The Supervisor called the meeting to order at 7:30 P.M. having the clerk take the Roll Call. Proof of Notice having been furnished, the Public Hearing on Proposed Amend- ments to the Mobile Home Park Ordinance of the Town of Lansing was called to order by Supervisor McDermott. Each proposed amendment was reviewed and considered carefully by the board and persons present. All persons desiring to be heard, having been heard, the hearing was termin- ated at 9:05 P.M. Please take notice that the Town Board of the Town of Lansing will hold a Public Hearing on amendments to the Mobile Home Park Ordinance at the Town Hall In the Town o6 Lansing on the 8th day of June, 1976 at 7:90 P.M. Said amendments - relate toahe issuance of Temporary permit0for established Mobile Home - Parks; applica- tions for license of new Mobile Home Parks and additions to existing parks; hearings; environmental requirements; water supply systems; sewage disposal systems; electrical distribution systems and planned development-area. A detailed copy of sal. amendments may be obtained at the office" of the Town Clerk in the Town of Lansing. May 26; 1976 On Motion, meeting adjourned to June 10, 1976 at 8:00 P.M. June 10, 1976 The Lansing Town Board met in an Adjourned Meeting at 8:00 P.M. as called at the Regular Meeting of June 8, 1976. Said meeting to consider and act on any and all business that may come before said board. James Howell and four The Supervisor called the meeting to order at 8:.00 P.M. having the clerk take the Roll Call. Letter received from the Town of Caroline inviting the Town Board and Lansing residents to the Town of Caroline's Bicentennial activities to be held July 3rd. Letter received from Jean L. Dueland, 18 Sky Acres Drive, Ithaca, requesting a refund of the $150.00 paid for dock rental for the 1976 season. RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. McDermott: RESOLVED, that the dock rental for the 1976 season in the amount of $150.00 be refunded to Jean L. Dueland,. as requested. Carried Norman D. Stanton, Ordinance Officer, submitted his monthly report which was read and reviewed by the board. Received and read copy of letter written by Walter J. Schwan, Ithaca T own Supervisor to John Murphy, County Administrator. Letter concerned return of sales tax monies due towns and villages in Tompkins County which was erroneously paid to the City of Ithaca. Letter received from L.J. Long, Secretary of the Tompkins County Industrial Development Agency. Said letter requesting $11,781.34 from Lansing Sewer Dist. #2 for the purchase of the Warren Road Sewer Extension. Discussion, no action taken. Letter of resignation received from Alvin C. Parker, Lansing Assistant Water Superintendent, effective June 1, 1976. Board accepted resignation and requested the clerk to acknowledge Mr. Parker's letter and express the board's appreciation for his services performed for the town. ,continued )_ E • 1 is v Continued June 10, 1976 RESOLUTION offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that the Town Board of the Town of Lansing willN)hold a Public Hearing on the junk yard application of Albert R. Ferris at 8:00 P.M. on the 13th day of July 1976. Carried The board discussed the County Sewer District versus an Intermunicipal Sewer System. It was the consensus of the board that the County Sewer District should remain as formed rather than convert to an Intermunicipal System. RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. Hilliard: WHEREAS, it is imperative that the Southern Cayuga Lake Intermunicipal Water Commission purchase water meters as soon as possible for installation on the area covered by the Intermunicipal Water Project, it being understood that sufficient funds are available for the purchase of said water meters, it is hereby RESOLVED as follows: Section 1, that the Town of Lansing authorizes the Southern Cayuga take Intermunicipal Water Commission to purchase water meters, new or used, at a cost now being negotiated by the Commission and the Commission is hereby authorized to use funds available to the Commission for such purpose. Section 2, This resolution is contingent upon the other participating municipal - ities'adopting a similar resolution. Vote of Town Board . . . . (Aye) Wesley McDermott, Supervisor Carried The board discussed purchasing a 1976 Bennington Flag for use at the Town Hall. Following resolution offered. RESOLUTION offered by Mr. LaVigne, who moved its adoption, seconded by Mr. McDermott: RESOLVED, that the Town purchase one 5X8 1976 Bennington Flag from Hovanec Signs in the amount of $46.00. Carried r��ah Councilman Edward LaVigne discussed Plumbing Code being proposed by Southern Cayuga Lake Intermunicipal Water Commission in order to obtain uniformity through- out the district. RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. LaVigne: WHEREAS, the Town Clerk has duly advertised for bids for the purchase of one new voting machine, and WHEREAS, the Automatic Voting Machine Division, Jamestown, N.Y. was the only bidder with a bid of $2,150.00, now therefore be it RESOLVED, that said bid of the Automatic Voting Machine Division be and the same is hereby accepted. Carried The board discussed the operation of the concession stand at the Lansing Park in regard to a three year operation contract. It was the consensus of the board that the contract should include a cancellation clause whereby either party-may exercise the right to use said clause at the end of each season during the three year contract period. The board discussed the subject of membership in the Tompkins County Municipal Officials Association and reviewed the Constitution and By -Laws of the Association. Following resolution offered: RESOLUTION offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that the Town of Lansing become a member of the Tompkins County Municipal Officials' Association, and, the clerk is directed to notify said Association of membership and submit the annual membership fee of $25.00 and $5.00 admission fee to the Treasurer of the Association. Carried Discussion held on the continued operation of Lansing Water Dist. #2. The Supervisor presented his monthly report. (continued) 7.� continued June 10, 1976 RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. LaVigne: RESOLVED, that General Fund bills #173 through #213 totalling $22,986.11 and Highway Fund bills #122 through #142 totalling $389493.71 be and the same are hereby approved for payment, and be it further RESOLVED, that Water District #2 bills be and the same are hereby approved for payment. Carried RESOLUTION offered by Mr. Hilliard, who moved its adoption, seconded by Mr. Naegely: WHEREAS, a Public Hearing was duly held after notice as required by law on proposed amendments to the Mobile Home Park Ordinance on the 8th day of June 1976, at the Town Hall in the Town of Lansing, and WHEREAS, full discussion was had by all persons present concerning proposed amendments, now therefore be it RESOLVED, that said amendments are hereby adopted and the Town Clerk is required to publish and post said amendments to the Mobile Home Park Ordinance as required by law. Wesley McDermott, Supervisor (Aye) TOWN OF LANSING ORDINANCE NO. 21 ORDINANCE OF THE TOWN OF LANSING, COUNTY OF TOMPKINS, STATE OF NEW YORK, amending the "Mobile Home Park Ordinance," adopted by the Town Board of the Town of Lansing on the 4th day of April 1972 amended June 11, 1974, is hereby amended to read as follows. ARTICLE 1 TITLE - no change ARTICLE 2 PURPOSE - no�'change ARTICLE 3 DEFINITIONS Dwelling - no change Mobile Home - no change Mobile Home Lot - no change Mobile Home Lot Width - no change Mobile Home Park - a parcel or adjoining parcels of land owned by the same party which is designed and improved for the placement of 3 or more mobile homes for nontransient use. Mobile Home Stand - no change Permanent Residence - no change Stand Area =- no change ARTICLE 4 LICENSE AND TEMPORARY PERMITS 4.1 - no change 4.2 - no change 4.3 - Established Mobile Home Parks, as determined by the Ordinance Officer, shall be issued, on the - effective date of the adoption of this Amendment a sixty (60) day temporary permit by the Town Clerk. The permit may be renewed once by action of the Town Board. Before the expiration of the sixty (60) days permit, upon presentation of the Fire Underwriters Inspection Certificate of electrical compliance, and the Board of Health Certification for sewage disposal and water supply by the park owners or manager, the Town Ordinance Officer will issue a one year temporary mobile home park license to the park owner. This temporary license may be extended ninety (90) days by action of the. Lansing Town Board. Forthwith upon issuance of the temporary license the Ordinance Officer shall inspect the park and report his findings on the compliance of the park to this Ordinance, to the park owner or manager and the Town of Lansing Planning Board. In the event that the park owner or manager feels that they are unable to correct deficiencies to bring their park into compliance with the Ordinance they will confer with the Planning Board concerning the areas of non - compliance. The Lansing Planning Board will make recommendations as to what is necessary to meet the intent of the Ordinance to the park owner or manager and furnish said information to the Town Board. The Ordinance Officer shall review with the park owner or manager the recommendations of the Planning Board and report the findings and recommendations to the Town Board. The Ordinance Officer shall furnish his report to the Town Board prior to the expiration of the temporary mobile home park license. The Town Board shall then determine based on the report and recommendations of the Planning Board and the Ordinance Officer whether or not a permanent license shall be issued to the park by the Ordinance Officer. (continued) a • ft Continued June 10, 1976 ARTICLE 5 APPLICATION FOR LICENSE OF NEW MOBILE HOME PARK OR ADDITIONS TO EXISTING MOBILE HOME PARKS AND LICENSE RENEWAL FOR ALL PARKS 5.1 - no change 5.2 - The application and all accompanying plans and specifications shall be filed in duplicate with the Ordinance Officer. The officer shall review the application and the proposed plans and specifications and shall forward a copy to the Planning Board and Town Board. The Planning Board shall review said proposed plans and give its recommendations with special emphasis as to compliance with the objectives of the general plan. Within forty -five (45) days from the time of submission to the Planning Board, the Board shall hold a public hearing on the proposed park. Following the public hearing the Planning Board shall give its recommendations to the Town Board within thirty (30) days from the date of the hearing. If the existing or proposed mobile home park is then altered or constructed in accordance with such plans and specifications as approved by the Town Board are in compliance with all of the provisions of the Ordinance, and all other applicable Ordinances, and Statutes, the Town Board shall approve the issuance of temporary permit by the Town Clerk. Upon completion of the park according to the plans, the Lansing Town Board shall approve the application and direct the Town Clerk to issue the license. 5.3 - Application for renewal of license. Upon application in writing for renewal of a license the Ordinance Officer shall direct the Lansing Town Clerk to issue the license for another year, provided that the park is in compliance with the provisions of this Ordinance. 5.4 - no change ARTICLE 6 - no change ARTICLE 7 - NOTICES, HEARINGS AND ORDERS 7.1 - no change 7.2 - Any person affected by any notice which has been issued in connection with the enforcement of this Ordinance may request and shall be granted a hearing before the Town of Lansing Board of Appeals, established by the Land Use Control Ordinance. 7.3 - no change ARTICLE 8 - ENVIRONPdENTAL REQUIREMENTS 8.1 & 8.2 - no change 8.3 - Soil and Ground Cover Requirements. Each lot shall be suitably landscaped to meet the needs of the community and environment. 8.4 - 8.12 = no change 8.13 - Mobile Home Stands 8.13.1 - no change 8.13.2 - no change 8.13.3 - The mobile home stand shall be provided with anchors and tie downs when the existing mobile home is removed from the stand and on the request from the mobile home owner, provided the mobile home is equipped with tie down points. If there are no tie down points on the mobile home then mobile homes need not be tied down. In all cases of new construction of mobile home stands, they shall be provided with anchors and tie downs. Tie downs can take the form of cast in place, screw, augers or other. ARTICLE 9 WATER SUPPLY SYSTEM 9.1 - General Requirements. All water supply systems shall be installed as per plans approved by the Tompkins County Health Departments, Lansing Town Board or the Lansing Water Superintendent, if on a municipal water supply. Omit all other present provisions of 9.1. 9.2 - omit 9.3 - 9.4 - no change ARTICLE 10 SEWAGE DISPOSAL AND DISCHARGE 10.1 - Where a public sewage system is available connection shall be made thereto. Where a public sewage system is not available a private system shall be provided and installed with the approval of Tompkins County Health Department and with the approval of the Lansing Water Superintendent if the park is located on a municipal water supply system. The purpose of this Article is to introduce a flexibility in conventional land use and design regulations by employing performance criteria established to encourage development in an imaginative and innovative manner while, through the process of review, discussion, insuring efficient investment in public improvements, a more suitable environment and protection of community interest. This section recognizes that a rigid set of space requirements along with bulk and use specifications would frustrate the application of the Planned Development concept. Therefore, where this concept is deemed appropriate by the Town Board, the set of conventional land use activities and area specifications set forth elsewhere in this ordinance are hereby replaced by an approval process in which the Planning Board may consider innovative approaches to plans on parks of over 15 mobile home stands. Jane Bush Horky, Town Clerk i Town of Lansing' 0 I 1 1 y 1 We, the undersigned members of the Town Board of the Town of Lansing, hereby waive notice of a Special Meeting to be held on the 26th day of June 1976 at 10:00 A.M. for the purpose of setting a Public Hearing date on proposed changes to the Land Subdivision Regulations for the Town of Lansing. Said Public Hearing to be held jointly by the Lansing Town Board and the Lansing Planning Board. RESOLUTION offered by Mr. Dermott, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that the Town Board of the Town of Lansing and the Lansing Planning Board will hold a Public Hearing on July 12, 1976 at 8:00 P.M. at the Lansing Town Hall to consider proposed changes to the Land Subdivision Regulations for the Town of Lansing. Said changes will simplify procedures for Minor Subdivisions, will change exemption for Subdivision approval from present five acres to three acres, and will remove the requirement for land or money for parks or recreation.
