HomeMy WebLinkAbout1975-05-20May 20, 1975 The Lansing Town Board met in an Adjourned Meeting on May 20, 1975 at 8:00 P.M., as called at the Regular Meeting of May 13, 1975. Said meeting scheduled to set a date for Public Hearing on a Proposed Amendment to the Land Use Ordinance dealing with flood plain and flood prone areas and act on any other business that may come before said board. ROLL CALL Wesley McDermott Supervisor Present Louis Bush Councilman Present Bert Hilliard Councilman Present Edward LaVigne Councilman Absent Lee Naegely Councilman Absent Robert Williamson Town Attorney Present Jane Bush Horky Clerk Present Visitors: Planning Board Chairman Viola Miller, William Bement, Bradley Griffin and Zoning Officer Norman Stanton. ® Supervisor McDermott called the meeting to order at 8:00 P.M. having the clerk take the Roll Call. Bradley Griffin, Regional Supervisor for the Department of Environmental Conservation, explained in detail the importance of the Town of Lansing amending the Land Use Ordinance in order to assist the town in becoming eligible for flood insurance under the National Flood Insurance Act of 1968 and amended in 1973. Mr. Griffin explained further, should the town neglect to protect the flood plain areas by not establishing land use and control measures, the State Legislature, would, pursuant to the Federal Flood Insurance Program, impose state rules, regulations and control in the community. Discussion held by the board, following resolution offered: RESOLUTION offered by Mr. Hilliard, who moved its adoption, seconded by Mr. Bush: RESOLVED, that a Public Hearing be held on the Amendment proposed to the Land Use Ordinance dealing with flood plain and flood prone.areas, on June 10, 1975 at 8:00 P.M. The Town Board discussed in detail, the town roads located within the Village of Lansing boundaries. Following resolutions offered: RESOLUTION offered by Mr. Bush, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that all town roads located within the Village of Lansing be turned over to the Village of Lansing, effective June 1, 1975, together with 7 /12th's of monies in Item #1 of the highway budget, raised by taxes levied against the real property located within the Village boundaries, and be it further RESOLVED, that the Clerk forward a certified copy of this resolution to the Mayor of the Village of Lansing. (Aye) Wesley McDermott, Supervisor Carried ® RESOLUTION offered by Mr. Bush, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that the Supervisor be and he hereby is authorized and directed to write to the Mayor of the Village of Lansing, that the Town of Lansing declines to enter into any contract with the Village of Lansing for the maintenance of Village roads. (Aye) Wesley McDermott, Supervisor Carried (continued) Continued May 20, 1975 RESOLUTION offered by Mr. Bush, who moved its adoption, seconded by Mr. Hilliard: RESOLVED, that the Town Board directs the Town Clerk to request an audit of all monies in the Town Budget,,monies from which budget are being turned over to the Village of Lansing. Z�t V June 10, 1975 The Lansing Town Board met in Regular Session at the Lansing Town Hall on June 10, 1975 at 8 P.M. with Supervisor McDermott presiding. Present Robert Williamson Town Atty. Present Jane Bush Horky Town Clerk Present Visitors: Water Supt. James Howell, Zoning officer Norman Stant6n, Planning Board Chairman Viola Miller and fifteen visitors. Supervisor McDermott opened the meeting having the clerk take the Roll Call. Proof of Notice having been furnished, the Public Hearing on the Proposed Amendment to the Land Use Ordinance - Flood Plain, was called to order by Supervisor McDermott. Planning Board Member, William Bement, reviewed the proposed amendment in general. Bradley Griffin, Regional Supervisor for the Department of Environmental Conservation, reviewed the importance of the town adopting said proposed ordinance versus the State Legislature imposing state rules and regulations, pursuant to the Federal Flood Insurance Program. No one appeared voicing any objection the the proposed Amendment to the Land Use Ordinance - Flood Plain, and all persons desiring to be heard, having been heard, the Public Hearing was terminated at 8:30 P.M. The Town Board reviewed the Public Hearing just held on the proposed Amendment to the Land Use Ordinance - Flood Plain, and the following resolution was offered: RESOLUTION offered by Mr. Naegely, who moved its adoption, seconded by Mr. Hilliard: WHEREAS, the Town Board of the Town of Lansing duly advertised a Public Hearing to be held on a proposed Amendment to the Land Use Ordinance - Flood Plain, to be held June 10, 1975 at 8:00 P.M. in the evening thereof, and WHEREAS, the Planning Board of the Town of Lansing recommended the adoption of said proposed amendment, now therefore be it RESOLVED, that an Ordinance of the Town of Lansing providing for the e Amendment to the Land Use Control Ordinance, adopted by this Town Board on the 4th day of June 1973, is hereby amended to read as follows: TOWN OF LANSING ORDINANCE N0. 17 AMENDMENT TO LAND USE ORDINANCE - FLOOD PLAIN ARTICLE 1 - PURPOSE Section 1. The purpose of this amendment to the land use ordinance is to establish land use and control measures that will improve and preserve the ability and capacity of the flood plain to withstand the effect of flooding with the least threat to the health, safety and welfare of the inhabitants of the Town of Lansing. These measures shall be consistent with federal criteria in order to assist the town to become eligible for flood insurance under the National Flood Insurance Act of 1968 (42 USC 4001 -4127, 82 STAT. 572).
