Continued July 20, 1982
Upon completion of his presentation, Mr. Niederkorn suggested that Town Board
Members concentrate on 1) District Lines, 2) Schedule of Land Uses or Activi-
ties and 3) Minimum lot size - density.
The Town Board and Planning Board expressed their thanks to Mr. Niederkorn
for his very thorough review of the Proposed Zoning Ordinance.
The Planning Board requested that the Town Board continue their study and
consideration of the Proposed Ordinance.
Members of the Town Board reviewed and discussed the bid received for
one 1974 or newer Tandem Truck with cab and chassis. Following Resolution
offered:

ORDINANCE NO. 31
Ordinance of the Town of Lansing, County of Tompkins, State of New York,
proving for AMENDMENT to Ordinance No. 5, ORDINANCE OF THE TOWN OF LANSING,
PROVIDING FOR A PARTIAL TAX EXEMPTION OF REAL PROERTY OWNED BY CERTAIN PERSONS
WITH LIMITED INCOME WHO ARE 65 YEARS OF AGE OR OVER, adopted August 9, 1966,
which Ordinance was amended November 30, 1970, March 11, 1975, February 14, 1978,
June 27, 1979 and September 9, 19800
1. Section 2 subdivision 4 of the Ordinance as adopted August 9, 1966,
and amended as aforesaid is hereby amended as follows:
The income for all the owners of the property for the income tax year
immediately preceding the date of the application must not exceed $10,500.00
($9,200.00). Income tax year shall mean the twelve month period for which the
owner or owners filed a federal personal income tax return, or if no such return
is filed, the calendar year. Where the title is vested in either the husband or
wife, their combined income may not exceed $10,500.00 ($9,200.00). Income includes
all social security and retirement benefits, interest, dividends, total gain from
the sale or exchange of a capital asset which may be offset by a loss from the
sale or exchange of a capital asset in the same income tax year, net rental income,
salaries or earnings, and net income from self - employment. It does not include
a return of capital, gifts or inheritances. In computing net rental income and
net income from self - employment, no depreciation deduction shall be allowed from
the exhaustion, wear and tear of real or personal property held for the production
of income. The burden of proof is upon the applicants to show eligibility and
they may be required to obtain and submit copies of their latest federal and
state income tax returns, social security statements, etc.
2. This Ordinance shall be effective immediately.
3. This Ordinance shall be entered in the Minutes of the Town Board and
published in the Ithaca Journal and a copy thereof posted on the signboard
maintained by the Town Clerk of the Town of Lansing, pursuant to subdivision 6
of Section 30 of the Town Law and Affidavit of publication and posting filed with
the Town Clerk.
