HomeMy WebLinkAbout1987-06-26June 26, 1987 The Lansing Town Board met in 26, 1987 to discuss the final Lansing Water District #2 and an Adjourned Meeting at 4:00 P.M. on June order for Lansing Water District No. 8 and Water # 10 and to consider and act on any other business that may come before said board. Councilman The Supervisor called the meeting to order. He then adjourned the meeting to Hilliards Exxon to obtain a quorum. The Supervisor had the clerk take roll call. WHEREAS the New York State Department of Audit and Control has approved establishment of Lansing Water District No. 2 and WHEREAS, T.G. Miller Associates, P.C. engineers for the Town of Lansing on behalf of said Water District has reviewed all bids for the construction of the proposed work in connection with said water district and WHEREAS, the lowest responsible bidder meeting all specifications for work to be performed in Lansing Water District Number 2 is Paolangeli Contractors with a low bid in the amount of $ 126,000.00 based on estimated quanties. Noew therefore be it RESOLVED, that the bid for construction work in Lansing Water District Number 2 be in the same awarded to Paolangeli Contractors in the amount of $ 126,000.00 and be it further RESOLVED, that the Town Supervisor hereby is authorized and directed to execute a contract on behalf of the Town for said construction with Paolangeli Contractors. Kirby who moved its adoption, seconded by Mr. Hilliard: ' The adoption of the Order was duly put to a vote and upon Roll Call, the vote was as follows. Said Order attached hereto and made a part thereof. THE FOLLOWING ORDER IN THE MATTER OF THE ESTABLISHMENT OF LANSING WATER DISTRICT NUMBER 10 IN THE TOWN OF LANSING, COUNTY OF TOMPKINS STATE OF NEW YORK, offered by Mr. Hilliard, who moved its adoption, seconded by Mrs. Kirby: The adoption of the Order was duly put to a vot and upon Roll Call, the vote was as follows: Herbert Howell, Supervisor Voting Aye Bert Hilliard, Councilman Voting Aye Jeannine Kirby, Councilwoman Voting Aye The Order was thereupon declared duly adopted. Miller Associates,P.C. engineers for the Town of Lansing on behalf of both Water Districts has reviewed all bids for the construction for the proposed work in connection with said water districts and WHEREAS, the lowest responsible bidder meeting all specifications for work to be performed in Lansing Water District Number 8 is Paolangeli Contractors with a low bid in the amount of $ 43,498.20 based on estimated quanties and WHEREAS, the lowest responsible bidder meeting all specifications for work to be performed in Lansing Water District Number 10 is Paolangeli Contractors with a low bid in the amount of $ 15,864.20 based on estimated quanties and be it further RESOLVED, that the bid for construction work in Lansing Water District Number 8 be in the same awarded to Paolangeli Contractors in the amount of $ 43,498.20 and Water District Number 10 be in the same awarded to Paolangeli Contractors in the amount of $ 15,684.20 and be it further RESOLVED, that the Town of Lansing Supervisor hereby is authorized and directed to execute a contract on behalf of the Town for said construction with Paolangeli Contractors. VOTE OF TOWN BOARD Herbert Howell, Supervisor Voting Aye Jeannine Kirby, Councilwoman Voting Aye Bert Hilliard, Councilman Voting Aye RESOLUTION, offered by Mr. Hilliard, who moved its adoption, seconded by Mrs. Kirby: RESOLVED, that the Highway fund bill # 240 to Isbell Contracting Company in the amounf of- $- 5,672.00 is hereby approved for payment. VOTE OF TOWN BOARD Herbert Howell, Supervisor Voting Aye Jeannine Kirby, Councilwoman Voting Aye Bert Hilliard, Councilman Voting Aye Supervisor Howell read a letter to the board members from Mr. and Mrs. Keith Loson concerning hook up to water for their property on Drake Road. RESOLUTION, offered by Mr. Hilliard, who moved its adoption,'seconded by Mrs. Kirby: RESOLVED, that the Town Board will allow Mr. and Mrs. Loson to contract with Bolton Point with the intension to hook -up to a Water District if and when one is ever formed in that area. Be it further RESOLVED, that Robert Williamson will draw up the contract and the Supervisor is hereby authorized and directed to execute said "contract - n�.b.ehalf of. tFie�Town. and - 3 - one copy of the Order having been duly filed in the Office of the State Department of Audit & Control at Albany, New York, and the other in the office of the Town Clerk of the Town of Lansing, and the Town Clerk having duly presented such Order to the Town Board at this meeting, being its first meeting held after the Order was filed with her; it is hereby ORDERED that Lansing Water District No. 8 be established in the Town of Lansing as described by the Order of the State Comptroller to be designated Lansing Water District No. 8 of the Town of Lansing and to be of the description and boundary shown in exhibit "A" attached hereto and made a part hereof, and it is further ORDERED that the following improvements in said district be constructed upon required funds being made available or provided for as shown on the map and plan of the proposed district on file with the Town Clerk, the facilities to be contructed to consist of some 1800 feet of 8 -inch diameter ductile iron water main, together with valves, fire hydrants and other related necessary appurtenances. The proposed district of approximately 18 acres in area will include 10 homes and three vacant lots located along Buck Road between Brickyard Hill Road and Wilson Road in the Town of Lansing. -4- Treated water requirements, estimated not to exceed an average of 4,500 gallons per day, will be purchased from the Southern Cayuga Lake Intermunicipal Water Commission. The Town of Lansing is a member of the Commission, and the capacity of the Bolten Point Supply is considered more than adequate to serve the district, and it is further ORDERED that the proposed improvements, including costs of rights -of -way, acquisitions of sites, construction costs, legal fees and other expenses in the total amount of $53,500.00 shall be financed as follows: by issuance of serial bonds of said Town in the above amount to mature in such a number of annual installments not exceeding 20 years, as may hereafter be determined by the Town Board of Lansing payable in the first instance from assessments levied by the Town Board in proportion as nearly as may be to the benefit which each lot or other parcel within the district will derive therefrom, and it is further ORDERED, that the Town Clerk of the Town of Lansing is hereby authorized and directed to cause a certified copy of this Order to be duly recorded in the office of the Clerk of the County of Tompkins in which the Town of Lansing is located, within 10 days after the adoption of this Order, and it is further -5- ORDERED, that the Town Clerk is hereby authorized and directed to file a certified copy of this Order in the office of the State Department of Audit & Control, Albany, New York, with in ten days after the adoption of this Order. G., Miller Associates p.c., Engineers and Surveyors, Ithaca, New York. .:E r 1_ IN THE MATTER OF THE ESTABLISHMENT OF LANSING WATER DISTRICT NUMBER 10 IN THE TOWN OF LANSING, COUNTY OF TOMPKINS, STATE OF NEW YORK A resolution having been duly adopted by the Town Board by the Town of Lansing directing the Town Engineer to supervise the preparation of a map, plan and report for providing the facilities, improvements or serivices in a portion of the Town of Lansing, wherein a water district hereinafter described was proposed to be established, and said map, plan and report having been duly filed in the office of the Town Clerk of the Town of Lansing, and an Order having been duly adopted by the Town Board of the Town of Lansing of the 8th day of October, 1986, reciting the description of the boundaries of the proposed district, the maximum amount proposed to be expended for the improvement, the proposed method of financing to be employed, the fact that a plan, map and report desc file in the Town Clerk's Office for publi specifying that the Town Board would meet of Lansing on the 30th day of October, 19 ribing the same were on c inspection and at the Town Hall, Town 86 at 8:00 p.m, for the purpose of conducting a public hearing on the proposal to establish the Lansing Water District No. 10 with the specified improvements and to hear all persons interested in the subject thereof concerning to same, and a hearing having been duly held D - 2 - by said board at such time and place, and it having been duly resolved and-determined thereafter that the Notice of Hearing was published and posted as required by law and otherwise sufficient, that all the property and property owners within the proposed district were benefited thereby, that all property and property owners benefited were included within the limits of the proposed district, and that it was in the public interest to grant in whole the relief sought, and in having been then and there further duly resolved that the establishment of said district as proposed be approved, subject to permissive referendum in the manner provided in Article 7 of the Town Law, and a certificate of the Town Clerk having been filed pursuant to subdivision 4 of Section 209 -e of the Town Law, certifying that no petition was filed requesting such a referendum, and application having been thereafter duly made in duplicate to the State Department of Audit & Control at Albany, New York, for permission to create such district as more fully provided for by Town Law Section 209 -f, and the State Comptroller having duly made and Order in duplicate dated the 26 day of June, 1987, granting permission for the creation of the district in all respects as petitioned for and approved by the Town Board as a foresaid; and one copy of such Order having been duly filed in 1_ -3- the office of the State Department of Audit & Control at Albany, New York and the other in the office of the Town Clerk of this Town, and the Town Clerk having duly presented said Order to the Board at this meeting, being its first meeting held after the Order was filed with her;. it is hereby. ORDERED, that Lansing Water District No. 10 be established in the Town of Lansing, Tompkins County New York as described in the Order of the State Comptroller, to be designated as Lansing Water District No. 10 of the Town of Lansing and to be of the description and boundaries set forth in Schedule "A" attached hereto, and it is further ORDERED, that the following improvements in said district be constructed upon the required funds being made available and provided for as shown on the map and plan of the proposed district on file with the Town Clerk, the facilities to be constructed will consist of some 620 plus or minus feet of six - inch diameter ductile iron main together with valves, fire hydrants and other related necessary appurtances. The proposed water main extension will be connected to the Town of Lansing Water District No. 2 system on Ludlowville Road. Pressure will be provided by the exisiting 1 MG Capacity Town Storage Tank located at Village Circle South on Warren Road.
