Supervisor Munson called the meeting to order having the clerk take the Roll Call. • Proof of Notice having been furnished by the Town Clerk, the Public Hearing to consider a proposed Amendment to Ordinance #5, dated August 9, 1966, as amended, to provide for a partial tax exepmtion for real property owned by persons with limited income who are 65 years of age or over, was called to order by Supervisor Munson. No one appeared voicing any objection to the proposed Amendment as presented, and all persons desiring to be heard, having been heard, the Public Hearing was terminated at 8:15 P.M. RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Emmick: WHEREAS, a public hearing has been held on a proposed amendment to the ordinance granting tax exemption to the elderly, now therefore be it RESOLVED, the same hereby, is approved and adopted and the Town Clerk is authorized and directed to post and publish same in accordance with the town law. (Aye) Philip Munson, Supervisor TOWN OF LANSING ORDINANCE No. 33 Ordinance of the Town of Lansing, County of Tompkins and State of New York, providing for amendment to Ordinance No. 5, ordinance of the Town of Lansing, providing for a partial tax exemption of real property owned by certain persons with limited income who are 65 years of age or over, adopted August 9, 1966, which ordinance was amended November 30, 1970, March 11, 1975, February 14, 1978, June 27, 1979, September 9, 1980 and July 30, 1982. SECTION 1. The provision of the ordinance of the Town of Lansing adopted August 9, 1966, as amended, are hereby amended to read as follows: Section 1. This ordinance is enacted pursuant to Section 467 of the Real Property Tax Law of the State of New York as amended by Chapter 589 of the laws of 1982 and Section 467 -d of the Real Property Tax Law of the State of New York as added by Chapter 991 of the laws of 1983. Section 2. Pursuant to the provisions of Sections 467 and 467 -d of the Real Property Tax Law of the State of New York, real property located in the Town of Lansing, County of Tompkins, owned by one or more persons, each of whom is • 65 years of age or over or real property owned by husband and wife, one of whom is 65 years of age or over, shall be partially exempt from taxation by said town for the applicable taxes specified in Section 467 and 467 -d based upon the income of the owner or combined incomes of the owners. Such partial exemption shall be to the extent set forth in the schedule following: ANNUAL INCOME OF OWNER OR PERCENTAGE ASSESSED VALUATION COMBINED ANNUAL INCOME OF OWNERS EXEMPT FROM TAXATION Up to $10,500.00 50% More than $10,500.00, but less than $11,000.00 45% $11,000.00 or more, but less than $11,500.00 40% $11,500.00 or more, but less than $12,000.00 35% $12,000.00 or more, but less than $12,500.00 30% $12,500.00 or more, but less than $13,000.00 25% $13,000.00 or more, but less than $13,500.00 20% This partial exemption provided by this ordinance shall, however, be limited to such property and persons as meet the conditions, qualifications, exclusion, (continued) Continued March 13, 1984 170 and limitations set forth in Section 467 and 467 -d of the Real Property Tax Law of the State of New York. This ordinance shall be administered in accordance with said sections of the Real Property Tax Law as now adopted and as they may be amended from time to time, and the provisions of said sections, as provided in Section 467 -d(b) shall be applicable to the effectuation of the exemption provided for in this ordinance. SECTION 2. This ordinance shall be effective immediately. SECTION 3. Murray, a former Supervisor of the Town of Lansing and Bids received on the Roller and Screening Plant were reviewed and discussed by the board members and Highway Superintendent. No action taken. Highway Superintendent, Howard Groat, discussed the construction of town roads, also stating that he preferred "T "s versus turn - arounds be built when • required. Letter received from Highway Superintendent Howard Groat stating that he would accept Fiddlers Green Road in its entirety, as a Town Road, said road meeting the Town of Lansing Road specifications. RESOLUTION offered by Mr. Emmick, who moved its adoption, seconded by Mr. Stevens: WHEREAS, Howard Groat, the Town Highway Superintendent, has approved.the construction of Fiddler's Green Road and turn arounds owned by Arno Finkeldey, Jr., in its entirety, and WHEREAS, the Town Attorney has approved the legal description for conveyance of said road to the town for highway and utility purposes only, including two turn- arounds, now therefore be it RESOLVED, that the Town of Lansing hereby accepts Fiddler's Green Road as a town road in its entirety. Unanimously adopted A copy of the minutes of January 3rd, January 10th, January 24th and February 14th and February 25th, 1984 having been furnished to members of the town board beforehand, the Supervisor asked for a motion to propose corrections on to accept same as submitted. RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by Mr. Emmick: RESOLVED, that the minutes as submitted by the clerk be approved. Carried RESOLUTION offered by Mr. Emmick, who moved its adoption, seconded by Mr. Stevens: RESOLVED, that Supervisor Munson be authorized to attend the Orin Lehman Luncheon to be held March 15, 1984 at the Sheraton Inn, Ithaca, N.Y., and that all necessary expenses be a town charge. Carried RESOLUTION OF RESPECT - CUSHING H. MURRAY --------------- - - - - -- RESOLUTION offered by Mr. Hilliard, unanimously seconded and adopted: WHEREAS, Cushing H. Murray, a former Supervisor of the Town of Lansing and Tompkins County Board of Supervisors for the period 1950 and 1951, died March 13, 1984, and WHEREAS, he was extremely interested in Town and County affairs and served the Town of Lansing and Tompkins County with years of devotion and diligence, • now therefore be it RESOLVED, unanimously that the members of this Board express their deepest and heartfelt sympathy and sincere condolences to the family of Cushing H. Murray, and RESOLVED, further that the clerk of the Board forward a certified copy of this resolution to the family of Cushing H. Murray. Councilman George Stevens discussed with board members, the N.Y.S. Uniform Fire Prevention and Building Code concerning the responsibilities for the enforcement of same. Mr. Stevens stated that a meeting will be held March 19th at the 7:30 P.M. at the Tompkins Co. Planning Board Office for interested Towns to exchange views and methods relating to the enforcement of the Code. Mr. Stevens also noted that New York State would be conducting a Workshop on the Code on March 29th from 7:00 P.M. to 10:00 P.M. at a place to be announced at a later date. Councilwoman Margaret McElwee discussed the modifications of the proposed Amendments to the Lansing Zoning Ordinance. (continued) 172 Continued March 13, 1984 Supervisor Munson discussed the Town plowing and sanding Village of Lansing roads. Messrs. Munson and Stevens will contact Village Officials to discuss the matter. Supervisor Munson presented his monthly report. AUDIT RESOLUTION offered by Mr. Emmick, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that General Fund bills #72 through #128 totalling $28,896.22 and Highway Fund bills #74 through #123 totalling $85,890.25 be and the same are hereby approved for payment, and be it further RESOLVED, that Water District #2 bills be and the same are hereby approved for payment. Uniform Fire Prevention and Building Code and to consider and act on any other business that may come before said board. At the request of Supervisor Munson, Councilman George Stevens chaired the meeting. Councilman George Stevens discussed the work session held at the County Planning Department on March 19, 1984 for Representatives of all Tompkins County Municipalities in regard to the State Fire and Building Codes. Board members discussed repealing Lansing Local Law #1 for the year 1983 entitled "Declaration that the Town of Lansing will not enforce the NYS Uniform Fire Prevention and'Building Codes." Action withheld, pending the legal advice of Town Attorney Robert Williamson. It was the consensus of the board that the Town advertise for a part - time position for a Lansing Zoning and Ordinance and New York State Uniform Fire and Building Code Enforcement Officer. Ad to state that engineering training /building and construction trade experience be required and salary to $8,500.00. Town Clerk instructed to place said ad in the Ithaca Journal. On motion, meeting adjourned to March 26, 1984 at 5:00 P.M.
