will be assessed one -sixth (1/6) unit per acre. 2. Vacant Lots/Unimproved Land Fronting on Water Mains a. General: For the purposes of, assessment, vacant lots fronting on water mains will be divided into one acre lots with a minimum of 150 foot frontage and assessed one (1) unit for each lot. Remaining unimproved rear land will be assessed one -sixth (1/6) unit per acre. 3. Newly Built Houses and Apartments a. When additional houses and apartments or other buildings are built on an existing vacant or new subdivision lot, they will be assessed as per the above formulae. Assuming the project is financed with 20 year serial bonds at 8% interest and a minimum principal - repayment at 80% of average, the first year payment is calculated as follows: Principal Repayment $250,000/20 years x 80% = $10,0000 First Year Interest Payment $250,000 x .08 = Estimated First Year Cost /Property Owner 30,000/116 = $259 /assessment unit House and Lot = 2 units = $5184 20,000 $30,000. One Acre Lot only = 1 unit = $259. Estimated Fifth Year Cost /Property Owner Assuming 20 of a potential 44 new units of growth in the District is realized in five years, the estimated annual cost above would be reduced by approximately 1/4 to $197 /assessment unit or $394. for house and lot; and WHEREAS, the maintenance and operating costs are as follows: MAINTENANCE AND OPERATING COSTS - The costs of maintaining and operating the Town system, including the cost of treated water supplied by Bolton.Point, are recovered in the per - gallon price charged to water users. Metered water charges, using the current Town per - gallon pricing schedule, are estimated to be $130 to $160 per average single family household per year and are in addition to the annual capital repayment cost; and WHEREAS, there will be a one time connection charge as follows: ONE TIME CONNECTION CHARGES _ For each household Bolton Point Water Supply connection fee, water meter, pressure reducer, etc..:. $ 4500 Water service line from curb box at street line to house (estimate average)* 5000 $ 950. *Note: the cost of any interior plumbing changes which may be required will vary for each house and are not included here; and WHEREAS, the capital costs will have to be financed by bonding and the issuance of serial bonds and /or be paid by r annual debts service assessments by those properties included in the district for the facilities. NOW, on motion of Jeffrey Cleveland, seconded by Herbert Beckwith, it is hereby ORDERED, that the Town Board of.the Town of Lansing hold a public hearing at the Lansing High School, Room 101 in said Town of Lansing on the 7th day of July, 1988, at 7:00 P.M. on that date and consider said map, plan and report and to hear all persons interested in the subject thereof concerning the same and to take such action thereof as is required or authorized by law. The adoption of the foregoing order was duly put to a vote and upon call the vote was as follows. WHEREAS, pursuant to proceedings heretofore duly had and taken in accordance with the provisions of Section 202 -b of the Town Law, and more particularly a Resolution, dated October 30, 1986, the Town Board of the Town of Lansing, Tompkins County, New York has determined it to be in the public interest to increase and improve the facilities of Water District No. 2 of said town, at a maximum estimated cost of $150,000.00; and WHEREAS, pursuant to a Resolution of the Town Board of the Town of Lansing, Tompkins County, New York.dated February 11, 1987, the Town authorized the issuance of $150,000.00 Serial Bonds of the Town for the payment of said improvements; and WHEREAS, pursuant to said Bonding Resolution, a Bond Anticipation Note, 1987, number 1, in the amount of $150,000.00 was executed and issued to the Tompkins County Trust Company in Ithaca, New York by the terms of which the Town agreed to pay said Note on the 17th day of June, 1988; and WHEREAS, it is now desired to provide funding to pay such Note and to authorize the issuance of a Bond Anticipation Note in the amount of $150,000.00 pursuant to the terms and conditions of the Note, a copy of which is attached hereto. For the specific object or purpose of paying Bond Anticipation Note, 1987, number 1, in the amount of $150,000.00, the .proceeds from which were used for the specific object or purpose of paying the cost of the increase and improvement of the facilities of Water District No. 2 in the Town of Lansing, Tompkins County, New York, consisting of the purchase and installation of approximately 3200 feet of eight inch ductile iron water main to connect to existing main at Brickyard Hill Road to the existing main at the intersection of Myers Road and Route 34B and approximately 600 feet of six inch ductile iron water main in Ludlowville Road to provide a connection to Water District No. 10, together with a pressure reducing valve and fire hydrants, including incidental expenses in connection therewith, there are hereby authorized to be issued $150,000.00 Serial Bonds of said Town pursuant to the provisions of the Local Finance Law. Section 2. It is hereby determined that the plan for the financing of the aforesaid specific object or purpose is by the issuance of the $150,000.00 Serial bonds of said Town authorized to be issued pursuant to this Bond Resolution. Further details pertaining to said Bonds will be prescribed in a further Resolution or Resolutions of this Town Board. Section 3. It is hereby determined that the period of probable usefulness of the aforesaid specific object or purpose is ten years, pursuant to subdivision 1 of paragraph a of Section 11.00 of the Local Finance Law. It is further determined that the maximum maturity of the Serial Bonds herein authorized will exceed five years. 2 Section 4. Subject to the provisions of the Local Finance Law, the power to authorize the issuance of and to sell Bond Anti.cipation Notes in anticipation of the issuance and sale of the Serial Bonds herein authorized, including renewals of such notes, is hereby delegated to the Supervisor, the chief fiscal officer. Such notes shall be of such terms, form and contents, and shall be sold in such manner, as may be prescribed by said Supervisor, consistent with the provisions of the Local Finance Law. Section 5. The faith and credit of said Town of Lansing, Tompkins County, New York, are hereby irrevocably pledged to the payment of the principal of and interest on such obligations as the same respectively become due and payable. An annual appropriation 0. shall be made in each year sufficient to pay the principal of and interest on such obligations becoming due and payable in such year. Section 6. The validity of such Bonds and Bond Anticipation Notes may be contested only if: 1) Such obligations are authorized for an object or purpose for which said Town is not authorized to expend money, or 2) The provisions of law which should be complied with at the date of publication of this resolution are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or 3) Such obligations are authorized in violation of the provisions of the Constitution. Section 7. This resolution which takes effect immediately shall be published in full in The Ithaca Journal, the official 3 1 newspaper, together with a notice of the Town Clerk in substantially the form provided in Section 81.00 of the Local Finance Law. This was tabled until July 7, 1988 at 6 :00 P.M. at the Lansing Town Hall Board Room. RESOLUTION offered by Mr. Tvaroha who moved its adoption seconded by Mr. Cleveland: RESOLVED that the Town Board hereby authorizes the issuance of $150,000.00 serial bonds of of the increase said Town. (The the Town of Lansing, Tompkins County, and improvement of the facilities of whole Resolution is attached hereto New York, to Water District and made a part pay the cost No. 2 of thereof).
