Letter received from the County Assessment Division requesting two Town Board Members be appointed to act on the Local Board of Assessment Review scheduled for Wednesday, June 15, 1983 from 5 - 7 P.M. at the Lansing Town Hall. RESOLUTION offered by Mr. Munson, who moved its adoption, seconded by Mr. Emmick: RESOLVED, that Margaret McElwee and George Stevens be appointed to serve on the Local Board of Assessment Review. Carried On motion, meeting adjo r ed at 5:40 P.M. • June 14, 1983 The Lansing Town Board met in Regular Session at the Lansing Town Hall on June 14, 1983 at 8:00 P.M. with Supervisor Munson presiding. Brink, Wayne Thomas, Linda VanAlstine, Thomas Allerton and Ronald Norman. The Supervisor called the meeting to order at 8:00 P.M: having the clerk take the Roll Call. Proof of Notice having been furnished by. the Town Clerk, the Public Hearing in the matter of the proposed Local Law entitled DECLARATION THAT THE TOWN OF LANSING WILL NOT ENFORCE THE NYS UNIFORM FIRE PREVENTION AND BUILDING CODE was called to order at 8:00 P.M. by Supervisor Munson. Town Board Members and persons present discussed the proposed Local Law as presented. Lansing Fire Chief, Wayne Thomas, spoke concerning fire viola- tions and the authority to handle same without the enforcement of a Uniform Code. All persons desiring to be heard, having been heard, the Public Hearing was terminated at 8:26 P.M. Ronald Norman appeared before the board to voice his objection to the 10:00 P.M. closing at the Myers Park, Mr. Norman felt that the Park Police should use more discretion in regard to the 10:00 P.M. curfew. 131 Bids were publicly opened for the sale of a 1966 Ford Tandem Axle Truck with Cab and Chassis, as is. One bid received as follows: Mary Flang, Groton, New York in the amount of $538.78. Board members reviewed and discussed the bid received, following resolution offered: RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Emmick: WHEREAS, The Highway Superintendent has duly advertised for bids for the sale of one used 1966 Ford Tandem Axle-Truck with Cab and Chassis, as is, and • WHEREAS, Mary Flang of Groton, New York, was the only bidder, said bid in the amount of $538.78, now therefore be it RESOLVED, that the aforesaid bid be and hereby is accepted. (Aye) Philip Munson, Supervisor Highway Superintendent, Howard Groat, presented a Petition from eleven persons requesting a 30 mile per hour speed limit on Salmon Creek Road. Discussion held by the board, no action taken. Highway Superintendent, Howard Groat and Board Members discussed the limb wood remaining on the John Brown Farm. It was the consensus of the board that the Highway Superintendent advertise the wood for bid, bidder to provide own Liability Insurance, limit not less than $100,000.00. (continued) 132 continued June 14, 1983 RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Stevens: RESOLVED, that the old boat and trailer at the Highway Garage be sold, in lieu of storage fees, be sold to Leon Swayze in the amount of $350.00, giving Quit Claim /Bill of Sale. Carried Memo received from Norman Stanton stating that the Recreation Committee will hold a meeting on June 16th at 8:00 P.M. in the Board Room to work on final plans for the area around and south of the Town Hall. Letter received from Carolyn J. McPherson stating that she strongly opposed the Warren Road location as a possible site for a new jail. Letters received from Roger B. Sovocool concerning 1) opposing the roadway to serve, not only the present NYSEG fly ash pile, but the new ash pile now proposed, 2) parking and refuge problems the property owners at Milliken Station Extension are having with fisherman. Letters received from the Tompkins County Department of Health concerning 1) Inadequately covered storage tank at Holgate Apartments located at 162 Lud- lowville Road, and, 2) Request of Sewer System Waiver requested by Richard Pinney on property located at 138 Ludlowville Road. A copy of the minutes of April 12, 19, May 10 and 24, 1983 having been furnished to members of the town board before hand, the Supervisor asked for a motion to propose corrections or to accept same as submitted. RESOLUTION offered by Mr. Emmick, who moved its adoption, seconded by Mr. Stevens: RESOLVED, that the minutes as submitted by the clerk be approved. Carried Supervisor Munson discussed the Lansing Creative Play Area Project being built at the Lansing Elementary School. Supervisor Munson presented his monthly report. AUDIT RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by Mr. Emmick. RESOLVED, that General Fund bills #207 through #261 totalling $78,833.68 and Highway Fund bills #193 through #237 totalling $51,414.87 be and the same are hereby approved for payment, and be it further RESOLVED, that Water District #2 bills be and the same are hereby approved for payment. Carried RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that the Executive Session be terminated and the Regular Meeting be reconvened (10:20 P.M.). RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Stevens: RESOLVED, that the Town Board of the Town of Lansing create the position of Court Clerk - full time (exempt) in accordance with the provisions of Civil Service Law, Section 14, subdivision 8 -a, as of July 1, 1983. Unanimously carried RESOLUTION offered by Mr. Hilliard, who moved its adoption, seconded by Mr. Stevens: RESOLVED, that Lorraine Abraham be employed as a Part -time Court Clerk for training purposes, effective immediately, at the rate of $4.75 per hour, plus mileage, until July 1, 1983. (Aye) George Stevens, Councilman . (Aye) Philip Munson, Supervisor LOCAL LAW #1 - 1983 DECLARATION THAT THE TOWN OF LANSING WILL NOT ENFORCE THE NYS UNIFORM FIRE PREVENTION AND, BUILDING CODE. Be it enacted by the Town Board of the Town of Lansing as follows: SECTION 1: New York State Executive Law, Section 381(2) requires that "every local government shall administer and enforce the Uniform Fire Prevention and Building Code on or after the first day of January 1984." SECTION 2: Further provisions of Executive Law, Section 381(2) allows units of local government to provide that they will not enforce the Uniform Code and permits transfer of the rights and responsibilities for enforcement to the County of Tompkins or the State of New York, whichever is appropriate. SECTION 3: The Town of Lansing, New York hereby declares that it will not enforce the Uniform Code on and after the first day of January 1984. SECTION 4: This local law shall take effect upon its being duly filed in the Office of the Secretary of State and in the office of the State Comptroller.
