The right to reject all bids is exp r Highway Superii Town of 13.1976 : August 10,1976 The Lansing Town Board met in Regular Session at the Lansing Town Hall on August 10, 1,076 at 8:00 P.M. with Supervisor Wesley McDermott presiding. Present Town Attorney Present Clerk Present one I Visitors: Frank Nagy, Mr. & Mrs. Harry Banfield, Zoning Officer Norman Stanton, and Barry Ford. The Supervisor called the meeting to order having the clerk take the Roll Call. Proof of Notice having been furnished, the Public Hearing on the Proposed Ordinance setting forth Rules and Regulations for the Town Parks in the Town of Lansing, was called to order at 8:00 P.M. by Supervisor McDermott. The proposed rules and regulations were read by the Supervisor. Members of the board and persons present discussed same as presented. All persons desiring to be heard, having been heard, and no objections being made to said proposed ordinance, the hearing was terminated at 8:45 P.M. The town board discussed the hearing just held and the following resolution was offered: RESOLUTION offered by Mr. Hilliard, who moved its adoption, seconded by Mr. Bush: WHEREAS, a Public Hearing was duly held after notice as required by law on a Proposed Ordinance setting forth Rules and Regulations for the Town Parks in the Town of Lansing on the 10th day of August 1976, at the Town Hall in the Town of Lansing, and WHEREAS, full discussion was had by all persons present concerning proposed Ordinance, now therefore be it RESOLVED, that said proposed Ordinance setting forth rules and regulations for the Town Parks in the Town of Lansing is hereby adopted and the Town Clerk is required to publish and post said Ordinance as required by law, and be it further RESOLVED, that the Clerk is directed to send certified copies of said Ordinance to the Tompkins Louis Bush, Councilman County of Sheriff and the State Police. (Aye) Wesley McDermott, Supervisor (continued) 6 Continued August 10, 1976 TOWN OF LANSING ORDINANCE No. 22 ORDINANCE of the Town of Lansing, County of Tompkins, State of New York, setting forth RULES AND REGULATIONS FOR THE TOWN PARKS in the Town of Lansing. The Town Board of the Town of Lansing, by virtue of the authority vested in it by law, does hereby ordain and enact as follows. 1. All public parks in the Town of Lansing (town park at Myers, Ludlowville, and Lansing recreation field) shall be closed to the public between 10:00 p.m. and 4:00 a.m. daily. The only exceptions shall be for specifically permitted users such as campers and users of boat slips under current assignment. 2. No person shall ride, drive or cause to be propelled any vehicle in the town parks at a speed greater than ten (10) miles per hour, nor be driven or parked on or over any path, lawn, flower bed or other improvement. 3. No littering or abandonment of trash shall be permitted anywhere on the grounds of the town parks other than the placement of trash in designated receptacles. 44 No dog shall be permitted in the parks unless held on a leash. 5. Violations and Penalties: Any person, firm, corporation or other, violat- ing any provision of this ordinance shall be deemed guilty of an offense and upon conviction thereof shall be subject to a fine of not exceeding $25.00, or to imprisonment for not exceeding fifteen days, or to both such fine and imprisonment for each and every violation. This ordinance shall be in force and effect upon publication and posting as required by law. Letter received from Charles L. Smith regarding his property located at McKinney's Point, which is located between two small creeks. Mr. Smith stated that on July 13, 1976, the south creek exceeded its banks which caused consid- erable damage, concluding that recent development on the stream up hill had caused the creek to receive more water than it could handle: Mr. Smith is of the firm opinion that, before the rains of next spring come, something should be done upstream in this creek, (such as a holding pond or a dam, etc.) to restrain the rapid run -off that has been caused recently. Discussion was held by the board and the clerk was instructed to send a copy of Mr. Smith's letter to the Village of Lansing and Gary W. Craig, Manager of the Pyramid Mall Project. Received from the N.Y.S. Electric & Gas Corp., an application for a license to operate a junk yard for use as a fly ash deposit site, located on the west side of Davis Road. The Members of the - -Board and Zoning Officer, Norman Stanton discussed said application. Following resolution offered: RESOLUTION offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Naegely: RESOLVED, that the Town Board of the Town of Lansing will hold a Public Hearing on the junk yard application of the N.Y.S. Electric & Gas Corp., at 7:30 P.M. on the 14th day of September 1976. Carried The Supervisor announced that the Tompkins County Municipal Officials' Association quarterly meeting would be held at the Sheraton Inn on Sept. 15th at 7:00 P.M. Supervisor McDermott stated that he would invite Frank Liguori, Tompkins County Commissioner of Planning,.to meet with the Town Board concern- ing "Selective Comminity Development % (continued) r. u 0 x i We, the undersigned members of the T own B oard of the T own of Lansing, hereby waive notice of a Special Meeting to be held on the 31st day of August 1976 at 5:00 P.M. for the purpose of discussing the maintenance, operation and salary in regard to Lansing Water District #2. v Continued August 10, 1976 The town board discussed the S outhern Cayuga Lake Intermunicipal Water Commission budget for the coming year in regard to operation, maintenance and debt service. The proposed amended water rate schedule was also reviewed by the boards Discussion held by the board, following resolution offered: RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. Bush: RESOLVED, that the Town Board of the Town of Lansing will hold a Public Hearing on a proposed amended water rate schedule and amendment to the Southern Cayuga Lake Intermunicipal Water Commission Contract containing said rates. (Aye) Wesley McDermott, Supervisor. Highway Superintendent Sharpsteen discussed the bids that were received on August 3, 1976 for one 1976 Spreader Box.. Following resolution offered: RESOLUTION offered by Mr. Bush, who moved its adoption, seconded by Mr. Hilliard: WHEREAS, the Highway Superintendent has duly advertised for bids for one new Spreader Box and WHEREAS, D.W. Clark Road Equipment, Inc., of Syracuse, New York was the lowest responsible bidder for one new model t'E't 13 ft. Hi -Way spreader equipped as specified, for a total cost of $4,564.00, now therefore be it RESOLVED, that the aforesaid bid be and hereby accepted and the Town Highway Superintendent is authorized to complete the transaction on behalf of the Town. Carried RESOLUTION offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Bush: RESOLVED, that the Highway Superintendent be authorized to attend the State of New York Highway Superintendent's Convention to be held at Grossinger's on September 21, 229 23, 241, 1976, and that necessary expenses be a town charge. Carried Plans for the Lansing Bicentennial were discussed by the boards RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. LaVigne: RESOLVED, that Alex Cima, Jr. be reappointed to serve as a Member of the Lansing Zoning Board of Appeals for a five year term, said term retroactive to June 15, 1976, to abide by Section 267 of the Town Law. Carried The Supervisor presented his monthly report. RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. LaVigne: RESOLVED, that General Fund bills #270 through #312 totalling $13,401.98 and Highway Fund bills #170 through #19311,totalling $22,170.10 be and the same are hereby approved for payment, and be -it further RESOLVED, that Water District #2 bills be and the same are hereby approved for payment.
