ARTICLE XIII: SPECIAL CONDITIONS, SPECIAL PERMITS AND PLANNED DEVELOPMENT Section 1302.1 Two Family dwelling units in R L M H and C Districts If more than 16 dwelling units are to be constructed on any single parcel, whether for sale or for rent, they must be constructed as a Planned Development Area (see Section 1307). Section 1302 Change present paragraph number 1, 29 3, 49 5 to paragraph numbers 2, 3, 49 5, 6. Section 1303.12 Electric, gas, sewer and water transmission lines and stations in L, M, H, C and I Districts Permitted when such stations are attractively landscaped to reduce noise and screen out objectionable views from adjacent properties. ARTICLE XIV: OFF- STREET PARKING Section 1401 All land use activities permitted by this Ordinance, including variances and special permits, shall provide adequate off - street parking in at least the amounts specified in the following schedule: 1. For dwelling units: -one family dwelling - two spaces per dwelling unit. -all other dwellings - 1.5 spaces per dwelling unit. 5. For a restaurant, social club, bar, tavern or similar use: A. Without, a bar - one parking space for each 100 square feet of gross floor area. Be With a bar - two parking spaces for each 100 square feet of gross floor-area. 7. For shopping centers or shopping plazas where concentrations of retail stores are located: -3 square feet of parking area for each square foot of selling floor area. 12. Churches and places of public assembly: -one parking space for each eight seats. 13. Bowling alleys and tennis courts: -six parking spaces for each alley or court. 16. Theaters: -one parking space for each four seats. ARTICLE XV: SIGNS Section 1500. The intent and purpose of this Article is to establish specifications for the provisions of signs in those certain Land Use Controlled Districts and also for the unzoned area of the town which will permit proper identification, preserve and enhance the visual characteristic quality of the'area and prevent installations which are particularly distractive and hazardous to vehicular traffic. Sections 1500 through 1511 apply to the zoned and unzoned areas in the Town of Lansing. Section 1501. In general, and unless otherwise specified in this Article, signs shall be located on the premises they advertise and shall not flash or move, or have the appearance of flashing or moving. No sign shall be located closer than.10 feet to any road right -of -way line or overhang any portion of land 10 feet from the road right - of -way line. This provision shall not apply to those signs needed -46 ARTICLE XVI: NONCONFORMING USES Section 1600. Continuance Continued April 30, 1974 Except as otherwise provided in this Article, the lawful nonconforming uses of any building or land existing at the date of adoption of this Ordinance may be continued even:though such use does not conform to the provisions of the Land Use Control District in which such land is located. Section 1603. Changes A nonconforming use may be changed'to another'nonconforming use only by var- iance granted by the Board of Appeals. No nonconforming use shall, if once changed to a conforming use, be changed back to a nonconforming use. ARTICLE XVII: ADMINISTRATION Section 1701. Building Permit ■ Add to this section: The Zoning Enforcement Officer may revoke a Building -" Permit if it has been found that there is a significant deviation from the plans upon which such permit was issued, as it falls within the scope of this Ordinance. Certificate of Occupancy Last sentence to read: If the building construction is in violation of the Zoning Ordinance, the law shall be enforced as stated in Article XX of this Ordinance. ARTICLE XVIII: APPEALS Section 1803. Procedure Add to 1. For appeal and /or application for variance, there will be a fee of $10.00. Fee not to be refundable. Proof of notice having been furnished, the Public Hearing on a proposal to amend Local Law #1, adopted June 14, 1966 entitled Rules, Regulations and Penalties of the Town Board of the Town of Lansing regarding Water Supply for Lansing Water District #1, was called to order by Supervisor McDermott at 8 :30 P.M. The proposal to amend Local Law #1 - 1966, relative to Item #2 Water Use and Conservation, was reviewed by the Board and persons, present. All persons.desiring to be heard, having been heard, the Public Hearing was terminated at 9 :10 P.M. The following resolution was offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Hilliard, towit: RESOLVED, that Local Law #1 of the year 1966 entitled Rules, Regulations, and Penalties of the Town Board of Lansing, Tompkins County, N.Y. Regarding Water Supply for Lansing Water District No. 1, is hereby amended to read as.follows: ITEM 11728 WATER USE AND CONSERVIATION - SHALL BE A.7 ,_TDED TO READ AS FOLLOWS: ITEM #28 WATER USE AND CONSERVATION FOR AIR CONDITIONING OR REFRIGERATION (a) Systems with a capacity of five tons or less shall not use .water directly or indirectly, (except when used with conservation equipment) from the public supply. 1 i (continued April 30, 197+) :l 47 This Local Law shall take effect upon filing and publication of same, pursuant to Section 27 of the Municipal _Home Rule Law. RESOLUTION offered by Mr. Hilliard: WHEREAS, the Town Clerk has duly advertised for bids for the purchase of one voting machine, and WHEREAS, the Automatic Voting Machine Division of Jamestown, New York was the only bidder with a bid of $2,009.00, less an allowance of $50.00 on one obsolete machine, now therefore be it RESOLVED, that said bid of Automatic Voting Machine Division be and the same is hereby accepted. 1 Seconded by Mr. LaVigne. Carried Letter read from Tompkins Co. ASC Committee expressing their appreciation for the use of the Town Hall. Letter received and read from Frank R. Liguori, .Tompkins County Commissioner of Planning, Re: application for Federal Assistance; Water, Sewer and Fire Safety; Tompkins County Industrial Park; Tompkins County Industrial Development Agency. Letter received and read from J.A. Carrigg, General Manager - Ithaca Area of the N.Y.S. Electric & Gas Corp. Said letter advised of an informal meeting scheduled May 3rd to discuss the Cayuga Station project. James Showacre, Chairman of Lansing Water & Sewer Advisory Committee, presented the Town Board, copies of minutes of meeting of April 19, 1974 of said Committee. Supervisor McDermott discussed the excellent plans of common access roads proposed for N. Triphammer Road and Route 13, designed by Planning Board Member, Fred Edmondson. Mr. Edmondson has offered to work on the engineering date of this project. Discussion by the board, following resolution offered:. RESOLUTION offered by Mr. LaVigne: RESOLVED, that the Town Board authorizes Fred Edmondson to obtain data from Eng, T.G. Miller regarding topography, location of public utilities, location of property lines with relation to rights -of -way in the Triphammer Road /Rte. 13 Interchange vicinity, relating to common access drives for businesses in the area, 'T, for a total cost not to exceed $500.00. Seconded by Mr. Hilliard. Carried Mr. Stanley Goldberg presented to the Town Board, plans for a proposed commercial building to be located at 23 Cinema Drive, south of Bill Cooke Cadillac. Mrs. Miller, Planning Board Chairman, stated that said Planning Board had reviewed the site and plans and had granted their approval. Discussion and review held by the board, following resolution offered: RESOLUTION OFFERED BY Mr. LaVigne: i RESOLVED, that the Town Board accept the recommendation of the Planning Board and Zoning Officer, for issuance of a Building Permit to Bishop's of Ithaca, Inc., for construction of a commercial building and appurtenances on 23 Cinema Drive. Miller, Eng. to outline scope of work they desire the Eng. to do in connection with formation of proposed Lansing Sewer Dist. #3, and a written contract for the work be submitted to the Town Board for approval. Seconded by Mr. Hilliard. RESOLUTION offered by Mr. LaVigne: Carried RESOLVED, that the Highway Superintendent be and hereby is authorized and directed to purchase replacement parts and materials for the repair of damaged equipment at the Lansing Park, including two play animals. Seconded by Mr. Naegely. Carried Councilmen Hilliard and LaVigne discussed the Lansing Park in regard to the marina and concession stand. Supervisor McDermott discussed correspondence from Treman and Clynes in regard to the completion of Bolton Road. Stated that Town Attorney Williamsom. was requesting an extension of one year. RESOLUTION offered by Mr. Naegely: RESOLVED that the terms of certain members of the Board of Zoning Appeals be modified so that there are no six or seven year terms. Term of Robert Gibbs- seven years- modified change to two years; term of John Barney - six years - modified change to four years; retroactive to June 15, 1973, to abide by Section 267 of the•Town Law. Seconded by Mr. Hilliard. On Motion, meeting adjourned to May 7, 1974 at 8:00 P.M.
