James Howell, Zoning Officer, Norman Stanton, Planning Board Members, David Hardie and William Bement, County Representative Harris Dates and seven Lansing residents. The Supervisor called the meeting to order having the Clerk take the Roll Call. Proof of Notice having been furnished by the Town Clerk, the Public Hearing to consider an Amendment of Ordinance, PROVIDING FOR A PARTIAL TAX EXEMPTION OF REAL PROPERTY FOR PERSONS WITH LIMITED INCOME WHO ARE 65 YEARS OF AGE OR OVER, to increase the yearly income limitation from $6,500.00 to $7,200.00 and amend- ing the Ordinance further to conform to current State Amendments, was called to order at 8:00 P.M. by Supervisor Philip Munson. County Representative Harris Dates and Arthur Wells, on behalf of the Older Adult Group, supported the increase of the yearly income limitation from $6,500.00 to $7,200.00. The proposed Amendment was reviewed by the board and persons present. All persons desiring to be heard, having been heard, and no objections made to said proposed Amendment to the Ordinance, Providing for a partial tax exemption of real property for persons with limited income who are 65 years of age or over, the Public Hearing was terminated at 8:20 P.M. The Town Board reviewed the Public Hearing just held on the proposed Amendment to Ordinance #5, and the following resolution was offered: RESOLUTION offered by Mr. Hilliard, who moved its adoption, seconded by Mrs. McElwee: RESOLVED, that the Amendment to Ordinance #5 which grants exemption to persons 65 years of age or over, whose income for the Income Tax year immediately preceding the date of application does not exceed $7,200.00, together with other clauses to conform the Ordinance to the current State Amendments, be and the same is hereby adopted, and be it further RESOLVED, that this Ordinance be entered in the Minutes of the Town Board, published in the Ithaca Journal and posted on the signboard maintained by the Town Clerk. The income for all the owners of the property for the income tax year immediately preceding the date- of.the applicatiori' must not exceed 7,200.00. Income tax year shall mean the twelve month period for which the owner or owners filed a federal personal income tax return, or if no such return is filed, the calendar year. Where the title is vested in either the husband or wife, their combined income may not exceed $7,200.00. Income includes all social security and retirement benefits, interest, dividends, total gain from the sale or exchange of a capital asset which may be offset by a loss from the sale or exchange of a capital asset in the same income tax year, net rental income, salaries or earn- ings, and net income from self - employment. It does not include a return of cap- ital, gifts or inheritances. In computing net rental income and net income from self - employment, no depreciation deduction shall be allowed from the exhaustion, wear and tear of real or personal property held for the production of income. The burden of proof is upon the applicants to show eligibility and they may be required to obtain and submit copies of their latest federal and state income tax returns, social security statements, etc. Section 3a. Application for such exemption must be made by the owner, or all of the owners of the property, on forms prescribed by the State Board to be furnished by the appropriate assessing authority and shall furnish the infor- mation and be executed in the manner required or prescribed in such forms, and shall be filed in such assessor's office on or before the appropriate taxable status date. 3b. At least sixty days prior to the appropriate taxable status date, the assessing authority shall mail to each person who was granted exemptions pursuant to this section on the latest completed assessment roll an application form and a notice that such application must be filed on or before taxable status date and be approved in order for the exemption to be granted. The assessing authority (Tompkins County) shall, within three days -of-the completion and filing of the tentative assessment roll, notify by mail any applicant who has included with his application at least one self- addressed, pre -paid envelope, of the approval or' denial of the - application; provided, however, that the assessing_ authority shall, upon the.receipt and filing of the application, send by mail notification of receipt to any applicant who has included two of such envelopes with the application. Failure to mail any such application form or notices or the failure of such person to receive any'of the same shall not prevent the levy, collection, and enforcement of the payment of the taxes on property owned'by such person. Section 4. In all other respects the Ordinance adopted August 9, 1966, amended November 30, 1970, and amended March 11, 1975, shall remain in full force and effect. Section 5. This Ordinance shall be entered in the Minutes of the Town Board and published in the Ithaca Journal and a copy thereof posted on the sign- board maintained by the Town Clerk of the Town of Lansing, pursuant to sub- division 6 of Section 30 of the Town Law and affidavit of publication and post- ing filed with the Town Clerk. This Ordinance shall take effect 10 days after such publication and posting: BY ORDER OF THE TOWN BOARD OF THE TOWN OF LANSING. Harris Dates, Lansing County Representative, commented on,Off -tract betting, Tompkins County Hospital governance and the Economic Opportunity Corporation Outreach Program. Norman D. Stanton, Ordinance Officer, submitted his monthly report which was read and reviewed by the board. Donald M. Howell presented a petition to the board which read, "We, the undersigned, are concerned with the Crooked Hill Road situation, but are opposed to any permanent closing of this road to vehicles." Said petition signed by fifty -nine Lansing residents. Discussion held by the board and persons present concerning the danger, cost of repair and the possibility of closing Crooked Hill Road at some future date. Supervisor Munson stated that there would be a Public Information Meeting concerning Lansing Town Parks on February 22nd, 1978 at 7:30 P.M. at the Lansing Town Hall. Vincent Giordano appeared before the board concerning a car bridge being constructed on Milliken Road Extension, inquiring if the Town or residents of the area would assume -the financial liability of building said bridge. Dis- cussion held by the board. No action taken. Councilwoman Margaret McElwee presented recommendation to the board con- cerning fixed asset accounting. Discussion held by the board. RESOLUTION offered by Mr. Stevens, who moved its adoption, seconded by Mrs. McElwee: WHEREAS, Jay Orear, 1656 E. Shore Drive, Ithaca, N.Y. was erroneously assessed for two living units instead of one living unit on the Water Dist. #1 (continued) Continued February 14, 1978 Assessment Roll which became a lien on January 1, 1978 and was paid by Mr. Orear on January 27, 1978, now therefore be it RESOLVED, that Mr. Orear be refunded $36.50 from Water District #1 Capital Fund to correct said error. Unanimously carried. William Cook appeared before the board to discuss the drainage ditches and culverts on the west side of Salmon Creek Road that flow into Salmon Creek. Mr. Cook stated that the ditches fill up from debris and water coming down from the hills, suggesting the culverts be moved in order to divert the water directly to Salmon Creek. Members of the Board and Attorney Williamson will set up a road tour and review the situation. The bid received from Coulson Oil Co., Inc., as advertised was reviewed by the board. Following resolution offered: RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. Hilliard: • RESOLVED, that the bid of Coulson Oil Co., Inc., Locke, New York, for Diesel Fuel in the amount of .44¢ per gallon be accepted and the Highway. Superintendent is authorized to complete the transaction on behalf of the town. Carried Cayuga Heights Police Chief, Harlan MCEwen, has recommended a new numbering plan for North Triphammer Road. The Lansing Planning Board discussed these changes at their meeting of January 23, 1978 and have requested the Town Board to endorse the renumbering of addresses on North Triphammer Road to eliminate further ambiguity in reporting emergencies in this area. Discussion held by the Town Board, following resolution offered: RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. Stevens: RESOLVED, that this Town Board hereby approves the renumbering of North Triphammer Road as proposed by Cayuga Heights Police Chief, Harlan MCEwen, said renumbering to be implemented with the cooperation of the personnel of the Town of Lansing Fire Companies. Carried Lansing County Representative Harris Dates, Councilwoman Margaret McElwee, Councilmen Bert Hilliard, Lee Naegely and George Stevens, met at 9 :00 A.M., Saturday, February 11, 1978 for the purpose of auditing the Town Officer's books for the year 1977. Having reviewed said books, the following Receipts, Disbursements and Balances of the Town Officer's accounts were found to be correct and requested that said audit be submitted to the Lansing Town Board. Carried Councilman George Stevens reported on the animal control problem. Stated that he had attended two informal meetings concerning the problem. Recommended that more information be compiled from Towns and Villages that now have Animal Control Ordinances and investigate the enforcement provisions and costs before any action is taken by the board. Councilman George Stevens reported on the Tompkins County Environmental Management Council Meeting. 'The audited figure of this 12/31/76 balance reflected neither checks outstanding nor cash on hand. Adjusting for these alters this balance by a net change of of $145.67 (- 257.67 outstanding checks + $112.00 cash on hand). (continued) Continued February 14, 1978 Supervisor Philip Munson reported on the Lansing Retirement Home. Stated that he had met with Dr. Gaffney concerning water problem. Councilman Bert Hilliard reported on the meeting held by the Lansing Parks Commission. Town Attorney Robert Williamson reported that the Trial on Annexation would begin August 17th. Attorney Williamson spoke concerning the State Environmental Quality Review Act. Trotter, Chairman of the Lansing Parks Commission, requesting that Ordinance 22, "Rules and Regulations for the Town Parks", adopted August 10, 1976,'be amended as follows: Section 1, line 5 - presently reading; "The only exceptions shall be for specifically permitted users such as campers and users of boat slips under current assignment." This should be changed to read: "The only exceptions shall be for specifically permitted users such as campers and seasonal boat slip renters, season- al dry dock storage renters, or seasonal launch renters."
