HomeMy WebLinkAbout1976-11-04November 4, 1976 The Lansing Town Board met in an Adjourned Meeting on November 4, 19766 to conduct Public Hearing's on the Preliminary Budget and Special District Tax Rolls for the year 1977, and to act on any other business that may come before said board. Said meeting held at the Lansing Town Hall at 8:00 P.M., with Supervisor Wesley McDermott presiding. The Supervisor called the meeting to order having the clerk take the roll call. Proof of Notice having been furnished, the Supervisor advised the Board that the Public Hearing was now open on the Preliminary Budget for the year 1977, as called by the Town Board and so advertised in the Ithaca Journal and posted accord. ing to Town Law 108. Members of the board reviewed the Preliminary Budget as compiled. All persons desiring to be heard, having been heard, and no objections made to the said Preliminary Budget, the Hearing was terminated at 8:20 P.M. RESOLUTION offered by Mr. Hilliard, who moved its adoption, seconded by Mr. LaVigne: RESOLVED, that upon recommendation of the Ordinance Officer, Norman Stanton, that the renewal date for Temporary Mobile Home Park Permits for the following owners be extended to November 12, 1976: Eric Lyon, David Thompson, Donald Worsell, Gordon Cook, Marshall Volbrecht; Richard Sharp be extended to December 6, 1976 and Edward Shettel be extended to January 7, 1977. Carried Proof of Notice having been furnished by the Clerk, the Public Hearing on the Special Districts, Lansing Water District #1, Lansing Water District #2 and Lansing Sewer District #2 was called to order by Supervisor McDermott at 8 :30 P.M, as advertised in the Ithaca Journal and posted according to law. The Assessment Rolls for the year 1977 were offered for inspection and discussion. All persons desiring to be heard, having been heard, and no objections made to said rolls, the Hearing on the Special Districts was terminated at 8:55 P.M. RESOLUTION ADOPTING GENERAL FUND BUDGET offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Hilliard: WHEREAS, this Town Board has met at the time and place specified in the notice of Public Hearing on the General Fund Preliminary Budget and heard all persons desiring to be heard thereon; now therefore be it RESOLVED, that this Town Board does hereby adopt such General Fund Preliminary Budget as originally compiled, as the annual budget of this Town for the fiscal year beginning on the lst day of January 1977, and that such budget as so adopted be entered in detail in the minutes of the proceedings of this Town Board, and be it FURTHER RESOLVED, that the Town Clerk of this Town shall prepare and certify in duplicate, copies of said annual budget as adopted by this Town Board, together with the estimates, if any, adopted pursuant to Section 202 -a, subd. 2, of the Town Law and deliver one copy thereof to the Supervisor of this Town to be presented ® by him to the Board of Representatives of this County. For example, if ten apartment units or trailer units are fed by a single meter, the total meter charge shall be computed as follows. divide the total meter reading by ten, equals the gallons of water per equivalent unit. The water charge per equivalent unit is computed by multiplying the number of gallons per equivalent unit by water rate schedule. (Aye) Louis Bush, Councilman Bert Hilliard, Councilman Edward LaVigne, Councilman Lee Naegely, Councilman Wesley McDermott, Supervisor Carried RESOLUTION offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Naegely: WHEREAS, the Tompkins County Division of Assessment filed an Assessment Roll for the Town of Lansing Water District #2 on and before September 15, 1976, and WHEREAS, after proper notice a Public Hearing was held on November 4, 19765 and all persons desiring to be heard, having been heard and no one appearing object- ing to said Water District #2 Assessment Roll, now therefore be it RESOLVED, that the Assessment Roll as prepared be filed for Lansing Water District #2 and the same is hereby approved, affirmed and adopted pursuant to Section 239 of the Town Law for the year 1977, and be it further RESOLVED, that the formula used for the basis of extending the Assessment Roll for Lansing Water District #2 for the year 1977 be: Assessed�Valuation Charge: $1.93 per thousand land and buildings. A RESOLUTION DELEGATING TO THE SUPERVISOR OF THE TOWN OF ITHACA.) TOMPKINS COUNTY, NEW YORK, ACTING ON BEHALF OF THE TOWNS OF ITHACA, DRYDEN AND LANSING AND THE VILLAGE OF CAYUGA HEIGHTS, ALL IN TOMPKINS COUNTY, NEW YORK, THE POWER TO PROVIDE FOR THE DETAILS AND AUTHORIZE THE SALE OF $7,000,000 JOINT SERIAL BONDS OF SAID TOWNS AND VILLAGE. WHEREAS, the Town of Ithaca, the Town of Dryden, the'Town of Lansing and the Village of Cayuga Heights, Tompkins County, New York have heretofore had and taken proceedings authorizing the joint construction of a comprehensive water improvement consisting of an intake plant at Bolton Point on Lake Cayuga in the Town of Lansing, a water treatment plant and raw water pump station, force mains, plant and pumping station roads and a transmission main to the Village of Cayuga Heights for an intermunicipal water supply facility for the joint use and operation by the Town of Dryden on behalf of Water District No. 1 in said Town, by the Town of Ithaca on behalf of the Town -Wide Water Supply Benefited Area in said Town, by the Town of Lansing on behalf of Water District No. 1 and the McKinney Water District in said Town and by the V illage of Cayuga Heights for said Village, and have jointly adopted a joint bond resolution authorizing the issuance of $4,150,000 joint serial bonds of said Towns and said Village to pay the cost of such intermunicipal water supply facility; and WHEREAS, by subsequent proceedings had and taken by the aforesaid Towns ® and Village, a further joint bond resolution was adopted authorizing the issuance of an additional $1,920,000 joint serial bonds of said Towns and said Village to pay additional costs of such intermunicipal water supply facility; and WHEREAS, said Towns and Village, pursuant to further proceedings of a similar nature, authorized the joint construction of a comprehensive water improvement consisting of transmission mains, a two million gallon storage reservoir and booster station for an intermunicipal water distribution facility for the joint use and operation by the Town of Dryden on behalf of Water District No. 1 in said Town, by the Town of Ithaca on behalf of the Town -Wide Water Distribution Benefited Area in said Town, by the Town of Lansing on behalf of the McKinney Water District in said Town, and by the Village of Cayuga Heights for said Village, and jointly adopted a joint bond resolution authorizing the issuance of $1,930,000 joint serial bonds of said Towns and said Village to pay the cost of such intermunicipal water distribution facility; and WHEREAS, pursuant to the aforesaid bond resolutions, the said four municipalities delegated to the Supervisor of the Town of Ithaca, the chief fiscal officer of said Town, the power to authorize the issuance of and to sell joint bond anticipation notes in antipation of the issuance and sale of joint serial bonds therein author- ized, including renewals thereof, and Continued November 4, 1976 WHEREAS, bond anticipation notes having from time to time been authorized and issued in accordance with such delegation for purposes of financing costs of con- struction of the aforesaid intermunicipal water supply facility and intermunicipal water distribution facility and it is now desired to fund a portion of the balance of such notes now outstanding by the issuance of joint serial bonds and to delegate to the Supervisor of the Town of Ithaca the power to provide for the details and authorize the sale of such bonds; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Lansing, Tompkins County, New York, if the within resolution in identical form is adopted, approved and made effective by the Town of Ithaca, the Town of Dryden and the Village of Cayuga Heights as follows: Section 1. Consistent with the Agreement of Municipal Cooperation for Construc- tion, Financing and Operation of an Intermunicipal Water. Supply and Transmission System heretofore entered into by and among the Town of Ithaca, the Town of Dryden, the Town of Lansing and the Village of Cayuga Heights, all matters relating to the issuance of bonds pursuant to the bond resolutions described in the preambles hereof, except as otherwise provided herein, relating to such bonds, including the date, denominations, maturities and interest payment dates within the limitations pres- cribed herein shall be determined by the Supervisor of the Town of Ithaca, the chief fiscal officer of said Town, acting on behalf of the four municipalities described above. Such bonds shall contain substantially the recital of validity clause provided in Section 52.00 of the Local Finance Law and shall otherwise be in such form and contain such recitals in addition to those required by Section 51.00 of the Local Finance Law as the said Supervisor of the Town of Ithaca shall determine. Section 2. The bonds authorized by this resolution shall mature in annual in- stallments in the manner provided by law and shall bear interest at such rate as may be anecessary to sell the same, provided, however, that such rate of interest shall not exceed any maximum legal rate in effect as of the date such bonds are sold, such interest to be paid semi- annually. Such bonds shall be in bearer coupon form with the privilege of conversion into bonds registered as to both principal and interest. Such bonds shall be signed in the name of the Town of Ithaca by its Supervisor, in the name of the Town of Dryden by its Supervisor, in the name of the Town of Lansing by its Supervisor and in the name of the Village of Cayuga Heights by its Treasurer and a facsimile of the seals of each of said Towns and of said Village shall be imprinted thereon and the interest coupons shall bear the facsimile signatures of the aforesaid Supervisors and the aforesaid Village Treasurer. Section 3. This resolution shall take effect upon the adoption by the Town Boards of the aforesaid Towns and the Board of Trustees of the aforesaid Village and may be adopted by each of said bodies in multiple counterparts.
