ROLL CALL Wesley McDermott Supervisor Present Louis Bush Councilman Present Bert Hilliard Councilman Present Edward LaVigne Councilman Present Lee Naegely Councilman Present Lloyd Sharpsteen Highway Superintendent Present Robert Williamson Town Attorney Present Jane Bush Horky Town Clerk Present Visitors: Eugene Tobey, Frank Nagy, Barry Ford and Robert Lynch. The Supervisor called the meeting to order at 8 :00 P.M. having the clerk take the Roll Call. • Letter received from.'Sergio and Ann Neyeloff requesting a "Deaf Child" sign posted on Jerry Smith Road. Discussion held by the board. Highway Supt. Sharpsteen and Councilman Bush to discuss sign with Mr. & Mrs. Neyeloff and Mr. Sharpsteen to contact Co. Highway Supt. Stevenson regarding the request. Assemblyman Gary Lee submitted letter received by him from David S. Silver, Director of Division of Municipal Affairs, relating to a system of double -entry accounting for local governments. Ordinance Officer, Norman D. Stanton, submitted his monthly report which was read and reviewed by the board. Letter received from John C. Barney, Chairman of the Board of Zoning Appeals, stating that the terms of two members of the Board expire on June 15, 1977, namely Jeffrey Klein and John Barney. Discussion held by the board, following resolution offered: RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that Jeffrey Klein and John Barney be reappointed to the Board of Zoning Appeals for five year terms respectively, said terms beginning June 15, 1977. Carried Progress report - Tobey property, was received from Bob Murphy, Inc., said report discussed by the board and Mr. Tobey. Letter received from Mr. & Mrs. Ned G. Boice, owners of a cottage located on the land adjoining the New York State land just north of Salmon Creek. Mr. & Mrs. Boice questioned if the Town Board had any control of the all night parties, the sanitary problems and the dumping on the State Land. Discussion held by the board. It was the consensus of the board to write to the New York State Dept. of Environmental Conservation concerning this problem. Frank Nagy and Barry Ford discussed park problems with the board members. Mr. Nagy requested the town to cut the clump of trees along the dike at the Town Park and clean up the area. Discussion held by the board, following resolution offered: RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. Bush: RESOLVED, that the Town cut the trees along the dike at the Lansing Town Park. Following resolution offered: RESOLUTION offered by Mr. Bush, who moved its adoption, seconded by Mr. LaVigne: RESOLVED, that the bid of CCO Equipment Inc., of East Syracuse, New York, the lowest bidder meeting all specifications for one 1977 Front End Loader with Bucket, taking into consideration the trade -in for one used Trojan Front End Loader with bucket, making a net bid of $58,443.00, being the same is hereby accepted and the Highway Supt, is authorized to complete said transaction on behalf of the town. NOW THEREFORE, on motion of Councilman Edward LaVigne, seconded by Councilman Louis Bush that this Town Board of the Town of Lansing hereby determines pursuant to Paragraph 1 of Section 711 of the General Municipal Law that: 1) said petition for annexation entitled No. 1 complies in all respects with the provisions of Article 17 of the General Municipal Law and 2) that on the basis of the testimony taken at the hearing, which testimony is incorporated herein by reference and made a part hereof, and on the basis of further considerations, including, but not limited to those relating to the effects upon a) the territory proposed to be annexed, b) the local government (Town of Lansing) to which the territory is proposed to be annexed, c) the remaining area of the local government (Village of Lansing) in which the territory is situated, and d) the Ithaca City School District, Lansing School District, Lansing Fire District, Village of Lansing Water District, (formerly Lansing Water District No. 1) located partly in the territory proposed to be annexed, that it is the determination of this Board that it is in the overall public interest to approve such proposed annexation. (Aye) Wesley McDermott, Supervisor • RESOLUTION Approving Petition No. l: RESOLVED, on motion made by Councilman Louis Bush, seconded by Councilman Bert Hilliard, that upon all of the testimony taken at the hearing on the proposed annexation of certain territory in the Village of Lansing to the Town of Lansing as set forth and described in full in Petition No. 1 held on the 29th day of March 1977 at the Howard Johnson Motor Lodge in said Village of Lansing at which both the members of the Town Board of the Town of Lansing and the members of the Village Board of the Village of Lansing were present, that the Petition termed No. 1 complies with Article 17 of the General Municipal Law and incorporates herein as if set forth in full the Determination adopted by this Board concurrently herewith as if the same were again set forth at length. AND BE IT FURTHER RESOLVED, that this Board determines that the proposed annexation is in the overall public interest. AND BE IT FURTHER RESOLVED, that pursuant to Section 707 Subdivision 1, all real or personal property and rights in real and personal property, including, but not limited to streets, roads, highways, bridges, culverts, sidewalks, street lighting fixtures and conduits, pipes, drains (either above or below ground surface) and appurtenances and appurtenant rights in relation thereto, if any, owned by the Village of Lansing, shall become the property of the Town of Lansing, to which such territory is annexed as of the date of such annexation, but the ownership of any real and personal property or rights in real and personal property of, or acquired for special improvement Districts in the Village of Lansing shall remain uneffected. AND BE IT FURTHER RESOLVED, pursuant to Section 708 Subdivision 1 of the General Municipal Law that as concerns the apportionment of any indebtedness and any contract or other liabilities and interest on same, any such indebtedness or liabilities or interest, if any, in the event of such annexation, shall be a charge upon and shall be paid by the Town of Lansing to which the territory is annexed, as the same shall be due and payable, to the Village of Lansing in the same proportion to the whole of such indebtedness or such liability as the full valuation of the taxable real property of the territory to be annexed bears to the full valuation of the taxable real property of the Village of Lansing, said government being the government in which the territory was situated prior to the annexation; such proportions to be computed as of the date of the annexation. (Aye) Wesley McDermott, Sup:erv1sor RESOLUTION offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Naegely: WHEREAS, the Town Clerk has duly advertised for bids for the purchase of one new voting machine, and WHEREAS, the Automatic Voting Machine Division of AVM Corporation of Jamestown, New York was the only bidder with a bid of $2,420.00, now therefore be it RESOLVED, that said bid of the Automatic Voting Machine Division be and the same is hereby accepted, and be it further RESOLVED, that the town clerk is authorized to complete the transaction on behalf of the town.
