HomeMy WebLinkAbout1975-03-26'TOWN OF LANSING ORDINANCE NO. 16 An Ordinance of the Town of Lansing, Tompkins County, State of New York, providing for the amendment of an Ordinance adopted by the Town Board on the 9th day of August, 1966 as amended by the Town Board on November 30, 1970. BE IT ORDAINED, by the Town Board of the Town of Lansing, County of Tompkins, State of New York: Section 1: Section 2 of the Ordinance is hereby amended to read as follows: Section 2: The following requirements must be met in order to qualify for exemption: 1. Either the husband or wife must be 65 years of age or over on the date the application for said exemption is filed. 2. Title to the property must have been vested in the owner or owners of the property for at least two years prior to the date of the application. 3. The property must be used exclusively for residential purposes and must be occupied in whole or in part by the owner or owners and said property must be their legal residence. 4. The income of all the owners must not exceed $6,500 during the income tax year immediately preceding the date of application. Where the title is vested in either the husband or wife the combined income of the husband and wife may not exceed $6,500. "Income" includes all Social Security and Retirement payments, interest, dividends, rental income, salaries or other earnings including income from self - employment. It does not include gifts or inheritances received during the income tax year. The burden of proof is upon the applicants to show eligibility and they may be required to obtain and submit copies of their latest Federal and State Income Tax, Social Security statements, etc. Section 3: In all other respects the Ordinance adopted August 9, 1966, amended November 30, 1970 shall remain in full force and effect. Section 4: This Ordinance shall be entered in the Minutes of the Town Board and published in the Ithaca Journal and a copy thereof posted on the Sign Board maintained by the Town Clerk of the Town of Lansing,pursuant to Subdivision 6 of Section 30 of the Town Law and affidavit of publication and posting filed with the Town Clerk. This Ordinance shall take effect immediately. BY ORDER OF THE TOWN BOARD OF THE TOWN OF LANSING March 26, 1975 The Lansing Town Board met in an Adjourned Meeting on March 26, 1975 at 8:00 P.M. for the purpose of conducting a Public Hearing on the junk yard application of Bob Murphy, Inc., and act on any other business that may come before said board. ROLL CALL Louis Bush Councilman Present Bert Hilliard Councilman Absent Edward LaVigne Councilman Absent Lee Naegely Councilman Present Wesley McDermott Supervisor Present Jane Bush Horky Clerk Present Visitors: Water Supt. James Howell, Ordinance Officer Norman Stanton and six Lansing residents. Supervisor McDermott opened the meeting having the clerk take the Roll Call. Proof of Notice having been furnished, the Public Hearing on the Junk Yard Application of Bob Murphy, Inc., to operate a junk yard on 217 Fenner Road was called to order by the Supervisor. Mr. Murphy presented an aerial photograph and a detailed map of the junk yard site, and reviewed the method of operation of the dump. Discussion held by the board and persons present. All persons desiring to be heard, having been heard, and no objections made to said Junk Yard Application of Bob Murphy, Inc., the hearing was terminated at 9:30 P.M. The town board discussed the hearing just held and the following resolution was offered: RESOLUTION offered by Louis Bush, who moved its adoption, seconded by Mr. Naegely: RESOLVED, that the application of Bob Murphy, Inc., for operation of a Junk Yard consisting of 60 acres located at the south side of Fenner Road, west side of Davis Road in the Town of Lansing, be and hereby is approved with (continued C7 1 Continued March 26, 1975 direction of the Town Clerk to issue a Junk Yard License for the year 1975, with the following contingencies: 1) That he continue to maintain a valid D.E.C. Permit. 2) That all completed areas be covered with soil and seeded with a cover crop during the summer of 19750 3) That he not exceed an elevation of 1,000 feet at the site. (Aye) Wesley McDermott, Supervisor Supervisor McDermott presented his monthly report which was reviewed by the board. RESOLUTION offered by Mr. Bush, who moved its adoption, seconded by Mr. Naegely: RESOLVED, that the Supervisor be authorized to sign an underground line easement granting the New York State Electric & Gas Corp. and the New York Telephone Co., an easement across the lands of the Town of Lansing Town Park as shown on the attached drawing. Carried ON MOTION, meeting adjourned 10:15 P.M.
