AUDIT RESOLUTION offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Naegely: RESOLVED, that General Fund bills #1 through #12, totalling $5,917.77 and Highway Fund bills #1 through #7 totalling $12,958.90 be and the same are hereby approved for payment, and be it further RESOLVED, that Water District #2 bills be and the same are hereby approved for payment. Carried On Motion, meeting adjourned at 10:45 P.M. /�� February 8, 1977 The Lansing Town Board met in Regular Session at the Lansing Town Hall on February 8, 1977 at 8:00 P.M. with Supervisor McDermott presiding. Present Clerk Present Visitors: Zoning Officer Norman Stanton and eleven visitors. The Supervisor called the meeting to order at 8:00 P.M. having the clerk take the Roll Call. Proof of Notice having been furnished, the Public Hearing on the proposed Amendment to the Ordinance Regulating Snowmobiles, to include in Section 3, subdivision (3) (b), Buck Road westerly from Route 34 to Conlon Road, Bower Road from Route 34 to Conlon Road and Searles Road from 59 Searles Road westerly to Conlon Road, as Town Roads designated for snowmobiles, was called to order by Supervisor-McDermott. John Place, residing at 142 Bower Road, appeared before the board and spoke against Bower Road being designated for snowmobiles. Mr. Place stated that the curves and hills on Bower Road made it diffucult to stop for snow- mobiles, spoke of the added liability and felt the noise disruptive to the environment. Marvin Paige, on behalf of the Snowmobile Clubs, spoke in favor of amending the Ordinance to include the new roads designated, stating that said roads were accessible to the snowmobile trails. All persons desiring to be heard, having been heard, the hearing was terminated at 8:30 P.M. Proof of Notice having been furnished, the Public Hearing on a proposed Local Law for the Town of Lansing dealing with notice to the Town of Lansing of defective and unsafe conditions in the Town Highway, etc., before a Civil Action may be maintained against the Town for damages or injury to person or property by reason of said defect, was called to order by Supervisor McDermott. Attorney Williamson reviewed the Local Law in detail with the board members and persons present. (Aye) Lee Naegely, Councilman Vote of Town Board . . . . (Aye) Wesley McDermott, Supervisor RESOLUTION CARRIED LOCAL LAW #1 - 1977 PRIOR NOTICE OF DEFECTIVE HIGHWAYS, BRIDGES ETC. Be it enacted by the Town Board of the Town of Lansing as follows: Section 1. No civil action shall be maintained against the town of Lansing (hereinafter referred to as "the Town ") or the town superintendent of highways of the Town, or against any improvement district in the Town for damages or injuries to person or property (including those arising from the operation of snowmobiles) sustained by reason of any highway, bridge, culvert, highway marking, sign or device, or any other property owned, operated or maintained by the Town or any property owned, operated or maintained by any improvement district therein, being defective, out of repair, unsafe, dangerous or obstructed unless written notice of such defective, unsafe dangerous, or obstructed condition of such highway,bridge, culvert, highway marking, sign or device, or any other property owned, operated or maintained by the Town, or any property owned, operated or maintained by any improvement district, was actually given to the town clerk of the Town or the town superintendent of highways of the Town, and that there was a failure or neglect within a reasonable time after the giving of such notice to repair or remove the defect, danger or obstruction complained of; and no such action shall be maintained for damages or injuries to persons or property sustained solely in consequence of the existence of snow or ice upon any highway, bridge, culvert or any other property owned by the Town or any property owned by any improvement district in the Town unless written notice thereof, specifying the particular place, was actually given to the town clerk of the Town or the town superintendent of highways of the Town and there was a failure or neglect to cause such snow or ice to be removed or to make the place otherwise reasonably safe within a reasonable time after the receipt of such notice. Section 2. No civil action will be maintained against the Town and /or the town superintendent of highways of the Town for damages or injuries to person or property sustained by reason of any defect in the sidewalks of the Town or in consequence of the existence of snow or ice upon any of its sidewalks, unless such sidewalks have been constructed or are maintained by the Town or the superintendent of highways.of the Town pursuant to statute, nor shall any action be maintained for damages or injuries to person or property sustained by reason of such defect or in consequence of such existence of snow or ice unless written notice thereof, specifying the particular place, was actually given to the town clerk of the Town or to the town superintendent of highways of the Town and there was a failure or neglect to cause such defect to be remedied, such snow or ice to be removed, or to make the place otherwise reason- ably safe within a reasonable time after the receipt of such notice. Section 3. The town superintendent of highways of the Town shall transmit, in writing, to the town clerk of the Town within five (5) days after receipt thereof, all written notices received by him pursuant to this law, and he shall take any and all corrective action with respect thereto as soon as practicable. The town clerk of the Town shall keep an index record, in a separate book, of all written.notices which.the town.clerk shall receive of the existence of a defective, unsafe, dangerous or obstructed condition in or upon, or of an accumulation of ice and snow upon any town highway, bridge, culvert or a sidewalk, or any other property owned by the Town, or by any improvement district, which record shall state the date of the receipt of the notice, the nature and location of the condition stated to exist, and the name and address of the person from whom the notice is received. The record of such notice shall be preserved for a period of five (5) years from the date it is received. The town clerk, upon receipt of such written notice, shall immediately and in writing notify the town superintendent of highways of the Town of the receipt of such notice. Section 5. Nothing contained in this law shall be held to repeal or modify or waive any existing requirement or statute of limitations which is applicable to these causes of action but, on the contrary, shall be held to be additional requirements to the rights to maintain such action, nor shall anything herein contained be held to modify any existing rule of law relative to the question of contributory negligence, nor to impose upon the Town, its officers and employees, and /or any of its improvement districts, any greater duty or obligations than that it shall keep its streets, sidewalks and public places in a reasonably safe condition for public use and travel. If any clause, sentence, phrase, paragraph or any part of this law shall for any reason be adjudged finally by a court of competent jurisdiction to be invalid, such judgment shall not affect, impair or invalidate the remainder of this law but shall be confined in its operation and effect to the clause, sentence, phrase, paragraph or part thereof directly involved inthe controversy or action in which such judgment shall have been rendered. It is hereby declared to be the legislative intent that the remainder of this section would have been adopted had any such provisions not been included. Section 6. This local law shall take effect immediately upon its passage by the town board of the Town and its filing with the secretary of state. A copy of the munutes of December 14, and December 28, 1976 having been furnished to the members of the town board beforehand, the Supervisor asked for a motion to propose corrections of errors or to accept same as submitted. RESOLUTION by Mr. LaVigne, seconded by Mr. Naegely, that the minutes as submitted by the clerk be approved. Carried Norman D. Stanton, Ordinance Officer, submitted his monthly report which was read and reviewed by the board. Letter received and read from Charles L. Smith concerning the creek over- flow and resultant property damage at McKinney's Point following the rains of July 11, 1976. The minutes of the December 13, 1976 meeting of the Lansing Planning Board were received and read. Letter received from LouisW. Munchmeyer, President of the Tompkins County Medical Society concerning the problem of adequate medical coverage in Towns of Tompkins County, Two Petitions for the Annexation to the Town of Lansing of territory adjoining said Town in the Village of Lansing, was received and reviewed by the Town Board, Tracy Tobey appeared before the board in regard to the clean up of fly ash on his property and what Bob Murphy reported concerning same. Supervisor McDermott stated that a report had just been received from Mr. Murphy noting that no additional progress had been made due to weather conditions, however, Mr. McDermott read a letter he was forwarding to Mr. Murphy insisting that work commence immediately and the fly ash removal completed before spring thaw or the Town Board would be asked for a resolution revoking his existing permit. Councilman Lee Naegely recommended that the Town not join the TV Cable Franchise Task Force Commission at this time. Supervisor McDermott announced that the Town Board had been requested to meet with the Home for Aging Committee on February 15th at 8:00 P.M. at the Town Hall. Fred Croft and Rhaeto Pfister appeared before the board and asked the board to consider Boy Scout Troop #48 to operate the Lansing Park Concession Stand for the 1977 season. Councilman Edward LaVigne was appointed to search for a Member to the Tompkins County Environmental Council to represent the Town of Lansing. (continued) Continued February 8, 1D77 RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. LaVigne: RESOLVED, that the Resolution adopted at the meeting of January 11, 1977 appointing Jerilea D. Burke as a Member of the Lansing Planning Board for a five year term be amended to read, "that Jerilea D. Burke be appointed as a Member of the Lansing Planning Board for a seven year term beginning Jan- uary 1, 1977.11 Carried Attorney Robert Williamson and the Members of the Town Board discussed in detail a Resolution providing for the consolidation and sale into one issue of serial bonds of the Town of Lansing, aggregating $1,155,000 heretofore separately authorized by said town for various town purposes. Following discussion, the. RESOLUTION PROVIDING FOR THE CONSOLIDATION AND SALE INTO ONE ISSUE OF SERIAL BONDS OF THE TOWN OF LANSING, TOMPKINS COUNTY, NEW YORK, AGGREGATING $1,155,000 HERETOFORE SEPARATELY AUTHORIZED BY SAID TOWN FOR VARIOUS TOWN PURPOSES was offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Naegely. Said Resolution attached hereto and made a part thereof. RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that the Maturity Schedule, dated February 1, 1977, for the serial bond sale, which includes three Sewer District . #2, three Water District #1 and one Water District #2 bond anticipation notes, be and is hereby adopted.
