HomeMy WebLinkAbout1981-09-29Continued September 22, 1981 35 RESOLUTION offered by Mr. Munson, who moved its adoption, seconded by Mrs. McElwee: WHEREAS, the Town of Lansing and the Village of Lansing are in the preliminary stages of a proposed joint water project known as Phase I and Phase II, and WHEREAS, an application for funding with respect to said joint water project is presently pending before the Appalachian Regional Council, and WHEREAS, for the purposes of such joint project an emergency flow is being defined as an unforseen breakdown or fire flow that causes a temporary but immediate need by either municipality, and WHEREAS, the two systems of said Town and Village can be connected for long - range benefits in water services to both municipalities, NOW, THEREFORE, be it RESOLVED, that in the event of an emergency flow the Village of Lansing and the Town of Lansing will furnish water supply to the municipality in need of ® such emergency service at the actual operating cost, and be it further RESOLVED, that neither municipality is obligated to build a water line to its border for a hookup to the other municipality's line if the ARC funds are not granted as applied for. Unanimously adopted RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by Mrs. McElwee: RESOLVED, that Local Registration to be held October 10, 1981 be consolidated as follows: Districts 1, 2, 3, 4, will register at the Town Hall Annex and Districts 5, 6, and 7 will register at the Oakcrest Fire Hall. Unanimously adopted Letter received from the Executive Department of the State of New York stating that our application for eligibility to participate in the Federal Surplus Property Program had been approved. Resolution offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Emmick: RESOLVED, that the sum of $90.00 be transferred from Youth Program #A7310.4 to Youth Services A7310.4.1. Unanimously adopted RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by Mr. Emmick: RESOLVED, that the name of the road from Auburn Road back to the Retirement Home be named "Woodsedge Drive" as suggested by the Lansing Housing Authority. September 29, 1981 The Lansing Town Board met in an Adjourned Meeting on September 29, 1981 at 8 :00 P.M. to conduct a Public Hearing to consider the Establishment of Lansing Water District No. 4 and to act on any other business that may come before said board. Proof of Notice having been furnished by the Town Clerk, the Public Hearing in the matter of the establishment of Lansing Water District No. 4 was called to order at 8:00 P.M. by Supervisor Munson. Town Board members and persons present discussed the proposed establishment of Water District No. 4, reviewing the map, plan and report of same. No one appeared voicing any objection to the proposed establishment of Water District No. 4 as presented and all persons desiring to be heard, having been heard, the Public Hearing was terminated at 8:30 P.M. (continued) 36 Continued September 29, 1981 Members of the Town Board reviewed the Public Hearing just held on the pro- posed Establishment of Lansing Water District No. 4 and the following resolution was offered: RESOLUTION - APPROVAL OF ESTABLISHMENT OF LANSING WATER DISTRICT N0, 4 TOWN OF LANSING In the matter of the establishment of Lansing Water District No. 4, in the Town of Lansing, County of Tompkins, State of New York, pursuant to Article 12 -A of the Town Law. WHEREAS, a map, plan and report relating to the est Lansing Water District No. 4, prepared by T.G. (c) That all the property and property owners benefited are included with- in the limits of the proposed district. (d) That it is in the public interest to establish such water district. BE IT FURTHER RESOLVED that the proposed improvement including construction cost, cost of acquisition of lands and easements, legal and engineering fees, and all other expenses, be financed by issuance of Serial Bonds of said Town to mature in such number of annual installments not exceeding 30 years, as may here- • after be determined by the Town Board of Lansing, payable in the first instance - from assessments levied by the Town Board in proportion as nearly as may be to the benefit which each lot or other parcel within the District will derive there- from, and IT IS FURTHER RESOLVED that this Resolution is subject to a permissive referendum as provided in Section 209e of the Town Law. RESOLUTION offered by Mr. Emmick, who moved its adoption, seconded by Mrs. McElwee: RESOLVED, that Town Engineer T.G. Miller and Associates, be and they are her authorized and directed to proceed with plans, specifications and contract documents for Lansing Water No. 4. Unanimously carried RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Stevens: RESOLVED, that the Supervisor be and he hereby is authorized to sign the Contract for Engineering Services, Step I - Wastewater Facilities Planning Study for the Southern Portion of the Town. Unanimously carried RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that the Supervisor be and he hereby is authorized to sign the Contract for Engineering and Surveying Services Water System in South End of the Town. Unanimously carried RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Stevens: RESOLVED, that the Supervisor of the Town of Lansing be and he hereby is authorized to accept the Federal and State Grants for Wastewater Facilities for Southern Portion of the Town of Lansing, and be it further RESOLVED, that the County of Tompkins is hereby requested for funding • participation in the eligible portions of the study costs of the grants. Unanimously carried RESOLUTION offered by Mr. Emmick, who moved its adoption, seconded by Mr.. Hilliard: AMENDMENT OF RESOLUTION ADOPTED JUNE 91 1981 RESOLVED, that the Town Board hereby appropriates a sum not to exceed $25,000.00 to pay the cost of preparing a general map, plans, and report for providing the facilities and improvements required for water districts in the southern part of the Town of Lansing to serve premises owned by Borg Warner Corporation and adjacent areas in the Town of Lansing. Said maps, plans, and reports shall be prepared by Thomas G. Miller, under the supervision of the Town Board, be it further RESOLVED, that the expense incurred for preparing said maps, plans, and reports shall be a town charge, but in the event a water district or water districts are hereafter established or extended and the improvements constructed, the expense shall be deemed to be part of the cost of the particular water district or exten- sion thereof. This resolution is adopted subject to a permissive referendum. Unanimously adopted 38 Continued September 29, 1981 RESOLUTION offered by Mr. Emmick, who moved its adoption, seconded by Mr. Stevens: RESOLVED, that the Resolution regarding rip -rap work at Site 4 on Salmon Creek, adopted February 10, 1981, be amended to approve a preliminary cost estimate of $37,500.00 rather than $31,500.00. year beginning on the 1st day of January 1982, the itemized statement Unanimously carried Supervisor Munson announced to the board that the budget for the next ensuing year must be completed at this time. Budget study was made and reviewed by the board. Following the completion of the preliminary budget it was ready for adop- tion and the date of the hearing set thereon. FURTHER RESOLVED, that such RESOLUTION offered by Mr. Emmick, who moved its adoption, seconded by Mr. Hilliard. of the Town Clerk where it shall be available RESOLVED, that this Town Board does hereby prepare and approve as the pre- liminary budget of this Town for the fiscal year beginning on the 1st day of January 1982, the itemized statement of estimated revenues and expenditures hereto attached and made a part of this resolution, and be it FURTHER RESOLVED, that such preliminary budget shall be filed in the office of the Town Clerk where it shall be available for inspection by any interested persons at all reasonable hours, and be it FURTHER RESOLVED, that this Board shall meet at 8:00 P.M. on the 5th day of November 1981, for the purpose of holding a Public Hearing upon such preliminary budget, and be it FURTHER RESOLVED, that the Town Clerk give notice of such Public Hearing in the manner provided in Section 108 of the Town Law, and that such notice be published and posted in substantially the following form: NOTICE OF HEARING UPON PRELIMINARY BUDGET FOR THE TOWN OF LANSING FOR YEAR 1982 NOTICE IS HEREBY GIVEN, that the preliminary budget of the Town of Lansing, Tompkins County, New York for the fiscal year beginning January 1, 1982, has been completed and filed in the office of the Town Clerk of said Town, where it is available for inspection of any interested,person at all reasonable hours, FURTHER NOTICE IS HEREBY GIVEN, that the Town Board of said Town of Lansing will meet and review said preliminary budget and hold a Public Hearing thereon at the Lansing Town Hall, Lansing, New York at 8:00 P.M. on the 5th day of November 1981, and that at such hearing any person may be heard in favor of or against the preliminary budget as compiled or for or against any item or items therein contained, AND FURTHER NOTICE IS HEREBY GIVEN, pursuant to Section 108 of the Town Law, that the following are proposed yearly salaries of town officers of this town: Supervisor $ 65000.00 Councilman 4 @ $2,500.00 each 109000800 Town Clerk & Receiver of Taxes 165827.00 Highway Superintendent 20,352.00 BY ORDER OF THE TOWN BOARD Carried RESOLUTION offered by Mr. Emmick, who moved its adoption, seconded by Mr. Stevens: - WHEREAS, the Assessment Rolls for Lansing Water District #2 and Sewer District #2 have been completed and have been filed with the Town Clerk, now therefore be it RESOLVED, that the Town Board of the Town of Lansing will hold a Public Hearing on said Assessment Rolls on the 5th day of November 1981 at 8:30 P.M. in the evening thereof, then and there to meet, hear and consider any objections which may be made to the rolls, and be it further RESOLVED, that the Town Clerk publish notice of completion of the rolls pursuant to Section 239 of the Town Law, Carried RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Emmick: RESOLVED, that the Town Board of the Town of Lansing will hold a Public Hearing on November 5, 1981 at 8:45 P.M. on the proposed uses of Federal Revenue Sharing Funds for the calendar year of 1982. Carried Fay Grover presented a petition to the board, signed by fifty persons residing on Asbury Drive, requesting a street light be installed at the corner of Asbury Drive and N. Triphammer Road. BE IT FURTHER RESOLVED that the proposed improvement including construction cost, cost of acquisition of lands and ease- ments, legal and engineering fees, and all other expenses, be financed by issuance of Serial Bonds of said Town to mature in such number of annual install- ments not exceeding 30 years, as may hereafter be determined by the Town Board of Lansing, pay - able-in the first instance from assessments levied by the Town Board in proportion as nearly as may be to the benefit which each lot or other parcel within the District will derive therefrom, and IT IS FURTHER RESOLVED that this Resolution is subject to permissive referendum as pro- vided in Section 209e of the Town Law.
