Carried Councilman Lee Naegely reported on the Ithaca - Tompkins County Trans- portation Commission. Supervisor Philip Munson presented his monthly report. AUDIT RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Stevens: RESOLVED, that General Fund bills #157 through #218totalling $29,063.48 and Highway Fund bills #149 through #175 totalling $43,136.96 be and the same are hereby approved for payment, and be it further RESOLVED, that Water District #2 bills be and the same are hereby approved for payment. June 27, 1979 The Lansing Town Board met in an Adjourned Meeting on June 27, 1979 at 8:00 P.M. to conduct a Public Hearing to consider a proposed Amendment to Lansing Ordinance #25, and to act on any other business that may come before said board. Proof of Notice having to consider an Amendment to PROVIDING FOR A PARTIAL TAX WITH LIMITED INCOME WHO ARE which ordinance was amended 1978. The proposed amendme $7,200.00 to $8,000.00. been furnished by the Town Clerk, the Public Hearing Ordinance No. 5 ORDINANCE OF THE TOWN OF LANSING, EXEMPTION OF REAL PROPERTY OWNED BY CERTAIN PERSONS 65 YEARS OF AGE OR OVER, adopted August 9, 19669 November 30, 1970, March 11, 1975 and February 14, at will increase the maximum allowable from No one appeared voicing any objection to the proposed Amendment as presented, and all persons desiring to be heard, having been heard, the Public Hearing was terminated at 8 :15 P.M. (Aye) Philip Munson, Supervisor TOWN OF LANSING ORDINANCE N0. 28 Ordinance of the Town of Lansing, County of Tompkins, State of New York, providing for AMENDMENT to Ordinance No. 5 ORDINANCE OF THE TOWN OF LANSING, PROVIDING FOR A PARTIAL TAX EXEMPTION OF REAL PROPERTY OWNED BY CERTAIN PERSONS WITH LIMITED INCOME WHO ARE 65 YEARS OF AGE OR OVER, ADOPTED AUGUST 9, 1966 which ordinance was amended November 30, 1970, March 11, 1975 and February 14, 1978. 1) Section 2 subdivision 4 of the Ordinance as adopted August 9,* -1966, as amended is hereby amended as follows: The income for all the owners of the property for the income tax year immediately preceding the date of the application must not exceed $8,000.00 ($7,200.00). Income tax year shall mean the.twelve monthyfiperiod for which the owner or owners filed a federal personal income tax return, or if no such return is filed, the calendar year. Where the title is vested in either the husband or wife, their combined income may not exceed $8,000.00 ($79200.00). Income includes all social security and retirement benefits, interest, dividends, total gain from the sale or exchange of a capital asset which may be offset by a loss from the sale or exchange of a capital asset in the same income tax year, net rental income, salaries or earnings, and net income from self - employment. It does not include a return of capital, gifts or inher- itances. In computing net rental income and net income from self - employment, no depreciation deduction shall be allowed from the exhaustion, wear and tear of real or personal property held for the production of income. The burden of proof is upon the applicants to show eligibility and they may be required to obtain and submit copies of their latest federal and state income tax returns, social security statements, etc. 2) All persons who were otherwise eligible on May 1, 1979 and did not make application for exemption prior to May 1, 1979 because their income exceeded $7,200.00 but did not exceed $8,000.00, and those persons who did apply and who were denied the exemption because their income exceeded $7,200.00 may file application for said exemption until the final filing of the roll, August 1, 19790 3) This Ordinance shall be effective immediately. 4) This Ordinance shall be entered in the Minutes of the Town Board and published in the Ithaca Journal and a copy thereof posted on the signboard maintained by the Town Clerk of the Town of Lansing, pursuant to subdivision 6 of Section 30 of the Town Law and affidavit of publicationj:and posting filed with the Town Clerk. BY ORDER OF THE TOWN BOARD OF THE TOWN OF LANSING The clerk noted that a Complaint had been filed on June 27, 1979 at 1:30 P.M., by Ethel S. Wilkinson against the Town of Ithaca, Town of Lansing, Town of Dryden, Village of Lansing, Village of Cayuga Heights and the South- ern Cayuga Lake Intermunicipal Water Commission. Said Complaint concerns a 50 foot hard surfaced public highway extending westerly from Route 34 to the Lake. A Road Tour will be scheduled in the near future for the Town Board and Road Superintendent to review the following problems: 1) hazardous road condition north of Twin Bridges near County line, 2) Davis & Emmons Roads intersection, 3) previous request of George Beckwith to accept his road, namely, Beckwith Lane and 4) water flowing from Lansingville Road to the' property of Viola Christofferson located on Ludlowville Road.
