The Lansing Board met in an Adjourned Meeting at the Lansing Middle School
Auditorium on February 4, 1987 at 7 :30 P.M. to discuss the new proposed Water
District # 90

The Supervisor called. the mpeting.to.order at 7:30 P.M. having the
Clerk take the Roll Call.
Proof of Notice having been furnished by the Town Clerk, the Public
Hearing for Proposed Water District # 9 was called to order at 7 :30 P.M.
Town Attorney Robert Williamson explained the legal aspects of the
Proposed Water District # 9.
Engineer, T.G. Miller and his assistant, David Herrick gave a presentation
outlining the following:
Water System to be constructed
Method of Operation
Estimated of the Project Cost
Method of Financing
Proposed Assessed`Formula
Estimates of annual assessment charges to the Everage homeowner
Estimated annual maintenance and operating costs
One time connection charge
A question and answer period followed Mr. Miller's presentation.
A show of hands was asked for and objected to by a resident of Stormy
View Drive.. The resident stated the hearing for a point of information and
:3 large percentage of the people in the proposed district did_notl-receive, the Town
Newsletter which contained information of the Public Hearing.
The consensus was that the residents did want the water, but objected
to the high cost.
All persons desiring to be heard, having been heard the question and
answer period was closed.
It was stated that the next move was for the Town Board to consider
a formation of the Proposed Water District # 9 at the next regular Town
Board Meeting which will be held on February 11, 1987.
The Public Hearing was adjournd by Supervisor Howell at 9:20 P.M.

The Supervisor called the meeting to order at 8:00 P.M. having the

Proof of Notice having been furnished,the Public Hearing concerning
Ordinance Amendment Town of Lansing Ordinance No. 34 pertaining to partial
Tax Exemption of Real Property owned by certain persons with limited income
who are 65 years of age or older, was called to order at 8:00 P.M. by
Supervisor Howell.
The new schedule of combined annual income and the percentage assessed
valuation exemption was outlined and a short discussion followed.
Mr. William Berich Sr. objected to the age of 65 years and older. He
felt the age limit should be less that 65 years of age.
All.persons desiring to be heard, having been heard, the Public Hearing
was terminated at 8:04 P.M.
T.own.Bo.ard Memebers discussed the Public Hearing just held and the
following Resolution was offered:
RESOLUTION offered by Mr. Emmick, who moved its adoption, seconded by
Ms. Kirby:
RESOLVED, that ORDINANCE AMENDMENT TOWN OF LANSING ORDINANCE NO. 34,
be adopted.
• The adoption of the Resolution was duly put to a vote and upon Roll Call,

NOTICE OF A PUBLIC HEARING
PLEASE TAKE NOTICE that the. Town Board of the Town of
Lansing will hold a Public Hearing at the Lansing Town
Hall, Lansing, New York at 8:00 P.M. on February 11,
1987 to consider a proposed Amendment to Ordinance
INo. 5, dated August 9, 1966, as amended, to provide
'for a partial tax exemption for real property owned by
persons with limited income who are 65 years of age or
over. Such parcel exemption shall be to the extent set
iforth in the schedule following:
Up to $12,025 50 percent
More than $12,025 but less than $32,525 45 percent;
$12,525 or more, but less than $13,025 40 percent!
$13,025 or more, but less than $13,525 35 percent'

Helen Howell spoke on the possibility of
a Land Fill
being in
the Town
of Lansing. She was concerned that the
residents of
Lansing
seemed
unaware that this possibility exists. She also
stated that
the next
Solid
Waste Committee meeting will be in Danby on
February.19,
1987 at
7:30 P.M.
She informed everyone that there would be an
Open House
at the new
Jail
on February 28, 1987 from 1:00 P.M. to 5:00 P.M.
Discussion was held on the Proposed Water District No. 9. Mr. Lucente
presented a letter to each Board Member which stated his concern in the cost
of the project, also he felt that sewer was more important. He felt it might
be less expensive if he could form his own water district. The Boards
consensus was that his request was too late to modify the proposal.
Robert Krizek spoke on behalf of his father, Mr. James Krizek. He
felt that the formula for establishing the assessment was unfair. He also
felt that if the proposal was adopted as presented that legal action would
be taken.
Attorney Robert Williamson then read the resolution to establish
the proposed Water District No. 9 in its entirety.
Mr. Williamson then explained the legal procedure concerning a
referendum.

WATER DISTRICT NO. 9, be adopted.

Highway Supertindent, Howard Groat reported that the Lansing Lions
Club had approached him about putting in another Pavillion in the
Myers Park. They want the board's opinion on the size and the location
of the new pavillion. The Town Board will meet at Myers Park at a later
date to decide on the Lansing Lions Club request.
It was also stated that the final Survey maps on the Lansing Park
had been completed, and permanent markers would be set at a later date.
Certified Public Accountant, Andrew N. LaVigne presented his audit report
of the Town Books for the year ending December 31, 19859
Mr. Howell had one addition to add to Mr. LaVignes report, which was
as follows:
At its meeting dated December 30, 1985, the Town Board of the Town of
Lansing, New York, agreed to accept bids for the purchase of the following
equipment:
1985 Caterpiller Loader
$ 186,359
1986 Ford F150 Pickup Truck $ 9,385
The loader was purchased on a five year installment plan, requiring
annual payments of $ 36,784.50, including interest.

Supervisor Howell reported that the Village of Lansing would like to
exchange copies of Board Minutes. Mr. Howell also received a letter form
the Village of Lansing thanking us for our part in the trash pick -up day.
Attorney Robert Williamson has filed the deed between the Town and Alex Cima
for roads in the Horizons Subdivision with the Tompkins County Clerk's
Office in Book 618 of Deeds at Page 610. This is also on file in the Lansing
Town Clerk's Office.
Supervisor Howell presented his monthly report.

RESOLUTION - APPROVAL OF ESTABLISHEMENT
OF LANSING WATER DISTRICT NO. 9
TOWN OF LANSING
At a meeting of the Town Board of the Town of Lansing held
at the Town Hall in the Town of Lansing, Tompkins County, New
York, on the 11th day of February, 1987, at 8:00 p.m..
PRESENT: Herbert Howell, Supervisor
Bert Hilliard, Councilman

In the matter of the establishment of Lansing Water
District No. 9 in the Town of Lansing, Tompkins County, New
York, pursuant to Article 12 -A of the Town Law.
WHEREAS, a map, plan and report relating to the
establishment of the proposed Lansing Water District No. 9,
prepared by T.G. Miller, P.C. & Associates, Engineers and
Surveyors, duly licensed by the State of New York, in manner and
in such detail as has been determined by the Town Board of
Lansing, having been duly filed with the Town Clerk in
accordance with the requirements of Article 12 -A of the Town
Law, and
WHEREAS, an Order was duly adopted by the Town Board of the
Town of Lansing on the 14th day of January, 1987, reciting the
filing of said map, plan and report, the improvements proposed,
the boundaries of the proposed district, the estimated expense
thereof, the proposed method of financing, the fact that the

map, plan and report describing the same were on file in the
Town Clerk's office for public inspection, and stating all other
matters required by law to be stated, and specifying February 4,
1987, at 7:30 p.m. on that day, as the time, and the Lansing
Middle School, Town of Lansing, as the place where the said Town
Board would meet to consider said map, plan and report, and to
hear all persons interested in the subject thereof concerning
the same, and to take such action thereon as is required or
authorized by law, and
WHEREAS, such Order was duly published and posted as
required by law, and
WHEREAS, a hearing on said matter was duly held by said
Town Board on the 4th day of February, 1987, commencing at 7:30
p.m. on that day, at the Lansing Middle School, in said Town of
Lansing, and full discussion of the matter having been duly had,
and all persons desiring to be heard, having been duly heard,
NOW, upon the evidence given upon such hearing and upon
motion of George Stevens, seconded by Louis Emmick, it is
RESOLVED AND DETERMINED.
a. That the notice of hearing was published and posted as
required by law and is otherwise sufficient.
b. That all the property and property owners within the
proposed district are benefited thereby.
C. That all the property and property owners benefited are
included within the limits of the proposed district.

d. That it is in the public interest to establish the
proposed water district.
BE IT FURTHER RESOLVED AND DETERMINED, that the
establishment of a water district as set forth in said map, plan
and report be approved; that the improvements therein mentioned
be constructed, and the necessary easements and lands be
acquired, upon the funds being made available and provided for;
and such district shall be known and designated as Lansing Water
District No. 9 in the Town of Lansing and shall include the
premises described in Exhibit "A" attached hereto and made a
part hereof;
BE IT FURTHER RESOLVED, that the following improvements in
said district be constructed upon the required funds being made
available or provided for:
SERVICE AREA: As described in Exhibit "A ", the proposed
water district includes lands to be served by water main
situated along Armstrong Road from Asbury Road to Franklyn
Drive, Asbury Drive; Asbury Road from North Triphammer Road East
to Warren Road, Atwater Road to a point approximately 1,500+
feet North of Asbury Road, Bean Hill Lane; Belvedere Drive;
Brookhaven Drive; Farrell Road to a point approximately 3,200+
feet East of Warren Road; Forest Acres Drive; Franklyn Drive;
Grandview Drive; Hillcrest Road from Triphammer Terrace
southeast to Warren Road; Horvath Drive; Maple Drive; North
Triphammer Road from Asbury Road North to Peruville Road; Sharon

Drive; Sky Acres Drive; Springbrook Circle; Stormy View Drive;
Triphammer Terrace; Stonehaven Drive; Village Circle North;
Village Circle South; Village Place; Warren Drive from Warren
Road to boundary of Water District No. 5 and Warren Road from
Warren Drive North to Asbury Road,
POPULATION TO BE SERVED: The present population to be
served in the proposed district is estimated at 1,200 (480 units
x 2.5 persons /unit). In the future the population served might
be expected to increase to 2,400.
WATER SUPPLY: Present treated water requirements,
estimated not to exceed an average of 0.12 MGD (1,200 persons x
100 GPCD) to supply some 480 dwelling units and several small
businesses, will be purchased from the Southern Cayuga Lake
Intermunicipal Water Supply Commission (Bolton Point Water
Supply). Future water requirements might reach 0.48 MGD. The
Town of Lansing is a member of the commission, and the capacity
of the Bolton Point Supply is considered more than adequate to
serve this district now and in the future.
WATER SYSTEM TO BE CONSTRUCTED: As shown on the map and
plan of the proposed water district, the facilities to be
constructed will consist of approximately 55,700 feet of 10 -inch
and 8 -inch diameter ductile iron water mains together with fire
hydrants, valves and other related and necessary appurtenances.
METHOD OF OPERATION:
Water will be drawn from the existing
Lansing Town Water District at the following points: Along

North Triphammer Road at Asbury Drive, Horvath Drive, Asbury
Road at Triphammer Terrace and at Warren Road and Village Circle
South. Pressure and volume, including storage, will be provided
by a pumping station at 1.0 MG tank previously constructed under
Water District Nos. 4 and 5.
BE IT FURTHER RESOLVED, that the proposed improvements,
including costs of rights -of -way, construction costs, legal fees
and other expenses be financed by the issuance of serial bonds
of said Town to mature in such number of annual installments not
exceeding 30 years, payable in the first instance from
assessments levied by the Town Board in proportion as nearly as
may be to the benefit which each lot or parcel will derive
therefrom.
BE IT FURTHER RESOLVED, that this Resolution is subject to
permissive referendum as provided in Section 209(e) of the Town
Law.

A RESOLUTION AUTHORIZING THE ISSUANCE OF 5150000 SERIAL BONDS
OF THE TOWN OF LANSING, TOMPKINS CONTY, NEW YORK, TO PAY THE
COST OF THE INCREASE AND IMPROVEMENT OF THE FACILITIES OF WATER
DISTRICT NO. 2 OF SAID TOWN.
WHEREAS, pursuant to proceedings heretofore duly had and taken in
accordance with the provisions of Section 202 -b of the Town Law, and
more particularly an order dated October 30, 1985, the Town Board of
the Town of Lansing, Tompkins County, New York has determined it to
be in the public interest to increase and improve the facilities of
water District No. 2 of said Tcwn, at a maximum estimated cost of
$150,000; and
WHEREAS, it is now desired to provide funding
NOW, THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of

main in Ludlowville Road to provide a connection to the proposed
Water District No. 10, together with a pressure reducing valve and
fire hydrants, including incidental expenses in connection therewith,
there are hereby authorized to be issued 5150,000 serial bonds of
said Town pursuant to the provisions of the Local Finance Law.

It is hereby determined that the plan for the
financing of the aforesaid specific object or purpose is by the
issuance of the .$150,000 serial bonds of said Town authorized to be
issued pursuant to this bond resolution. Further details pertaining
to said bonds will be prescribed in a further resolution or
resolutions of this Town Roard.
Section__ .3s It is hereby determined that the period of probable
usefulness of the aforesaid specific object or purpose is ten years,
pursuant to subdivision 1 of paragraph a of Section 11.00 of the
Local Finance Law. It is hereby further determined that the maximum
maturity of the serial bonds herein authorized will exceed five years.
�ectign_�_ Subject to the provisions of the Local Finance Law,
the power to authorize the issuance of and to sell bond anticipation
notes in anticipation of the issuance and sale of the serial bonds
herein authorized, including renewals of such notes, is hereby
delegated to the Supervisor, the chief fiscal officer* much notes
shall be of such terms, form and contents, and shall be sold in such
manner, as may be prescribed by said Supervisor, consistent with the
provisions of the Local Finance Law.

County, New York, are hereby irrevocably pledged to the payment of
the principal of and interest on such obligations as the same
respectively become due and payable. An annual appropriation shall
be made in each year sufficient to pay the principal of and interest
on such obligations becoming due and payable in such .year.
Section 69 The validity of such bonds and bond anticipation notes
may be contested only if:
1) Such obligations are authorized for an object or purpose for
which said Town is not authorized to expend money, or
2) The provisions of law which should be complied with at the date
of publication of this resolution are not substantially complied
with,
and an action, suit or proceeding contesting such validity is
commenced within twenty days after the late of such publication, or
3) Such obligations are authorized in violation of the provisions of
the Constitution.

ORDINANCE AMENDMENT
TOWN OF LANSING ORDINANCE No. 34
i Ordinance of the Town of Lansing, County of Tompkins and
State of New York, providing for amendment to Ordinance
No. 5, ordinance of the Town of Lansing, providing for a
partial tax exemption of real property owned by certain
persons with limited income who are 65 years of age or
over, adopted 'August 9, 1966, which ordinance was
amended November 30, 1970, March 11, 1975, February
14, 1978, June 27, 1979, September 9, 1980, July 30, 1982,
and March 13, 1984.
SECTION 1. The provisions of the ordinance of the Town of
Lansing adopt ^eI August 9, 1966, as amended, is hereby
amended to read as follows:
Section 1. This ordinance is enacted pursuant to Section 467
of the Real Property Tax Law of the State of New York as
amended by Chapter 756 of the laws of 1986.
Section 2. Pursuant to the provisions of Section 467 of the
Real Property Tax Low of the State of New York, real prop-
erty located in the Town of Lansing, County of Tompkins,
owned by one or more persons, each of whom is 65 years
of age or over, or real property owned by husband & wife,
one of whom is 65 years of age or over, shall be partially
exempt from taxation by said Town for the applicable taxes
specified in Section 467 based upon the income of the
owner or combined income of the owners. Such partial
exemption shall be to the extent set forth in the schedule
following:

This partial exemption provided by this ordinance shall,
however, be limited to such property and persons as meet
the conditions, qualifications, exclusions and limitations
set forth in Section 467 of the Real Property Tax Law of the
State of New York. This Local Low.sholl be administered in
accordance with said sections of the Real Property Tax Law,
as now adopted, and as they may be amended from time
to time, and the provisions of said sections as provided in
Section 467 shall be applicable to the effectuation of the
exemption provided for in this ordinance.
Section 3. Application for such exemption must be made by
the owner or all of the owners of the property on forms pre-
scribed by the State Board to be furnished by the Tompkins
County Assessment Department and shall furnish the infor-
mation and-be executed in. a manner required or pre-
scribed in such forms and shall be filed in the Assessment
Department Office on or before the appropriate taxable
status date.
Section 4. Any conviction of having made a willful false
statement of the application for such exemption 'shol I be
punishable by a fine of not more than $100.00 and shall
disqualify the applicant or applicants from further exemp-
tion for a period of five years.
Section 5. This ordinance shall, in accordance with the pro-
visions of Section 2 of Chapter 756 of the laws of 1986, be
applicable to the town tax for the year 1988, and the provi-
sions of said law shall govern the granting of an exemption
under Section 467, notwithstanding any contrary provisions
of the section.
SECTION 2. This ordinance shall be effective immediately.
SECTION 3. This ordinance shall be entered in the minutes
of the Town Board and published in the Ithaca Journal and
a copy thereof posted on a sign board maintained by the
Town Clerk of the Town of Lansing pursuant to Subdivision
6 of Section 30 of the Town Law and affidavit of publication
and posting filed with the Town,Clerk.
