RESOLUTION offered .by.Mr. Naegely:
RESOLVED_;' that David L. Klein, 1187 E. Shore Drive, be.appointed as a Member
of the Lansing Board of Zoning Appeals for a five year term, said term commencing
June 15, 1974.
Seconded by Mr. LaVigne. Carried
The Zoning Board of Appeals advised the Town Board that Suzanne Lorbeer,.
member of the Appeals Board,'will be unable to be an active member for one year
and will be submitting her resignation. It was suggested by..the Appeals Board
that Margaret McElwee fill the unexpired term of Suzanne Lorbeer and Barbara
M. Irish be appointed to a one year term. Town Board to check on said request.
A letter was received and read from Viola H. Miller, Chairman of the Lansing
Planning Board. Said letter endoresed and recommended changes in the Zoning
Ordinance pertaining to site approval and building permits in the Industrial,
Commericial and Planned Development area zones as seem mandated by the "Nemeroff"
decision. The Planning Board also recommends such policy changes that seem
necessary to accomodate change and to avoid confusion in. administering the
Ordinance, endorsed the use of the Savings Clause, and recommended that the
Town Board petition the legislature for enabling legislation to make possible
Planning Board approval of site plans.
The board discussed a date for a Public Hearing to be held'on the recommended
changes to the'Zoning Ordinance. Following resolution offered*

WHEREAS, the Planning Board has recommended certain changes in the Town of
Lansing Zoning Ordinance to bring said ordinance into conformity with State law,
and
WHEREAS, said amendments have been presented to the Board, now therefore be it
RESOLVED, that this Board hold a public hearing on said proposed amendments
in the Town Hall on the 16th day of October 1974 at 8:00 in the evening thereof.

The Lansing Town Board met in Regular Session at the Lansing Town Hall on
October 8, 1974 at 8 P.M. with Supervisor McDermott presiding.

The Supervisor opened the meeting having the clerk take the -Roll Call.
A copy of the minutes of August 13, 1974 meeting having been furnished
to the members of the town board beforehand, the Supervisor asked for a motion .

Letter received from Office for Local Government regarding a Management Con-
ference to be held October 24, 1974 in Binghamton N.Y. The agenda for said confer-
ence was reviewed by the board.
MOTION by Mr. Bush, seconded by Mr. LaVigne, that Lloyd Sharpsteen and a
Representative from the Lansing Planning Board be authorized to attend the Manage-
ment Conference to be held in Binghamton, N.Y. on October 24, 1974, all necessary
expenses to be paid by the town. Carried
Norman D. Stanton, Ordinance Officer, submitted his monthly report which was
read and reviewed by the board.
Supervisor McDermott reported that three parties involved with the common
access points on the north side of the Triphammer project, had submitted agree-
ments to the concept of said access points.
Gary Craig, Project Manager for the proposed Pyramid Mall, stated that plans
and laterals of the proposed Mall would be presented for review at the Lansing
Planning Board Meeting of October 14th. Town Board Members were invited to attend.
Councilman Naegely stated that there would be a County Sewer Commission meeting
on November 12th at 4 P.M. at the office of Frank Liguori, Tompkins County Planning
Commissioner.
Robert Gibbs stated that boys on trail bikes had been riding around the Lansing
Water Tower on N. Triphammer Road. The board requested Water Supt. James Howell
to investigate this matter. Mr. Gibbs also discussed the cars and trucks parking
in front of McDonald's Restaurant, causing hazardous visible conditions when
approaching Triphammer Road from the restaurant parking area. Board requested
Highway Supt. Lloyd Sharpsteen to take this matter up with Public Works Comm-
issioner Howard Stevenson and report back.
The board discussed a request from the Lansing School Board to open Crooked
Hill Road to school bus traffic. It was the consensus of the Town Board to con-
tinue restrictions on Crooked Hill Road, as per resolution of October 9, 1973, for
continued observation by the Highway Department for possible settling.
Supervisor McDermott discussed with the board, the Freedom of Information
Act which the Town must take action on in the near future.
Arno Finkeldey presented his plans for nine homes to be constructed adjacent
to Myers Road and requested permission to hook up said nine homes to Lansing Water
District #2. Discussion by the board, following resolution offered.
RESOLUTION offered by Mr. Bush:
RESOLVED, that this board intends to enter into a contract with Arno Finkeldey
for public water for his sub - division as shown on map drawn by William Mott,
dated 3/30/74, being understood that water will only be supplied to nine homes,
the terms and conditions of this contract to beaapproved by this board after
approval and review by the Town Engineer, the review of the Lansing Water & Sewer
Committee and review by the Lansing Planning Board.

The board requested Atty. Williamson to draw up Agreements between the Town
of Lansing on behalf of Lansing Water Dist. #1 and John & Sylvia Hicks and Jay &
is Marjorie S. Orear; and the Town of Lansing on behalf of Lansing Water Dist. #2
and Arno Finkeldey, for the board's consideration in response to the above persons
requests to hook up to the Lansing Water Districts.
RESOLUTION offered by Mr. LaVigne:
RESOLVED, that the Supervisor be authorized to sign easements through town
property, as shown on Easement Map #539 dated 8/22/741, drawn by Lozier Engineers,
Inc., Rochester, N.Y.,.for the Bolton water project, entitled Southern Cayuga
Lake Intermunicipal Water System.

Councilman Lee Naegely reported that there would be a meeting of the County
Sewer Agency to be held at the Tompkins County Planning Office at 4 P.M. on the
31st of October. Said meeting concerning the report of O'Brien & Gere and any
other business that may come before said Agency.
Councilman Naegely stated that he was still concerned in regard to the lighting
at the Rte. 13 construction area, and will check with the Electric & Gas Co. on
the cost of a light or lights for said area.
Supervisor declared a recess at 8:40 P.M., business resumed at 8:55 P.M.
Supervisor McDermott announced to the board that the budget for the next
ensuing year must be completed at this time. Considerable budget study was
made and figures compiled. Following the completion of the preliminary budget
it was ready for adoption and the date of the hearing set thereon.

RESOLUTION offered by Mr. LaVigne:
WHEREAS, the assessment rolls for the Lansing Water District #1, Lansing Water
District #2, Lansing Sewer District #1, Lansing Sewer District #2 and Catherwood
Light District have been completed and have been filed with the Town Clerk, now
therefore be it
RESOLVED, that the Town Board hold a Public Hearing on said assessment rolls
on the 6th day of November 1974 at 8:30 P.M. in the evening thereof, then, and
there to meet, hear and consider any objections which may be made to the rolls, and
be it further
RESOLVED, that the Town Clerk publish notice of completion of the rolls
pursuant to Section 239 of the Town Law.

RESOLVED, that Norman D. Freeman, Esq.. upon recommendation of the Chairman of
the Lansing Board of Zoning Appeals, be retained to represent the said Zoning Board
of Appeals in the matters of Pyramid Companies VS John C. Barney, et al, presently
pending before the Tompkins County Supreme Court and the matter of Pyramid Companies
VS John C. Barney etal, presently pending before the Supreme Court, Appellate Div-
ision, Third Department, to be paid a rate not to exceed $50.00 per hour with a
maximum amount not to exceed $750.00 without further expenditure absent without
Town Board approval.

Wesley McDermott presiding. Said meeting to hold a Public Hearing on Proposed Changes

before said board.
