July 8, 1980
The Lansing Town Board met in Regular Session at the Lansing Town Hall on
July 85 1980 at 8:00.,P.M. with Supervisor Munson presiding.

The Supervisor called the meeting to order having the clerk take the Roll Call.
Norman D. Stanton, Ordinance Officer, submitted his monthly report which was
read and reviewed by the board. Information concerning the 1980 Census was in-
cluded in the report which was discussed by the board and Mr. Stanton.
RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by
Mr. Emmick:
RESOLVED, that the Zoning Officer be authorized to purchase reproductions of
aerial photographs of the Town-of Lansing which were bought by the Tompkins County
Planning Dept., said cost not to exceed $150.00.

Raymond.McElwee, Chairman of the Lansing Water and Sewer Committee spoke to the
board in regard to the committees' recommendation for engineering services to pre.
pare a Plan of Study for sewerage facilities as part of the Application for a Step 1
Federal and State Grant for facilities planning. Discussion held by the board,
following resolution offered:
RESOLUTION offered by Mr. Hilliard, who moved its adoption, seconded by
Mr. Emmick:
RESOLVED, that the sum of $2,500.00 be appropriated from the Contingency Fund
for payment of a Contract with Engineer T.G. Miller to prepare Plan of Study for
sewers for the southern portion of the Town of Lansing including Lansing Heights,
Ludlowville, Myers.and South Lansing communities extending easterly to Scofield Rd.
and southerly to the north line of the Village of Lansing.

A copy of the minutes of May 13, May 27 and June 10, 1980 having been furnished
to the members of the town board beforehand, the Supervisor asked for a motion to
propose corrections of errors or to accept same as submitted:.
RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by
Mr. Stevens:
RESOLVED, that the minutes as submitted by the clerk be approved.

Letter received from Betty Kelly,, Secretary for the Lansing Sr. Citizens,
inviting Town Board Members to attend their dinner at noon to be held at the
Lansing Town Park on July 16th.
Letter received from John W. & Sylvia J. Hicks requesting water service from
Water District #1,
Copy of letter received from N.Y.S. Dept. of Transportation to Mr. L.M.
Noseworthy, Vice President - Properties of the Lehigh-Val-ley Railroad Co., concerning
release of the preferential right of acquisition to a parcel of abandoned Lehigh
Valley Auburn and Ithaca Branch right of way located in the Towns of Ledyard and
Genoa, Cayuga County and Lansing in Tompkins County, State of New York.
Letter received from Gary Lamont, District Conservationist for U.S. Dept. of
Agriculture concerning contract award letter sent to Heys Enterprises for the
Salmon Creek Critical Area Treatment measure.

DETERMINATION-
ANNEXATION PETITION .
i
WHEREAS, a public hearing was held by the Town Board of the
Town of Lansing and the Village Board of the Village of Lansing
on the 15th day of April, 1980 at the Town Hall .Town of Lansing -rega4-d-
ing a petition requesting annexation of certain territory of the
Village of Lansing to the Town of Lansing which petition, includin
the description of the territory proposed to be annexed is incorp-
jorated herein by reference, and
WHE.REAS,th.e Town Board has fully examined said petition, and
WHEREAS, the,said Boards have.heard all of.those in attendanc
�at. the, hearing desiring to. be heard,
NOW THEREFORE, on motion made by George Stevens seconded by
Bert Hilliard be it resolved that this Town Board of. the
Town of Lansing hereby determines pursuant.to paragraph 1, Section
711 of the General Municipal Law as follows:
1. Said petition for annexation complies.:in. all respects
with the provisions of Article.17 of'the General Municipal
Law and
2. On the basis.of the testimony taken at the hearing,
which testimony is incorporated herein by reference and
made. a part hereof and on the basis of further considerations,
including, but not limited to those relating to the effec
upon
(a).. the territory to be annexed,
(b), local government (Town of Lansing) to which
the territory is proposed to be annexed,
(c). the remaining area of the local government(Village
I
of Lansing), in which. the territory is situated and
.(d), the Ithaca City School District, Town of • Lansing
School-District, Town of Lansing Fire District, Village
of Lansing Water District (.formerly Lansing Water District
No. l) located partly in the territory proposed to be
annexed that.it is the'determiriation of this board that
it is'in the overall public interest to. approve such
annexation.

RESOLUTION APPROVING PETITION FOR ANNEXATION
Resolved on motion made by George Stevens , seconded by
Bert Hilliard that upon all of the testimony taken at the hearing
on the proposed annexation of certain territory in the Village
of Lansing to the Town of Lansing as set forth in the Petition
dated on or about March 12, 1980, held on the 16 th day of April =1980
at the Town of Lansing Hall in the Town of Lansing at which both
the members of the Town Board of the Town of Lansing and the
members of the Village Board of the Village of Lansing were
present, that the Petition complies with Article 17 of the
General Municipal Law and incorporates herein as if set forth
in full the determination adopted by,the Town Board concurrently
herewith.
BE IT FURTHER RESOLVED that this board determines that the
proposed annexation is in the overall public interest.
BE IT FURTHER RESOLVED that pursuant to section 707 sub-
division 1, all real or personal property and rights in real or
personal property, including, but not limited to'streets, roads,
highways, bridges, culverts, sidewalks, street lighting fixtures
and.conduits, pipes, drains (either above or below ground surface ,
and appurtenances, and appurtenant rights in relation thereto,
if any, owned by the Village of Lansing, shall become the
property of the Town of Lansing, to which such territory is
annexed as of the date of such annexation, but the ownership of
any real and personal property or rights in real and personal
property of, or acquired for special *improvement districts in
the.Village::.of Lansing shall remain unaffected.

BE IT FURTHER RESOLVED pursuant to section 708 subdivision
of the General Municipal Law that as concerns the apportionment
of any indebtedness and any contract or other liabilities and
interest on same, any such indebtedness or liabilities or,
.interest, if any, in the event of such annexation, shall be a
charge upon and shall be paid by the Town of Lansing to which
the territory'is annexed, as same shall become due and payable,
to the Village of Lansing in the same proportion to the whole of
such indebtedness or such liability as the.full valuation of'the
taxable real property.of the territory to be annexed bears to
the full valuation of the taxable real property of the Village
of Lansing, said government being the government in which the
territory wag situated prior to the annexation; such proportions
to be computed as of the date of annexation.
BE IT FURTHER RESOLVED that the full valuation.of taxable
property shall be as defined in subdivision 7.08 section -l.

the Village of Lansing to the Town of Lansing at a public hearing

in the. Town of Lansing at which members of the'Town Board of the
Town of ..Lansing were present as well:..as members of the Village
Board of the Village of Lansing, after reviewing the testimony
taken at said hearing; considering its determination adopted the
8th day of July, 1980; and its resolution containing its findings
adopted July 8, 1980, it is hereby
ORDERED; that.-the proposed annexation of the territory
described in said petition incorporated herein by-reference as if
set forth in full is hereby approved, and it isp
FURTHER ORDERED that its determination and'resolution adopted
July 8,..198Q including its finding with respect to the compliance,

The DETERMINATION - ANNEXATION PETITION, RESOLUTION APPROVING PETITION FOR
ANNEXATION and the ORDER regarding the recent annexation were reviewed and
discussed by the board. The action taken on same are attached hereto and made
a part thereof.
Supervisor Munson presented his monthly report.
AUDIT RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded
by Mr. Emmick:
RESOLVED, that General Fund bills #253 through #305 totalling $60,409.36
and Highway Fund bills #142 through #168 totalling $33,394.16be and the same
are hereby approved for payment, and be it further
RESOLVED, that Water District #2 bills be and the same are hereby approved
for payment.

Atty. Ralph Barnard, Architect Larry Hoffman, Lorne Montague,

The Supervisor called the meeting to order having the clerk take the Roll Call.
Architect Larry Hoffman, associated with Levatich and Hoffman, appeared before
® the board and discussed in detail, the plans and specifications for the Lansing
Retirement Home. Mr. Hoffman stated that all clearances had been obtained for
'the water and sewer systems relative to the Lansing 40 Unit Retirement Home Project.
Materials were in the process of being compiled for review by the F.H.A. Branch
in Syracuse. The proposed road and wells to be used for the Retirement Home were
thoroughly discussed and reviewed, after which time the following resolutions
were offered:
RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by
Mr. Emmick:
RESOLVED, that the Town of Lansing will accept for highway purposes, a strip
of land 60' wide by 375' deep conveyed from the Lansing Housing Authority, by
warranty deed, said parcel as shown on the survey map entitled "Portion of lands
of Viola Argetsinger" made by George Schlecht dated May 1, 1980, copy of said map
filed with Town Clerk, and be it further
RESOLVED, that this acceptance of the above premises for Town road purposes is
subject to there being no conditions, restrictions or reversions in said deed, and
be it further
