Present Robert Williamson Town Attorney Present Jane Bush Horky Town Clerk Present Visitors: Deputy Town Clerk Wanda Brink, Zoning Officer Norman Stanton and eight Lansing Residents. `�-- The Supervisor called the meeting to order having the clerk take the Roll Call. Proof of Notice having been furnished, the Public Hearing on a proposed Local Law regulating and controlling the activities of dogs in the Town of Lansing, was called to order by the Supervisor at 7 :30 P.M. Councilman George Stevens reviewed the proposed Dog Control Law for the Town of Lansing. William Brothers explained the duties of the SPCA when a municipality contracts for dog control officer services. Pound and shelter services maintained by the SPCA was also discussed. Betty Howland spoke in favor of the proposed Dog Control Law and recommended the town contract with the SPCA to administer and enforce the provisions of this proposed Dog Control Law. All persons desiring to be heard, having been heard, the hearing was terminated at 8:12 P.M. The Town Board discussed the Hearing just held on proposed Local Law #1, 1979, after which time the following resolution was offered: RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by Mr. Naegely: WHEREAS, a Public Hearing has been held on July 10, 1979 at 7:30 P.M. in the evening thereof on proposed Local Law #1, 1979 regarding the regulating and controlling the activities of dogs within the Town of Lansing and providing enforcement thereof, and WHEREAS, no one appeared objecting to same, now therefore be it RESOLVED, that said Local Law #1, 1979 entitled "Dog Control Law" be and the same is hereby declared duly adopted,. Unanimously carried LOCAL LAW #1 - 1979 DOG CONTROL LAW Be it enacted by the Town Board of the Town of Lansing as follows: This Law is adopted pursuant to Article 7 of the Agriculture and Markets Law of the State of New York. Section 1. PURPOSE The purpose of the law is to promote the public health, safety, and welfare of the community, including the preservation and protection of the property of the Town of Lansing and its inhavitants, and of the peace and good order therein by regulating and controlling activities of dogs within the Town of Lansing and is providing enforcement thereof. Section 2. PROHIBITED ACTS Any owner of a dog or any other person who harbors any dog in the Town of Lansing chall be in violation of this law if such dog: r a. Is not restrained by an adequate collar and leash or under full control of a responsible person when not on the property of the owner or any other person harboring or having custody or control of the dog. b. Engages in habitual loud howling or barking or conducts itself in such manner as to habitually annoy any person other than the person owning or harboring such dog. C. Causes damage or destruction to property, or defecates, urinates, or otherwise commits a nuisance other than on the premises of the person owning or harboring such a dog. d. Chases or otherwise harasses any person in such manner as resonably to cause intimidation or to put such person in reasonable apprehension of bodily harm or injury when not on the property of the person owning or harboring such dog. Chases, leaps on, or otherwise harasses any (1) bicycle, motorcycle, automobile or any other vehicle or device used by persons for travel or as a conveyance, or any riders or occupants thereof, or (11) any cat, dog, or domestic animal. f. Is unlicensed when six months of age or older. g. Is nots = wearing °sa4 :current. and °,vali:d>= New�York -State dog license identification tag while at large, whether or not restrained by an adequate collar and leash. h. Is not redeemed within five days after being notified either personally or by mail that said dog has been seized and impounded pursuant to Section 3 of this law. Section 3. ENFORCEMENT Any person or persons who are or may and all peace officers may, administer an for such purpose shall have the authority dogs either on or off the premises of the of this law. Section 4. FILING OF COMPLAINTS be lawfully authorized by the Town, shall, d enforce the provisions of this law, and to issue appearance tickets and to seize owner, if witnessed to be in violation Any person who observes a dog in violation of any acts prohibited by this law, may file a signed complaint, under oath, with a Justice of the Town of Lansing, or with the authorized dog control officer or any peace officer, specifying the objec- tionable conduct of the dog, the date thereof, the damage caused, or the acts con- stituting violation of this law, and including the place or places where such conduct occured and the name and residence, if know, of the owner or other person harboring such dog. Section 5. MINOR OWNER: RESPONSIBILITY OF HEAD OF HOUSEHOLD. If any dog in violation of this law is owned by a person under 18 years of age, the head of household in which said person resides shall be deemed to be the owner or person harboring such dog and shall be the person responsible for the acts of said dog for the purposes of this law. Section 6. PRESUMPTION The fact that a dog is in violation of any of the provisions of this law shall be presumptive evidence that the dog has been permitted to be in violation with the knowledge of the owner or person harboring the dog. Section 7. VIOLATIONS No person shall hinder, resist, or oppose the dog control officer, peace officer, or other person authorized to administer or enforce the provions of this law in the performance of the officers' duties under this law. Section 8. PENALTIES A violation of this law shall constitute a violation as defined in the Penal Law of the State of New York, and shall be punishable by a penalty of not more than $25.00 for the first violation, not more than $50.00 for the second violation, and not more than $75.00 for the third and all subsequent violations, or by imprison- ment for a term not to exceed five days for each violation. These penalties shall be in addition to any other penalty provided by law. Section - ;:9. VALIDITY If any section, paragraph, subdivision, clause, phrase, or provision of this law shall be judged to be invalid or held unconstitutional, it shall not affect the validity of this law as a whole or any part or provision thereof other than the part so decided to invalid or unconstitutional. Section 10. EFFECTIVE DATE This law shall take effect immediately. John, Robert and Tom Dean appeared before the board, requesting the swimming area at the Town Park be moved further north in order that unpowered boats could pull up to the shore. Recreation Director William Robinson, stated that a State Plan and Map of the swimming area had been filed with the Sheriff's Department which prohibits any,,.,boats within 100 feet of the swimming area. The board con- cluded to study the situation in the fall. Natalie Keefe appeared before the board concerning road right -of -way adjacent to her property on Ladoga Park Landing. Discussion held by the board, following resolution offered: RESOLUTION offered by Mr. Naegely, seconded by Mr. Stevens. RESOLVED, that the Town hire Eng. T.G. Miller to survey Ladoga Park Road and establish the Town of Lansing right -of -way between Myers Road and the Lake. Carried (continued) 1 C7 Continued July 10, 1979 l" Park Commissioner Eric Trotter presented board members with the approved Agreement made by the Commissioner of Parks and Recreation of the State of New York. Said Agreement is for Lansing Town Park Improvements, totalling $58,500, maximum grant in the amount of $29,250.00. Board members to review same before taking action to enter into said Agreement. William Robinson, Chairman of the Lansing Recreation Commission, presented a 1980 Budget for that portion of the Youth Programs which will be eligible for State Aid. Upon reviewing the budget, it was the consensus of the board that a decrease must be made before it can be accepted. Mr. Robinson was requested to present a revised budget at the meeting of July 24th. Robinson, Jr., and Park Commissioner Eric Trotter. The Supervisor called the meeting to order having the deputy clerk take the Roll Call. The board discussed with Mr. Sharpsteen and Attorney Williamson several of the roads they had visited today on their Annual Road Tour. Highway Supt. Sharpsteen, Attorney Williamson and Mr. Robinson were excused at this time. The board and Park Commissioner Eric Trotter, discussed the Agreement made by the Commissioner of Parks and Recreation of the State of New York for the Lansing Town Park Improvements totalling $58,500.00. RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that the Supervisor of the Town of Lansing be authorized to execute an Agreement with the Commissioner of Parks and Recreation, State of New York, Project #36- 00773. Such project estimated reasonable cost to be $589500.00 including a maximum grant of $29,250.00. Town matching funds in the amount of $29,250.00 are available and the last paragraph of Resolution, adopted May 9, 1978 authorizing the Town Supervisor to execute such contracts ® as are necessary to implement the project, is reaffirmed.
