Z�t V June 10, 1975 The Lansing Town Board met in Regular Session at the Lansing Town Hall on June 10, 1975 at 8 P.M. with Supervisor McDermott presiding. James Howell, Zoning officer Norman Stant6n, Planning Board Chairman Viola Miller and fifteen visitors. Supervisor McDermott opened the meeting having the clerk take the Roll Call. Proof of Notice having been furnished, the Public Hearing on the Proposed Amendment to the Land Use Ordinance - Flood Plain, was called to order by Supervisor McDermott. Planning Board Member, William Bement, reviewed the proposed amendment in general. Bradley Griffin, Regional Supervisor for the Department of Environmental Conservation, reviewed the importance of the town adopting said proposed ordinance versus the State Legislature imposing state rules and regulations, pursuant to the Federal Flood Insurance Program. No one appeared voicing any objection the the proposed Amendment to the Land Use Ordinance - Flood Plain, and all persons desiring to be heard, having been heard, the Public Hearing was terminated at 8:30 P.M. The Town Board reviewed the Public Hearing just held on the proposed Amendment to the Land Use Ordinance - Flood Plain, and the following resolution was offered: RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. Hilliard: WHEREAS, the Town Board of the Town of Lansing duly advertised a Public Hearing to be held on a proposed Amendment to the Land Use Ordinance - Flood Plain, to be held June 10, 1975 at 8:00 P.M. in the evening thereof, and WHEREAS, the Planning Board of the Town of Lansing recommended the adoption of said proposed amendment, now therefore be it RESOLVED, that an Ordinance of the Town of Lansing providing for the e Amendment to the Land Use Control Ordinance, adopted by this Town Board on the 4th day of June 1973, is hereby amended to read as follows: TOWN OF LANSING ORDINANCE N0. 17 AMENDMENT TO LAND USE ORDINANCE - FLOOD PLAIN ARTICLE 1 - PURPOSE Section 1. The purpose of this amendment to the land use ordinance is to establish land use and control measures that will improve and preserve the ability and capacity of the flood plain to withstand the effect of flooding with the least threat to the health, safety and welfare of the inhabitants of the Town of Lansing. These measures shall be consistent with federal criteria in order to assist the town to become eligible for flood insurance under the National Flood Insurance Act of 1968 (42 USC 4001 -4127, 82 STAT. 572). (continued) Continued June 10, 1975 2 ARTICLE II - Definitions Section 1. Flood or flooding means a general and temporary condition of partial or complete inundation of normally dry land areas from the overflow of streams or rivers, or abnormally rising lake waters resulting from severe storms. Section 2. Flood plain or flood prone areas means a land area adjoining a river, stream,watercourse, bay or lake, which is likely to be flooded. Section 3. Flood hazard area means that maximum area of the flood plain that on the average, is likely to be flooded once every hundred years. Section 4. Flood-plain management means the operation of an overall program of corrective and preventive measures for reducing flood damage, including but not limited to emergency preparedness plans, flood control works, and land use and control measures. Section 5. Flood proofing means any combination of structural and nonstructural additions, changes, or adjustments to properties and structures which reduce or ® eliminate flood damage to land, water and sanitary facilities, structures, and contents of buildings. Section 6. Floodway means the channel of a river or other watercourse and the adjacent land areas required to carry and discharge the 100 year flood. Section 7. 100 -year flood means the highest level of flood that, on the average, is likely to occur once every 100 years. Section 8. Flood protection elevation means the 100 year - -flood elevation. ARTICLE III - USE ZONES Section 1. Floodway Zone - FW -10 Section 2. Purpose. It is hereby found and declared that the unmanaged use, alteration of topography, excessive filling channel encroacinnent or other acts affect the natural discharge of water through flood plains and constitute a threat to the health, safety and welfare of the inhabitants of the Town of Lansing. The purpose of the Floodway Zone is to protect the health, safety, and welfare of the inhabitants of the town from hazards due to periodic flooding. Section 3. Delineation of the Floodway Zone - FW -1. There is hereby established a.FW -1 Zone to accomplish the purposes of this Section. The boundaries of the Flood- way Zone are delineated specifically on the map which is hereby incorporated in this amendment. The delineation of the Zone is based upon an area comprising.the channel of a river or other watercourse and the adjacent land areas required to carry and discharge the 100 -year flood. Section 4. Permitted Uses. The following uses are permitted as of right in the FW -1 Zone: a) General farming. b) Animal husbandry. c) Sale of agricultural products grown and raised on the premises. d) Open recreation areas. e) Wildlife and game preserves. f) Off Street parking areas. g) Lawns and gardens. Section 5. Prohibited Uses: No new structures or improvements to existent structures will be permitted within the floodway zone unless authorized by special use permit authorized in accordance with Article V of this ordinance. Section 6. Special Provisions. a) No structure within the floodway zone shall be used for human habitation. b) No structure either temporary or permanent,-fill for any purpose, deposit, obstruction, or any other use shall be permitted which will reduce the capacity of the Floodway and increase the flood heights, increase the volocity or obstruct, catch or collect debris which will obstruct flow under flood conditions. Section 7. Flood Hazard Zone Section 7. Purpose. The purpose of the Flood Hazard Zone is to protect the health, safety and welfare of the inhabitants of the Town of Lansing from hazards due to periodic but infrequent flooding. Section 8. Delineation of the Flood Hazard Zone - FH -1. There is hereby established a FH -1 Zone to accomplish the purposes of this section. The boundaries of this zone are delineated specifically on the map made a part of and incorporated in this ordinance. The delineation of the Flood Hazard Zone is based upon the land areas that are subject to inundation by the 100 -year floods and are not included in the areas designated as floodway zones. kcontinued) 8 Continued June 10, 1975 Section 9. Special Provisions Applying to Flood Hazard Zones. Any use permitted within the town shall if located within the FH- 1.Zone meet the following requirements. a) All new construction, additions to existing structures and any alterations involving plumbing, heating and electrical work shall be permitted when.authorized by a special use permit issued in accordance with Article V of this ordinance. b) New structures shall: 1. Have a low flood damage potential. 2. Be designed and constructed to resist rupture or collapse caused by water pressure or debris. 3. Be placed on the building site so as to offer a minimum obstruction to a flow of flood water. 4. Be firmly anchored to prevent flotation of lateral movement openings or other narrowing of the flood way. c) New residential structures shall have the lowest habitable floor elevated to at least one foot above the 100 -year flood level. d) Service facilities such as electrical and heating equipment shall be constructed above the flood protection elevation for the particular area. e) New or replacement water supply systems shall be designed to prevent infiltration of flood waters into the system. f) New or replacement on -site waste disposal systems shall be approved and constructed in accordance with the regulations of the Tompkins County Health Department. g) Any storage facility for chemicals, explosives or flammable liquids shall be located at an elevation at least one foot above the 100 -year flood level. h) Building permit - No building shall be erected, moved, structurally altered or enlarged, no excavation for any building shall be done within the floodway zone or flood hazard zone of the Town of Lansing without a building permit issued in accordance with Section 1701 of the Land Use Ordinance. ARTICLE IV - SPECIAL USE PERMITS Section 1. The purpose of special use permits approval is to allow the proper integration into the community of uses which may be suitable only on certain con- ditions and at appropriate locations. Because of their unusual characteristics, or the special characteristics of the area in which they are to be located, special uses require special consideration so that they may be properly located with respect to the objectives of this amendment. Section 2. Authorization to Grant or Deny Special Uses Special uses may be permitted, enlarged, or otherwise altered upon authorization of the Town Board in accordance with the standards and procedures set forth in this Article and such additional standards as may be set forth for special uses elsewhere in.this ordinance. In permitting a special use for the modification of a special use the Town Board may impose, in addition to those standards and requirements expressly specified by this ordinance, and the additional conditions which the board considers necessary to protect the best interest of the surrounding property, neighborhood or town as a whole. Conditions which the Town Board may place upon special use permit may include controlling location and number of vehicle access points, limiting the number, size and location of signs, the construction of diking, fencing, screening, landscaping or other facilities to protect adjacent or nearby property. In the case of use existing prior to the effective date of this ordinance any change in use or in lot area or in alteration of structure shall conform with the requirements dealing with this ordinance. Section 3. Application for Special Use Permits An applicant for a special use-permit shall initiate a request for a special use or the modification of a special use by filing a written application with the Town Clerk The applicant shall furnish such information as is deemed necessary by the Town Board to determine the suitability of the particular site for the proposed use, including. a) Diagrams showing property boundaries. b) Plans showing dimensions and elevations of existing and proposed structures, flood proofing measures in relationship to the flaodway and the flood protection elevation. c) Specifications for building construction and materials including also the filling, dredging, grading, channel improvement, water supply and sanitary facilities. d) Any other drawings, data or information necessary for the understanding of the proposed use and continued) Continued June 10, 1975 e) Filing fee of $5.00 payable to the Town of Lansing. ARTICLE V - APPEALS Appeals shall be in accordance with Afticle XVIII of the Land Use Ordinance, ARTICLE VI - PENALTIES Penalties shall be in accordance with Article XX of Land Use Ordinance. Bids received were as follows: Challenge Industries - in the amount of John Johnson - in the amount of 402 E. State St. Ithaca, N.Y. $75.00 $70.00 Members of the board and bidders of the Lansing Park Food Concession, dis- cussed the operation and maintenance of the concession stand. It was the consensus of the board to make the award at an Adjourned Meeting to be held on June 14th at 9 A.M. Invitation received from Almeda- Lansing Rescue and Fire Company, inviting the board to attend Open House on June 15th, at which time three Retiring Members will be honored. Norman D. Stanton, Ordinance Officer, submitted his monthly report which was read and reviewed by the board. Letter received from Atty. Walter J. Wiggins regarding a canoe loaned by James F. Sweazey to the Lansing Recreation Committee for use at the Town Park. Said canoe has a value of approximately $400.00 and can not be located. Mr. Sweazey is.requesting some financial renumeration be made. Board discussed and turned matter over to Youth Recreation Commission. Letter and draft of Resolution entitled "Validation and Appointment of Members to County Sewer District No. 1 Commission" was received from Frank R. Liguori, Tompkins County Commissioner of Planning. The board reviewed and discussed the proposed resolution to clarify membership on County Sewer District No. 1 Commission and the following resolution was offered: RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr.: LaVigne: RESOLVED, that.the Town Board of the Town of Lansing accept Mr. Liguori's proposed revision of the Membership on County Sewer District #1 Commission. Bradley Griffin discussed said request on.behalf of the Parks Commission and'Gustev Kopp spoke on behalf of the Lion's Club. RESOLUTION offered by Mr. Hilliard, who moved its adoption, seconded by Mr. LaVigne: RESOLVED, that the Town Board of the Town of Lansing authorizes the Lansing Town Park Commission to enter into negotiations with the Recreation Commission, Lansing School District, Lansing Lions Club, LAU and such groups and persons who would have interest in the following objectives within the Town: 1. Making maximum use of existing recreational facilities and attempting to eliminate duplication of capital improvements thereon.. 29 Making contributions of funds, goods or services in the acquisition, construction and /or maintenance of such facilities. BE IT FURTHER RESOLVED, that as a specific initial project, the Commission will explore the possible joint uses of LAU field by the school athletic program and the Town recreation program. Should such joint use seem feasible and desir- able, needs for improvements will be identified and the costs and methods of such works will be noted, and means of funding suggested, and be it further RESOLVED, that all agreements by the Commission on behalf of the Town shall be subject to approval of the Town Board. Carried RESOLUTION offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Naegely: RESOLVED, that the Supervisor of the Town of Lansing, be and hereby is authorized to sign change orders, contracts, documents, easements, condemnation. orders, etc., on behalf of the Town for the Southern Cayuga Lake Intermunicipal Water Commission. Unanimously Carried. RESOLUTION offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Bush: RESOLVED, that Justice Spry be authorized to attend the Judicial Con- ference in Rochester, N.Y. on June 21, 1975, all necessary expenses to be a town charge. RESOLUTION offered by Mr. Bush, who moved its adoption, seconded by Mr. LaVigne: RESOLVED, that this board encourages the participating by the T own of Lansing in Tompkins County Fire Mutual Aid Plan as now in force and as amended -from time to time and certifies to the Tompkins County Board of Supervisors through its County Fire Coordinator that no restriction exists against "outside service" by such fire department within the meaning of Section 209 of the General Municipal Law which would affect the power of such fire department to.participate in such plan, and be it further RESOLVED, that a copy of this resolution be filed with the County Fire Coordinator. Unanimously Carried. Highway Supt. S harpsteen 'stated that the County Highway Supt. had requested a list of the roads and mileage of each, that the town was turning over to the Village of Lansing. Discussion by the board, following resolution offered: RESOLUTION offered by Mr. Bush, who moved its adoption, seconded by Mr. LaVigne: RESOLVED, that the Town Highway Superintendent prepare an actual calulation of the mileage of each of the town roads being-turned over-to the Village of Lansing, together with a list of the names of said roads and transmit said information to the County Highway Superintendent. Unanimously Carried. RESOLUTION offered by Mr. Naegely, seconded by Mr. Bush, RESOLVED, upon written recommendation of the Highway Superintendeht,°ithis board hereby accepts the extension on Stormy View Drive, built by Alex Cima, pursuant -to review and written approval of the deed by the Town Attorney, Unanimously Carried, Lansing Village Trustees, Anne Furry and James Ludwigsen, appeared before the board, stating that the Village of Lansing was seeking appropriate legal action to restrain or enjoin the New York State Department of Transportation from completing the Cayuga Mall driveway according to the "old plan" and to construct one according to the "proposed plan" to permit future construction of a full intersection with a traffic control light to connect with the commercial units to the west. The Village Official's requested the legal support of this action by the Town of Lansing. Discussion held by the board. No action taken.
