The Supervisor called the meeting to order having the clerk take the Roll Call. 1 1. Proof of Notice having been furnished by the Town Clerk, the Public Hearing in the matter of the Establishment of Lansing Water District No. 7, pursuant to Article 12 -A of the Town Law, was called to order at 8 :00 P.M. by Supervisor Munson. Supervisor Munson and Eng. T.G. Miller reviewed with persons present, the map, plan and report relating to the establishment of proposed Water District No. 7. The service area, water supply, water system and method of operation was discussed. Supervisor Munson stated that the proposed improvements, including costs of rights -of -way, construction costs, legal fees and other expenses shall be financed by HUD, ARC and other grants totaling $1,233,900.00 and no capital costs will have to be financed by bonding or repaid by annual debt service assessment by those properties included in the district for these facilities. A question and answer period followed the presentation.. A letter was received from Jay and Virginia Watts Orear, requesting to be put on record their strong.desire that their lot on Sun Path be included within a Town of Lansing Water District. Since the proposed District No 7 reaches close to their land, they would like it to extend further south along East Shore Drive to their lot. A unanimous show of hands by the persons present, indicated that the Town Board go forward in the establishment of Lansing Water District V. No one appeared voicing any objection to proposed Lansing Water Dist. #7 as presented and all persons desiring to be heard, having been heard, the Public Hearing was terminated at 9:22 P.M. Members of the Town Board discussed the RESOLUTION - APPROVAL OF ESTABLISH- MENT OF LANSING WATER DISTRICT NO.. 7, after which time the following resolution was offered: RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Emmick: RESOLVED, that the RESOLUTION - APPROVAL OF ESTABLISHMENT OF LANSING WATER DISTRICT NO 7, be adopted. The adoption of the Resolution was duly put to a vote and upon roll call, the vote was as follows. Philip Munson, Supervisor - voting Aye Louis Emmick, Councilman - voting Aye George Stevens, Councilman - voting Aye Margaret McElwee, Councilwoman - voting Aye The resolution was thereupon duly adopted. Said resolution attached hereto and made a part thereof. A petition bearing fifty -three names was presented to the Town Board pro- posing a speed limit of 30 mph on Asbury Drive and Horvath Drive. Discussion by the board, following resolution offered: RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by Mr. Emmick: RESOLVED, that the clerk submit to the Co. Supt. of Highways, a request that the State Dept. of Transportation, pursuant to Section 1622.1 of the Vehicle & Traffic Law, establish a lower maximum speed at which vehicles may proceed on Asbury Drive and Horvath Drive. Carried The Town Board goes on record as, accepting with pleasure from the Lansing Lions, a new bathroom on the second floor of the Town Hall Annex. Letter received from Mulvey Law Firm regarding the Town of Lansing selling sand and gravel. Town Atty. Williamson to check into the matter. The assumption is that the board would want: the hcaritIg to be held on or before the date the budget estimates from the department heads are due tojhe budget officer, which is September 20 (Oct. 20) (T.I � §104(1).). The Federal Revenue Sharing regulations require_ that the Proposed Use Heart g"be.4- held-not less Man seven calendar days before the budget is presented to the governing board So the hearing actually depends on the date the budget is_pre- sented to the governing board, which must.be on or before October 5 . (Nov. 10) (T.L. , §106(3)). Therefore the Proposed Use Hearing could be on or before September 28 (Nov. 3) and the notice for it on or before September 18 (Oct. 24) if the board isn't dying to integrate it with the norrnal budget process. (3) Present Tentative Budget �1v OVF ,u) ,(i :e this is the date which the Federal Revenue Sharing regula- tions depend on for their requirements concern- ing the Proposed Use Hearing. (4) Additional Copies — Preliminary Budget Once the town board has reviewed the tenta- tive budget and approved any modifications thereof, it becomes the pre 11mi nary' budget. The town clerk receives a copy of it to have on file and to reproduce as many copies as the town board may direct for public distribution (T.L.; §1106(4)). The preliminary budget may not be amended after it has been approved and filed in the clerk's- office for public inspection but before the public hearing (Op. State Compt. 76 -1047 unreported) . (5) Notice of Public Hearing The town clerk shall publish a notice of the public herin, on the preliminary budgeratleast once and ai ,east five days before the meeting:; The town board inay also direct the town clerk by resolution to publish it additional times. The town clerk must also post a copy of the notice on the town signboard (C.L., §108). The federal Revenue Sharing regulations re- quire that the notice should be published at least 10 days before the public hearing. if the F.R.S. budget hearing is held in conjunction with the regular budget hearing, and State or Local Law established a different time period for advance notice, Stich law shall take precedence over the federal requirement of 10 days. However, the time period cannot be less than three days. To satisfy both the regular budgetary provi- sions (1'. Towns in Westchester County should hold the public hearing on or before December 10 and cannot adjourn it beyond December 15 (T.L., § 108) . (6) Final Budget — Minutes The town board may revise the preliminary budget and should adopt the final budget no later than November 20 (Dec. 20) (T.L., §109(1) (2)). The, town clerk must include in the minutes of the proceedings any actions taken by the board to revise the preliminary budget, adopt the final budget, and attach a copy of the final budget thereto (T.l.., §109(2)). if the town board fails to act on adopting the final budget, the preliminary buc:lgcr, :is modified, shall constitute the budget for the ensuing year (T.L., §109(3)0,. The final budget becomes the annual budget for the ensuing year. (7) Adopted Budget to Supervisor The town clerk shall prepare and certify two copies of the annual budget as adopted by the town board, with estimates, if any. These should be delivered to the supervisor within five days after its adoption. The estimates refer to those ado red pursuant to section two hundred two - a of the Town Law for improvement districts (T.L., §115). r (8) F.R.S. -- Notice of Availability The town clerk rnu.St. muse a st:u:emcnt to be published, within 30 days after adoption of the final budget, which indicates that a summary of the adopted budget showing the intended use of F.R.S. funds is available for public inspection (Office of Revenue Sharing Regulations). In conclusion, I have presented one role of the town clerk in the budget process. There are several duties and several important dates. WHEREAS, a map, plan and report relating to the establish- ment of the proposed Lansing Water District No. 7 prepared by T.G. Miller, P.C. and Associates, Engineeers and Surveyors, duly licensed by the State of New York, in manner and in such detail as has been determined by the Town Board of Lansing, having been duly filed with the Town Clerk in accordance with,the require- ments of Article 12 -A of the Town Law, and WHEREAS, an order was duly adopted by the Town Board of the Town of Lansing on the 8th day of October, 1985, reciting and filing of said map, plan and report, the improvements proposed, the boundaries of the proposed district, the estimated expense thereof, the proposed method of financing, the fact that the map, plan and report describing the same are on file in the Town Clerk's office for public inspection, and stating all other D - 2 - matters required by law to be stated, and specifying October 28, 1985, at 8:00 p.m., on that day, as the time, and the Town Hall in said Town as the place where said Town Board would meet to consider said map, plan and report, and to hear all persons in- terested in the subject thereof and concerning the same, and to take such action thereon as required or authorized by law, and WHEREAS, such order was duly published and posted as is re- quired by law, and WHEREAS, a hearing on said matter was duly held by said Town Board on this 28th day of October, 1985, commencing at 8:00 p.m. on that day at the Town Hall in said Town, and full discussion of the matter having been had, and all persons desiring to be heard, having been duly heard, NOW, upon the evidence given upon such hearing and upon motion of Margaret McElwee seconded by Louis Emmick it is RESOLVED AND DETERMINED. a) That the notice of hearing was published and posted as required by law and is otherwise sufficient. b) That all of the property and property owners within the proposed district are benefited thereby. c) That all the property and property owners benefited are included within the limits of the proposed district. d) That it is in the public interest to establish said water district as hereinafter described, and be it further 1 -3- RESOLVED AND DETERMINED that the establishment of a water district as set forth in said map, plan and report be approved; that the improvements therein mentioned be constructed, and the necessary easements and lands be acquired, upon the funds being made available and provided for; and such district shall be known and designated as the Lansing Water District No. 7 in the Town of Lansing and shall include the premises described in Exhibit "A" attached hereto and made a part hereof, and be it further RESOLVED that the following improvements in said district be constructed upon the required funds being made available or pro- vided for. a) Service Area. Tax map parcels and frontage portions of larger parcels to be served by water mains being installed under HUD and ARC grants situated along: Asbury Road from North Triphammer Road West to East Shore Drive; Brickyard Road from NYS Route 34B northwesterly to Wilson Road; East Shore Drive from 1,300 feet + North of Waterwagon Road intersection North to NYS Route 34 -34B at South Lansing; North Triphammer Road from Lansing village line North to Asbury Road; NY State Route 34B from East Shore Drive West to Brickyard Road. Also included are lands along the Cherry Road watermain from Lansing village line East to the west boundaries of Lansing (T) Water Districts 4 and 5 at Bush Lane. b) Water Supply: Treated water requirements, estimated not to exceed 300,000 gallons per day to supply some 200 homes, -4- Elderly Housing Facility, Central School Complex and several businesses will be purchased from the Southern Cayuga Lake IntermunIicipal Water Supply Commission (Bolton Point Water Supply) via the existing Town of Lansing system by connection at Cherry Road. c) Water System: As shown on the map and plan of the pro- posed water district, the water system will consist of approxi- mately 30,300 feet of 10 -inch and 8 -inch diameter ductile iron watermains together with fire hydrants, valves and other neces- sary appurtenances. Due to changing topography, static main pressures along the route would naturally vary fromm 60 to 260 p.s.i. By use of main line pressure reducing stations and pressure reducers on household services where appropriate, service pressures will be maintained in the 40 to 80 p.s.i. range. Hydrants will be in- stalled at appropriate intervals along the route for fire protection. d) Method of Operation: Water will be drawn from the ex- isting Lansing (T) Water System by a connection at Cherry Road. Pressure and volume, including storage, will be provided by the pumping station and 1.0 Mg tank previously installed under Water Districts 4 and 5. As mentioned above, hydrants for fire protec- tion will be provided all along the route, and service water pressures will be maintained in the 40 to 80 p.s.i. range, and be it further 1 - 5 - RESOLVED that the proposed improvements, including costs of rights -of -way, construction costs, legal fees and other expenses shall be financed as follows: HUD, ARC and other grants totaling $1,233,900.00, and no capital costs will have to be financed by the bonding or repaid by annual debt service assessment by those properties included in this district for these facilities. The total project cost of $1,233,900.00 will be financed as follows: HUD $19150,000900 ARC 739900.00 Wilco 10,000.00 Total $112339900000 Maintenance and operating costs will be financed by metered water revenues. The average annual costs per household unit is estimated at $120.00, and be it further RESOLVED that this resolution is subject to permissive ref- erendum as provided in Section 209 -E of the Town Law. FINAL ORDER OF TOWN BOARD IN THE MATTER OF THE ESTABLISHMENT OF LANSING WATER'DISTRICT NO, 69 TOWN OF LANSING, TOMPKINS COUNTY, NEW YORK An order having been duly adopted by the Town Board of the Town of Lansing on the 13th day of November, 1984, citing the filing of map, plan and report, the improvements proposed, the boundaries of proposed Lansing Water District No. 6, the maximum amount proposed to be expended for the improvements, the proposed method of financing to be employed and the fact that a map, plan and report describing same are on file in the Town Clerk's office for public inspection, and s.tating all other matters required by law to be stated, and specifying December 4, 1984, at 8:00 p.m. on that day as the time, and the Town Hall of the Town of Lansing as the place where the Town Board would conduct a public hearing on such proposal to establish the water district aforesaid, with the specified improvements, and to hear all persons interested in the subject thereof concerning the same, and a hearing having been duly held by said board at such time and place, and it hav- ing been duly resolved and determined following such hearing that the notice of hearing was published and posted as required by law and otherwise sufficient, that all the property and property owners within the proposed district were benefited thereby, that all property and property owners benefited were included in the limits of the proposed district, and it was in the public inter- est to grant in whole the relief sought, and it having been then and there further duly resolved that the establishment of such �� district as proposed be approved, subject to permissive 1 - 2 - referendum in the manner provided in Article 7 of the Town Law, and a certificate of the Town Clerk having been filed pursuant to Subdivision 4 of Section 209 -e of the Town Law certifying that no petition was filed requesting such a referendum, and that the permission of the State Controller not being required pursuant to Section 209 -f of the Town Law, it is hereby ORDERED, that a water district be established in said Town of Lansing, Tompkins County, New York, to be designated as Lansing Water District No. 6 of the Town of Lansing, to be of the description set forth in Exhibit "A" attached hereto, and it is further ORDERED, that the following improvements in said district be constructed upon the funds being made available or provided for; i.e. the improvements shown on a map and plan of the proposed water district, the facilities to be constructed will consist of some three thousand five hundred feet (3,500') of eight inch (8 ") and three hundred twenty feet (320') feet of six inch (6 ") di- ameter ductile iron water mains, valves, hydrants and appurte- nances. These will be constructed in stages at the expense of the subdivider who will recover his costs as lots are sold. It is estimated that the total cost of the system to the subdivider will be approximately $100,000. The mains to be constructed will operate as a part of the existing Town of Lansing water system. A connection will be made to the town system near the pumping station located at the north- west corner of the Cima subdivision. Static water pressure in 1 -3- the district, provided by the 1 M.G. town water storage tank at Village Circle South, will average 80 -100 p.s.i. Individual pressure water reducers will be installed in the homes to be con- strutted to maintain operating pressures in the 60 -80 p.s.i. range. Fire protection will be available from hydrants located at intervals throughout the subdivision, and it is further ORDERED, that the proposed improvements, including costs of rights -of -way, constructions costs, legal fees and other expenses shall be totally financed by the subdivider with no temporary or permanent financing by the Town, and it is further ORDERED, that the Town Clerk of the Town of Lansing is hereby authorized and directed to cause a certified copy of this order to be duly recorded in the office of the clerk in the county of Tompkins in which the Town of Lansing is located, within ten days after the adoption of this order, and it is further ORDERED, that the Town Clerk is hereby authorized and di- rected to file a certified copy of this order in the office of the State Department of Audit and Control, Albany, New York, within ten days after the adoption of this order.
