The Lansing Town Board held a Special Meeting on January 28, 1983 at 5 :00 P.M.
for the purpose of considering bids received for the construction of a Water
Storage Tank for Lansing Water District #5, as advertised and to consider and
act on any other business that may come before said board.

The Supervisor called the meeting to order having the Clerk take the
Roll Call.
Board members present, reviewed and discussed the bids received
• January 28, 1983, for a 1,000,000 Gallon Water Storage Tank for Lansing
Water District #5. Following resolution was offered:
RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by
Mr. Stevens:
AWARD OF BID - LANSING WATER DISTRICT #5
WHEREAS, the Town of Lansing has duly advertised for bids for a one million
gallon Water Storage Tank for Lansing Water District #5, and
WHEREAS, Chicago Bridge and Iron Co. of 1 Wall Street, New York, New York
was the lowest responsible bidder meeting all specifications for construction
of the Water Storage Tank with the bid of $197,740.00 together with optional
proposal for Cathodic protection of the tank in the amount of $8,710.00 for
a grand total of $206,450.00,
NOW, THEREFORE BE IT RESOLVED, that the aforesaid bid be and the same is
hereby accepted and the Supervisor is hereby authorized and directed to execute
a contract with Chicago Bridge and Iron Co. for said project, and be it further
RESOLVED, that the acceptance of this bid and execution of the contract
is subject to the approval by Farmer's Home Administration.

A Petition signed by fourteen persons residing on Breed Road requested the
town to erect "CHILDREN AT PLAY" signs on the north and south sides of Breed
Road. Discussion held by the board and Highway Superintendent. The Highway
Superintendent to post signs, as requested, as soon as possible.
Park Superintendent Eric Trotter and Jerry Caward, Jr., appeared before
the board to discuss electrical problems at the Lansing Park. Mr. Caward will
submit a cost to provide separate keyed electrical outlets for dock rental
slips #2 through #15.
Campers at the Park was discussed. A $4.00 per nite camping fee and a
maximum rental period of one week was considered.
RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by
Mr. Emmick:
RESOLVED, that rates on all boat slips be increased $25.00 per season.

A copy of the minutes of December 14, 213 309 1982 and January 3, 1983
having been furnished to the members of the town board beforehand, the Supervisor
asked for a motion to propose corrections or to accept same as submitted.
RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by
Mr. Emmick:
RESOLVED,"that the minutes as submitted by the clerk be approved.

Letter received from the Tompkins County Municipal Officers Association
stating their meeting to be held on February 15, 1983 at 7 P.M. at Manos.
Ichabod Room.
Letter received from the Tompkins County Environmental Management Council
stating a workshop on the State Environmental Quality Review Act would be held
on Saturday February 26, 1983 from 10:00 AM until 1:00 PM, at the Cooperative
Extension Auditorium.
• Letter received from Highway Supt. Howard Groat concerning accumulated
sick time of Stanley Reeves. Consensus of the board that Mr. Reeves was hired
as a new employee as of January 1980, therefore, any accumulated sick time was
relinquished.
RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by
Mr. Emmick:
RESOLVED, that William Cook be appointed as a Member to the Lansing Planning
Board for a seven year term, said term retroactive to January 1, 1983 and expiring
December 31, 19890 Carried
RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by
Mrs. McElwee:
RESOLVED, that the Agreement for the year 1983 between the Tompkins County
S.P.C.A. and the Town of Lansing be accepted and the Supervisor is hereby
authorized and directed to sign said Agreement on behalf of the Town.

RESOLVED, that the Final Order In the Matter of The Establishment of
Lansing Water District No. 5 be and is hereby adopted. Said Order and action

LANSING, TOMPKINS COUNTY, NEW YORK, AT A MAXIMUM ESTIMATED COST OF $6003000,
AND AUTHORIZING THE ISSUANCE OF $6005000 SERIAL BONDS OF SAID TOWN TO PAY
THE COST THEREOF, be adopted.
Said Resolution attached hereto and made a part thereof.

• A proposed Agreement with respect to users of the Lansing Community Center
and the Town of Lansing was reviewed by the Board. The Board expressed approval
of the Agreement with the exception of Paragraph D, Item 2 which reads "Sale of
alcoholic beverages on the Premises is strictly prohibited" should be changed to
read "No alcoholic beverages shall be consumed or offered for sale on the Premises."
Supervisor Munson presented his monthly report.
AUDIT RESOLUTION, offered by Mrs. McElwee, who moved its adoption, seconded
by Mr. Stevens:
RESOLVED, that General Fund bills #23 through #60 totalling $14,838.84
and Highway Fund bills #21 through #63 totalling $32,796.57 be and the same
are hereby approved for payment, and be it further

The Lansing Town Board met in an Adjourned Meeting on February 14, 1983 at
8:00 P.M., at the Lansing Town Hall to hold a Public Hearing on a Junk Yard
Application from the New York State Electric & Gas Corp., and to conduct and act
on any other business that may come before said board.

The Supervisor called the meeting to order at 8:00 P.M. having the Town Clerk
take the Roll Call.
Proof of Notice having been furnished by the Town Clerk, the Public Hearing
on the application from the New York State Electric and Gas Corp., for a license
to operate a junk yard for use as an expansion of their present fly ash deposit
site, was called to order by Supervisor Munson.
Daniel J. Collins, Ithaca Area General Manager of NYSEG introduced the Eng-
ineers and Technicians who share responsibilities for the proposed new site.
Presentation included slides of the power plant and the proposed site, as
well as engineering drawings. The informative discussion covered all aspects of
the proposed operation.
A question and answer session followed the presentation.
No one appeared voicing any objection to the proposed Junk Yard application
and all persons desiring to be heard, having been heard, the Public Hearing was
terminated at 9:45 P.M.. Supervisor Munson stated that the Town Board shall,
within two weeks, make a finding as to whether or not the license shall be granted,
in accordance with the Junk Yard Ordinance.
Following a fifteen minute recess and the departure of persons attending the
Public Hearing, the Town Board reconvened and discussed the information presented
by NYSEG. In reviewing the Draft Environmental Impact Statement as submitted
to the N.Y.S. Department of Environmental Conservation by NYSEG, the board mem-
bers questioned the statement, "As indicated on the permit applications, disposal
of ash-from Hickling,- Goudey, Greenidge, and Jennison Stations is also proposed
as a contingency measure. It was the consensus of the board that clarification
of this statement must be determined before any action is taken on the Junk Yard
application.
On motion, meeting adjourned at 10:30 P.M

WHEREAS, an order was duly adopted uy said Town Board or the 1 =t
day of September, 1982, reciting a description of the boundaries cf
said proposed water district, the improvement proposed therefor, "e
maximum amount proposed to be. ,expended for said improvement6, the
proposed method of financing to be employed, the fact that said map,
plan and repo37t were on file in.the Town Clerk's office for- p�bl_c
inspection, and specifying the 20th day.of September, 1982, .t 8:G0
o'clock P.M., Prevailing Time, at the Town Hall of the TowM of
Lansing, as the time when and the place where said Town Board could
meet for the purpose of holding a public hearing to hear all pe_sons
interested in the subject thereof concerning the same; and
WHEREAS, such order was duly published and posted in the m_n::C_

WHEREAS, notice of the adoption of said resolution was dummy
published and posted in the manner provided by applicable provisions
of the Town Law, and proof of said publication and posting has been
duly presented to this Town Board; and
WHEREAS, the period of time for the submission and filing of a
.petition against said resolution and requesting a referendum in
connection therewith elapsed without such a petition being submitted
and filed; and
WHEREAS, in response to an application duly made pursuant to
subdivision 3 of Section 209 -f of the Town Law, the State Comptroller
has duly made an order, in duplicate, dated December 24, 1962,
granting permission for the establishment of said water district, or.
copy of which has been filed in the office of the Town Clerk anal

DESCRIPTION
LANSING WATER DISTRICT #5
All that tract or parcel of land situate in the Town of Lansing,
County of Tompkins, State of New York, bounded and described as follows:
Beginning in the east line of the Town of Lansing at the centerline
intersection of Snyder Road and Mohawk Road and running thence westerly
along the centerline of said Snyder Road also being the southerly line of
the Town of Lansing and the northerly line of the Village of Lansing, a
distance of 4205 feet + to the centerline intersection of Snyder Road and
Warren Road, running thence southerly along the centerline of Warren
Road and along the corporation line between the Town of Lansing and the
Village of Lansing a distance of 1000 feet + to the intersection of the
north lines of military lot numbers 99 and 100 with the corporation line
between the Town and Village of Lansing, running thence westerly alone
said corporation line for a distance of 25 feet + to the southeastern
corner of the Town of Lansing Water District Number 4 also being the
southeasterly corner of lands reputedly of Borg - Warner, running thence
northwesterly along the northeasterly line of lands reputedly of Bor- Warner
and along the easterly boundary of Water District Number 4 and crossing
the recently relocated Warren Road a distance of 951.8 feet + to a point,
running thence northeasterly and along the said water district boundary
and lands reputedly of Borg - Warner a distance of 64.6 feet +.to a point,
running thence northwesterly along the said water district boundary and
lands reputedly of Borg - Warner for a distance of 1778.5 feet to a point,

Section 2. The improvement proposed for said water district,
consisting of the installation' of a water distribution system to
serve said district, substantially in accordance with the aforesaid
map', plan and report, is hereby authorized and approved. The maximum
amount to be expended for said improvements shall not exceed
$600,0000 The cost of said improvement shall be financed by the
issuance of serial bonds of said Town maturing in annual installments
over a period not exceeding thirty years, payable in the first
instance from assessments levied by the Town Board in proportion as
nearly as may be to the benefit which each lot or parcel will derive
therefrom.
Section 3_ The Town Clerk is hereby authorized and directed to
cause a certified copy of this order to be duly recorded in the
office of the Clerk of Tompkins County, New York, within ten days
after the adoption of this order by this Town Board and to file a
certified copy thereof within that time in the office of the State
Department of Audit and Control, in Albany, New York, both pursuant
to subdivision 1 of Section 209 -g of the Town Law.
Section 4.

WHEREAS, it is now desired to authorize the construction of a
water distribution system in and for said Lansing Water District No.
5 of0the Town of Lansing and to provide for the financing thereof;
NOW, THEREFORE, BE IT
RESCIVED, by the Town Board of the Town of Lansing, Tompkins
County, New York, as follows.
�ect1on_1_ The construction of a water distribution system in and
for Lansing Water District No. 5 of the Town of Lansing, Tompkins
County, New York, as more fully described in the aforesaid
proceedings, at a maximum estimated cost of $600,000 is hereby
authorized.
Section 2* The maximum estimated cost of such specific object or
-- purpose is $600,000, and the plan for tine financing thereof is by the
issuance of the $600,000 serial bonds of said Town hereby authorized
to be issued pursuant to the provisions of the Local Finance Law;
provided, however, that the amount of serial bonds ultimately to be
issued shall be reduced by the amount of any State or Federal aid or

mcneys received from either Cornell University, the County of
Tompkins or the Tompkins County Industrial Development Agency for
such purpose. Further details pertaining to said bonds will be
prescribed in a further resolution or resolutions of this Torn Board.
Section__3_ It is hereby determined that the period of probable
usefulness of the aforesaid specific object or purpose is thirty
years, pursuant to subdivision 1 of paragraph a of Section 11_.00 of
the Local Finance Law. It is hereby further determined that the
maximum maturity of the serial bonds herein authorized will exceed
five years.
Section 4_ Subject to the provisions of the Local Finance Law,
the power to authorize the issuance of and to sell bond anticipation
nctbes in anticipation of the issuance and sale of the serial bonds
herein authorized, including renewals of such notes, is hereby
delegated to the Supervisor, the chief fiscal officer. Such notes
=hall be of cuch terms, form and contents, and shall be sold in such
manner, as may be prescribed by said Supervisor, consistent with the
provisions of the Local Finance Law.
Section 5. The faith and credit of said Town of Lansing,
Tompkins County, New York, are hereby irrevocably pledged to the
payment of the principal of and interest en such bonds as the same
- respectively become due and payable. There shall be annually
apportioned and assessed upon the several lots and parcels of land
within said Water District which the Town shall determine and specify
to be especially benefited by the improvement, an amount sufficient
to pay the principal and interest on said bonds as the same become
due, but if not paid from such source, all the taxable real property
in said Town shall be subject to the levy of ad valorem taxes wiz.bout
limitation as to rate or amount sufficient to pay the pri::cipal of

Section 6. The validity of such bonds and bond anticipation nctes
may be contested only if:
1) Such obligations are authorized for an object or purpose for
which said Town_ is not authorized to expend money, or
2) The provisions of law which should be complied with at the date
of publication of this resolution are not substantially complied
