At a meeting of the Town Board
of the Town of Lansing held at the
Town Hall in the Town of Lansing,
Tompkins County, New York, on
the 1st day of September 1982, at
i 6:00 O'clock p.m., present:.Philip

j In the matter of the estab-
lishment of Lansing Water Dis-
trict No. 5, the Town of Lansing,
County of Tompkins, State of New
York, pursuant to Article 12 -A of
the Town Law.
WHEREAS a map, plan and
report have been prepared in such
manner and in such detail as has
heretofore been determined by
the Town Board of Lansing, relat-
ing to the establishment of a
proposed water district in the
southern area of the town; and
WHEREAS such map, plan and
' report have been duly filed in the
I Town Clerk's office in said Town;
and
WHEREAS said map, plan and
report were prepared by T.G.
Miller, P.C., and Associates, En-
gineers and Surveyors, Ithaca,
New York, duly licensed by the
State of New York boundaries of
the proposed district, and a gener-
a al plan of.the water system, and a
report of the proposed method of
operation; and
WHEREAS said map shows the
proposed water district, water
i mains, proposed water tank and
site, including plans, specif-
ications, and easements to be
acquired; and
WHEREAS the boundaries of
the proposed district are de-
scribed in Exhibit "A" attached
hereto and made a part hereof;
and
WHEREAS the improvements
proposed'are as follows:
1. Shown on a map and plan of
the proposed water district on file
with the Town Clerk of the Town of
Lansing, the proposed system to
beconstructed consistsof approx-
imately Four Thousand Five Hun-
dred Feet (4,500') of sixteen inch
(16 ") diameter ductile Iron water
main, including valves`, fire
hydrants,and other appurtances,
together with a 1.0 Million gallon
capacity stand pipe for water
storage including in the above an
i interconnection to Lansing Water
District No. 4.
WHEAS the method of opera-
tion will be water drawn from the
Southern Cayuga Lake In-
te,rmunicipal Water System -
Bolton Point System by means of
a connection to the Lansing Water
District No. 4 in order to receive
an adequate supply of treated
water which will be stored in the
tank to be constructed near Vil-
lage Circle South. The'new tank
and connecting main, together
with the water main connecting
the pumping station now being
constructed by Water District No.
4 will provide the basic compo-
nents above outlined for service to
Lansing Water District Nos. 4and
5 and provide additional water
storage for fire protection to the
Airport Industrial Research Park
in the Village of Lansing; and
WHEREAS the proposed meth-'
od of financing the cost of said
improvements aforementioned
consists of the issurance of Serial
Bonds of the Town of Lansing to
mature in annual installments for
a period not exceeding thirty (30)
years, ,payable. in the first in -,
stance from assessments levied
by the Town Board -in proportion
as nearly as may be to the benefit
which each .lot or parcel -will
derive therefrom; and
WHEREAS the maximum
amount proposed to be expended
for the improvements aforemen-
tioned and for the acquisition of
necessary lands and easements is
Six Hundred Thousand Dollars
($600,000.00); and
WHEREAS it is anticipated
that the amount may be funded as
follows: Cornell University One
Hundred Fifty Thousand Dollars
($150,000.00); County of Tonpkins,
One Hundred Thousand Dollars
($100,000.00); Tompkins County
Industrial Development Agency,
Twelve Thousand Five Hundred
Dollars ($12,500.00); and FMHA-
ARC Grant, Three, Hundred
Thirty -Seven Thousand Five Hun-
dred Dollars ($337,500:00)giving a
total of Six Hundred Thousand
Dollars ($600,000.00); and
WHEREAS said map, plan and
report describing said improve-
ments are on file in the Town
Clerk's Office for public inspec-
tion;
NOW, on motion of Margaret
McElwee, seconded by George
Stevens, it is
HEREBY ORDERED that the
Town Board of the Town of Lans-
ing shall hold a public hearing at
the Lansing Town Hall, in said
Town of Lansing on the 20th day of
September, 1982, at 8:00 o'clock
p.m. on that day to consider said
map, plan and report and to hear
all persons Interested in the sub-
ject thereof concerning the same,
and to take such action thereon as
is required or authorized by law.
The adoption of the foregoing
Order was duly put to a vote and
upon call the vote was as follows:

and to take such action thereon as is required or authorized by law,
and,
WHEREAS, such Order was duly published and posted as required
by law, and
WHEREAS, a hearing on said matter was duly held by said Town
Board on this 20th day of September, 1982, commencing at 8:00 p.m.
on that day, at the Town Hall in said Town, and full discussion of
the matter having been had, and all persons desiring to be heard, having
been duly heard,
NOW, upon the evidence given upon such hearing and upon motion
of Margaret McElwee, seconded by George Stevens, it is
RESOLVED AND DETERMINED:
(a) That the Notice of Hearing was published and posted as
required by law and is otherwise sufficient.
(b) That all the property and property owners within the
proposed district are benefited thereby.
(c) That all the property and property owners benefited
are included within the limits of the proposed district.
(d) That it is in the public interest to establish such
water district.
BE IT FURTHER RESOLVED AND DETERMINED that the establishment
of a water district as set forth in said map, plan, and report be
approved; that the improvements therein mentioned be constructed,, and
the necessary easements and lands be acquired, upon the funds being made
available and provided for; and such district shall be known and
designated as the Lansing Water District No. 5 in the Town of Lansing and
shall include the premises described in Exhibit "A" attached hereto and
made a part thereof;
BE IT FURTHER RESOLVED that the proposed improvement, including
construction costs, costs of acquisition of lands and easements, legal
and engineering fees, and all other expenses, be financed by the issuance
of Serial Bonds of said Town to mature in such number of annual installments
not exceeding 30 years, as may hereafter be determined by the Town Board
of Lansing, payable in the first instance from assessments levied by the
Town Board in proportion as nearly as may be to the benefit which each lot
or other parcel within the District will derive therefrom (it being
anticipated that the amount may be funded as follows: Cornell University,
One Hundred Fifty Thousand Dollars ($150,000.00); County of Tompkins,
One Hundred Thousand Dollars ($100,000.00); Tompkins County Industrial
Development Agency, Twelve Thousand Five Hundred Dollars ($12,500.00); and
FmHA - ARC Grant, Three Hundred Thirty -Seven Thousand Five Hundred Dollars
($337,500.00) giving a total of Six Hundred Thousand Dollars ($600,000.00);
and
BE IT FURTHER RESOLVED that this Resolution is subject to a
permissive referendum as provided in Section 209 (e) of the Town Law.
The adoption of the foregoing Resolution was duly put to a vote
and upon roll call, the vote was as follows:

The Lansing Town Board met in an Adjourned Meeting on September 20, 1982
at 7:45 P.M. for the purpose of holding a Public Hearing on proposed uses of
Federal Revenue Sharing Funds for the year 1983 and a Public Hearing on proposed
Lansing Water District No. 5 and to consider and act on any other business that
may come before said board.

on proposed uses of Federal Revenue Sharing funds for the calendar year of 1983
was called to order by the Supervisor at 7:45 P.M.
Supervisor Munson and Members of the Town Board discussed proposed uses
of Federal Revenue Sharing funds for the calendar year of 1983 which would
include Park Projects, Youth and Recreation Projects and Highway Projects.
No written comments received, all persons desiring to be heard, having
been heard, and no objections made to said proposed uses of Federal Revenue
Sharing Funds, the Hearing was terminated at 7:58 P.M.
Proof of notice having been furnished by the Town Clerk, the Public Hearing
on Proposed Water District #5 was called to order by the Supervisor at 8:00 P.M.
Supervisor Munson and board members reviewed the map, plan and report
relating to proposed Water District #5.
James pasternak spoke of the financing of proposed Water District #5
as presented and expressed a favorable opinion compared to the previous
Water District #5 proposal.
All persons desiring to be heard, having been heard, the Public Hearing
on proposed Water District #5 was terminated at 8 :45 P.M.
Members of the Town Board discussed the RESOLUTION - APPROVAL OF
ESTABLISHMENT OF LANSING WATER DISTRICT NO. 5, after which time the following
resolution was offered:

Mr. Stevens:
RESOLVED, that the RESOLUTION - APPROVAL OF ESTABLISHMENT OF LANSING
