RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that this board hereby approves the additional work done by IRS Excavating, Inc. in the amount of $200.00 over and above the bid price of said LRS Excavating, Inc., 24 Ross Road, Lansing, New York, for driving extra piling beyond contract requirements. (Aye) Philip Munson, Supervisor Councilman Bert Hilliard discussed the Lansing Parks. Councilwoman Margaret McElwee stated that she had studied the Subdivision Rules and Regulations and would discuss it further at the March meeting. Councilman George Stevens stated that he would be meeting with William Robinson in the near future to review the Youth Recreation Program. Supervisor Philip Munson reviewed progress to -date on the Older Adults Home. Mr. Munson to request Louis Bush to act as liaison for the Town Board in matters concerning the Retirement Home for Older Adults. On Motion, meeting adjourned 10:00 P.M. Lloyd:Sharpsteen Highway Superintendent Town of Lansing, Marrh A. 1978 . °' .. • u March 14 , 1978 The Lansing Town Board met in Regular Session at the Lansing Town Hall on March 14, 1978 at 8:00 P.M. with Supervisor Philip Munson presiding. Present Robert Williamson Town Attorney Present Jane Bush Horky Town Clerk Present Visitors: Deputy Clerk Wanda Brink, Water Supt. James Howell, Zoning Officer Norman Stanton, County Representative Harris Dates and eight Lansing residents. The Supervisor called the meeting to order having the Clerk take the ® Roll Call. Proof of Notice having been furnished by the Town Clerk, the Public Hearing to consider an amendment to the Rules & Regulations for the Town Parks (Ordinance #22, Section 1) to permit use of the Town Park during closed hours for campers, seasonal boat slip renters, seasonal dry dock storage renters or seasonal launch renters, was called to order at 8:00 P.M. by Supervisor Philip Munson. Harris Dates spoke against the park being closed for Lansing residents and allowing renters of boat slips, campers etc., to be allowed to enter and leave the park at their pleasure. All persons desiring to be heard, having been heard, the Hearing was terminated at 8:06 P.M. A copy of the minutes of February 14 and February 28, 1978 having been furnished to the members of the town board beforehand, the Supervisor asked for a motion to propose corrections of errors'-,or to accept same as submitted. RESOLUTION offered by Mr. Hilliard, seconded by Mrs. McElwee, that the minutes as submitted by the clerk be approved. Carried Carolyn Burin, on behalf of several Myers residents, appeared before the board to discuss the ice jam in Salmon Creek at Myers on January 27, 1978 and the bill of $767.57 for dynamiting. Mrs. Burin stated that she had contacted Highway Superintendent Lloyd Sharpsteen and he offered to assist in evacuating the persons.living in the area but could do nothing more. Permission was obtained by Mrs. Burin from the Conservation Department to dynamite the ice jam if done by a licensed dynamiter, at which time she contacted the Breed Bros. from Trumansburg. Mrs. Burin noted that a Member of the Sheriff's Department and Mr. Sharpsteen were at the location when the Breed Bros. were looking over the creek. The residents of Myers feel the Town of Lansing should accept and pay the dynamiting bill in the amount of,$767.57. Harris Dates stated that Carolyn Burin had no legal right to encumber the town with this debt, however, being a home - owner, can understand her anxiety and frustration when they could not use their toilet facilities. Inasmuch as the county and town knew of the situation and took no action, Mrs. Burin took matters in her own hands. Legally this was wrong, morally this was right. Mr. Dates added that the dykes on the lower side of the Railroad Bridge were put in by the Town of Lansing Highway Department and strongly feels that it is the responsibility of the Town of Lansing and Lansing Town Board to accept and pay this bill in the amount of $767.57. Frank Nagy stated that the 1935 flood wiped out a large portion of Myers. ® The Railroad Company replaced the tracks, eventually Conrail built a bank which closed three - quarters of the creek which causes the water to go under the trestle. Mr. Nagy advised that duct work be done to put water back on course. Councilman Bert Hilliard stated that he felt the creek should have been cleaned, however, the town is hindered by the State and Conservation Departments, did not feel the town should be liable for the bill for dynamiting. Councilman Lee Naegely stated that in consideration of the amount of taxes that the residents of Myers have paid over the years and the possibility that the dynamiting may have saved their homes, the bill in question should be the respon- sibility of the town.. Councilman George Stevens stated that he would have to accept the judgment of the Supervisor and Highway Superintendent. Since the spending was not authorized by a town official it is a private matter. Should the town approve and assume the indebtedness of the bill of Mrs. Burin, how could we make a fair judgment on future bills, without prior authorization, that may be presented to the board. (continued) (continued March 14, 1978 Councilwoman Margaret McElwee stated the situation at Myers was extremely unfortunate and sad, however, the Town does not own the creek and she would have to agree with the statement made by Councilman Stevens. Floyd Oplinger, Jr., stated that he was at Myers and the residents were facing large quantities of water and the situation was very serious. Felt that if the dynamiting had not been done, the town would have been faced with a bill triple to this amount to restore the park site. Clayton Mobry, a resident of Myers Road, felt strongly that the town should pay the bill for dynamiting. Supervisor Philip Munson stated that the Railroad Company had created the problem in Salmon.Creek at Myers. Mr. Munson also stated that he had obtained permission from the'State Conservation Department to dynamite, however, when he returned to the area, the situation was stable. A short time later he returned and found they were dynamiting the creek. Attorney Robert Williamson was asked for legal advice. Mr. Williamson stated that before the Town Board can pay this dynamiting bill it has to confirm the actions of the Town Highway Superintendent and /or other town officials, if in fact, they authorized any such dynamiting. Mr. Williamson also stated that he had not heard that any town official had authorized said dynamiting. RESOLUTION offered by Mr. Naegely to pay the bill submitted by Carolyn Burin in the amount of $767.57 for dynamiting the ice jam in Salmon Creek at Myers. MOTION lost for lack of a second. RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by Mrs. McElwee: RESOLVED, that the bill submitted by Carolyn Burin in the amount of $767.57 for dynamiting the ice jam in Salmon Creek at Myers, not be approved for payment. Stanton, submitted his monthly report which was read and reviewed by the board. Floyd Oplinger, Jr., discussed the numbering change on North Triphammer Road. Councilman Lee Naegely will assist Mr. Oplinger in drafting a letter informing the persons involved, prior to the Fire Company personnel calling on the residents with additional information. Mr. Oplinger also stated that the Fire Company is contemplating up - dating the Lansing Directory. Will bring in cost figures at the April Meeting. Letter read from Rhaeto A. Pfister, on behalf, "of Boy Scout Troop 48, request- ing the Food Concession at the Town Park for the summer of 1978. Mr. Pfister also spoke to the board regarding the request. Clerk was instructed to advertise for bids for Food Concession according to law. Harris Dates, Lansing County Representative, commented on Off- Track - Betting, Economic Opportunity Corporation Outreach Program and County Antirecession funds. William Cook appeared before the board concerning Town Board Minutes of May 29, 1954. Said minutes stated that Tom Fiorilla had requested the town4"to open up a drainage ditch which was flowing over his land. The.Highway Superinten- dent was given authorization on that date to open the ditch. Mr. Cook asked the town board for comments. Supervisor Munson stated that the board would refer back to the minutes and-comment at a later date. Highway Superintendent Lloyd Sharpsteen discussed the bids which were received March 14, 1978 and publicly opened, for one New Heavy Duty,1/2 Ton Pickup Truck. Following resolution offered: RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by , Mr. Stevens RESOLVED, that the bid of Cayuga Ford, Inc., Ithaca, New York for one 1978 Heavy Duty 1/2 Ton Pickup Truck in the amount of $5,277.00 be and the same hereby is accepted and the Town Highway Superintendent is hereby authorized to complete transaction on behalf of the town. Carried Highway Superintendent Sharpsteen discussed purchasing cinders from N.Y.S. Electric & Gas Co., the cost of pipe in regard to the Milliken Road Extension, and the Mining Plan for the Salmon Creek Road Pit which was submitted to the New York State Department of Environmental Conservation. Frank Nagy discussed 16' right -of -way running east and west on south side of his property. Mr. Nagy discussed leaves in his yard. (continued) Continued March 14, 1978 Request from James L. Kopp, District Principal of Southern Cayuga Central School District, that the Town of Lansing sand the bus turn around at the Brookwood Trailer. Park in order that their bus drivers have a safer loading and unloading situation. Carried Bill received from V. Giordano Construction & Supply Corp., dated 2/17/78, in the amount of $425.00 for backhoe work done in creek bed at Milliken Road Extension. (Aye) Philip Munson, Supervisor RESOLUTION offered by Mrs. McElwee, who moved its adoption, seconded by Mr. Naegely: RESOLVED, upon recommendation of the Town of Lansing Planning Board, that Howard Cogan, 1420 Ridge Rd., Lansing, New York, be appointed to said Planning Board to fill the unexpired term of Fred Edmondson, term expiring January 1, 1979, and be it further RESOLVED, that Viola Miller be appointed_ as Lansing Delegate to the County Planning Board. Unanimously carried RESOLUTION offered by Mr. Hilliard, who moved its adoption, seconded by Mrs. McElwee: RESOLVED, that Joe Joseph, 601 Ridge Road, Lansing, New York, be re- appointed to the Lansing Parks Commission for a three year tern, said term expiring March 1981. Unanimously carried RESOLUTION offered by Mr. Hilliard, who moved its adoption, seconded by Mr. Stevens: WHEREAS, a Public Hearing was held on March 14, 1978 on the Amendment to the Rules and Regulations for the Town Parks (Ordinance 22, Section 1), and WHEREAS, everyone was heard on the proposed amendment, now therefore be it RESOLVED, that the proposed amendment is hereby approved, effective immediately. Unanimously carried TOWN OF LANSING ORDINANCE N0, 26 Ordinance of the Town of Lansing, County of Tompkins, State of New York providing for AMENDMENT TO RULES AND REGULATIONS FOR THE TOWN PARKS, adopted by this Town Board August 10, 1976, and AMENDMENT TO RULES AND REGULATIONS FOR THE TOWN PARKS, adopted May 24, 1977. Ordinance #22, Section 1 of the Ordinance as adopted August 10, 1976 is hereby amended to read as follows: All public parks in the Town of Lansing (town park at Myers, Ludlowville and Lansing recreation field) shall be closed to the public between 10:00 p.m. and 4:00 a.m. daily. The only exceptions shall be for specifically permitted users such as campers and seasonal boat slip renters, seasonal dry dock storage renters, or seasonal launch renters. In all other respects the Ordinance adopted August 10, 1976, and amended May 24, 1977 shall remain in full force and effect. This Ordinance shall be in force and effective immediately. BY ORDER OF THE TOWN BOARD (continued) Continued March 14, 1978 Supervisor Munson presented his monthly report. Councilwoman Margaret McElwee stated that the Subdivision Rules and Regu- lations will be reviewed by the Town Board and then be discussed jointly with the Planning Board. Will discuss matter further at the April Meeting. Supervisor Munson reported on the meeting of March 4th held by the Town Board and property owners residing on Milliken Road Extension. Said meeting concerned inadequate bridge and two culverts located in the area. Councilman Bert Hilliard reported on the repair of the launching ramp at the Lansing Town Park, stating the repair for same would not.exceed $1,000.00. Councilman Lee Naegely discussed Bolton Point. AUDIT RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that General Fund bills #54 through #92 totalling $49,658.70 and Highway Fund bills #41 through #64 totalling $22,823,12 be and the same are hereby approved for payment, and be it further RESOLVED, that Water District #2 bills be and the same are hereby approved for payment.
