The Lansing Town.Board.met.'in Special Session on November.8, 1973•at.8:OO.P.M.
with Deputy Supervisor Edward LaVigne presiding,'to. conduct Public Hearing's on
the Preliminary Budgets for the year 1974, Public Hearing on Special Districts and
consider and act on any other business that may come before said board.

Visitors: Water Supt. James Howell, Deputy Clerk Wanda Brink and thirteen
Lansing Residents.
The Deputy Supervisor called the meeting to order at 8:00 P.M. having the
clerk take the roll call.
Proof of Notice having been furnished, the Deputy Supervisor advised the Board
that the Public Hearing was now open on the preliminary budget as called by the
Town Board and so advertised in the Ithaca Journal and posted according to Town
Law 108.
The persons present were each presented a copy of the General and Highway Fund
Preliminary Budgets and a copy of the Maintenance & Operating Budgets for Water
District #1 and Water District #2. Each item of the budgets was gone over and
discussed in detail.
All persons desiring to be heard, raving been heard, and no objections made
to the said preliminary budgets, the Hearing was terminated.
Proof of Notice having been furnished by the Town Clerk, the Public Hearing
on the Special Districts; Lansing Water #1, Lansing Water 12, Lansing Sewer #1,
Lansing Sewer #2 and Catherwood Light District was called to order by Deputy'rSuper-
visor Edward LaVigne. The assessment rolls for the year 1974 were offered for
inspection and discussion.
All persons desiring to be heard, having been heard, and no objections made
to said rolls, the Hearing on Special Districts was terminated.
The Town Board discussed the Hearing's just held and the following resolutions
were offered:
RESOLUTION ADOPTING GENERAL FUND BUDGET offered by Mr. Naegely:
WHEREAS, this Town Board has met at the time and place specified in the notice
of public hearing on the General Fund Preliminary Budget and heard all persons
desiring to be heard thereon; now therefore'be it
RESOLVED, that this Town B oard does hereby.adopt such General Fund Preliminary
Budget as originally compiled, as the annual budget of this .Town for the.fiscal year
beginning on the lst day of January 1974, and that such budget as so adopted be
entered in detail in the minutes of the proceedings of this Town Board, and.be it

RESOLUTION.offered by Mr. Bush.
RESOLVED, that the Maintenance & Operation Budget for the year 1974 for Water
District #1 be accepted and said water rate schedule for metered water consumed
shall be fixed in accordance to sufficiently cover the maintenance and operation
budget cost of said district; 1974 rate schedule as follows:
WATER RATE SCHEDULE FOR DISTRICT #1.
Minimum Per Quarter (5,000) gal. allowed $8.50
Next 20;000 gal. per Qtr. @ 75¢ per 1,000 gal..
Next 50,000 gal. per Qtr. @ 65¢ per 1,000 gal.
Over 75,000 gal. per Qtr. @ 50¢ per 1,000 gal., and be it further
RESOLVED, that the aforesaid schedule shall apply for every two apartment
units or two trailer units fed from a single meter. For example, if 200 apartments
are fed by a single meter, the total water charge will be computed as follows:
200 units over 2 equals equivalent household units (100). Equivalent household
units (100).divided into total meter reading equals gallons of water per equivalent
unit. Water charge for equivalent unit is computed by multiplying gallons of
water per equivalent unit by water rate schedule. Total water charge is computed
by multiplying the equivalent water charge unit by 1000
Seconded by Mr. Naegely,
Mr. Gerald Talandis appeared before the board at this time and objected to
the Water Rate.Schedule for District #1 as presented. Requested the board to re-
examine the rate schedule before adopting. Discussion by the board followed and
it was MOVED by Mr. Naegely, seconded by Mr. Hilliard, that this resolution be
TABLED.

RESOLVED, that the Maintenance & Operation Budget for the year 1974 for

trailer unit fed from a single meter. For example, if ten apartment units or
trailer units are fed by a single meter, the total meter charge shall be computed
as follows: divide the total meter reading by ten, equals the gallons of water
per equivalent unit. The water charge per equivalent unit is computed by
multiplying the number of gallons per equivalent unit by water rate schedule.
The total water rate charge is computed by multiplying the equivalent unit charge
by ten.

WHEREAS, the Tompkins County Division of Assessment filed an assessment roll
for the Town of Lansing Water District #1 on and before September 15,1973, and
WHEREAS, after proper notice a Public Hearing was held on November 8, 1973,
and all persons desiring to be heard, having been heard, and no one appearing
objecting to said Water District #1 Assessment Roll, now therefore be it
RESOLVED, that the Assessment Roll as prepared be filed for Lansing Water
District #1 and the same is hereby approved, affirmed and adopted pursuant to
Section 239 of the Town Law for the year 1974, and be it further
RESOLVED, that the formula used for the basis of extending the Assessment Roll
for Lansing Water District #1 for the year 1974 be:
Assessed Valuation Charge: $2.25 per $1,000 land and buildings.
Unit Charge: $46.45 per living unit or equivalent where water is considered
available, and the same is hereby affirmed and adopted by the
Town Board.

It was suggested by Mr. LaVigne that an Informational Public Meeting be held
regarding the.new proposed-Village in the southern area of the _:Town. Mr. James
Preston of the Lansing Civic Association agreed to act as moderator at said pro-
posed meeting. Rita Smidt of the Village Study Group; Viola Miller, Chairman of
the Lansing Planning Board; Harris Dates, County Representative; newly elected
Supervisor, Wesley McDermott and the Lansing Town Board all agreed to participate
at,the Public Informational Meeting. Tentative meeting with the above mentioned
persons was scheduled for November 14th at 8 P.M. at the Town Hall, to establish
the format for the Public Informational Meeting which is tentatively scheduled
for November 26th.
RESOLUTION offered by Mr. Naegely:
RESOLVED, that the resolution adopted for payment to the County of Tompkins
and Cornell University for payment of airport sewer lines shall be amended to
provide for the repayment to the County of Tompkins and Cornell University'of
10 /12ths of the sewer taxes paid to Lansing in 1973, due to the erroneous assess-
ment of said charges. Refer to Resolution 12/28/72.

RESOLUTION offered by Mr. Bush:
RESOLVED, that this board authorizes the payment to Cornell University
for the purchase.of water storage tank $21,000.00, pumps installed by Cornell,
for Lansing $7,263.84, interest at 6% from 911169 to 9/1/73 $1,307.49 and heat
and power $1,350.00, total of which is $30,921.33.

The following resolution was offered by Councilman Lou IQ Rir'h ,
who moved its adoption, seconded by Councilman Lee Naegely , to -wit:

A RESOLUTION AUTHORIZING THE INCREASE AND IMPROVEMENT
OF THE FACILITIES OF LANSING WATER DISTRICT NO.. 1 OF
THE TOWN OF LANSING, TOMPKINS COUNTY, NEW YORK, AT A
MAXIMUM ESTIMATED COST OF $255,00.0,. AND AUTHORIZING THE
ISSUANCE OF $255,00.0 SERIAL BONDS OF SAID TOWN TO PAY
SAID COST.
WHEREAS, pursuant to proceedings heretofore had and taken in
accordance with the provisions of Sectioon 202 -b of the Town Law, and
more particularly a resolution of this Town Board dated July 17, 19731'
it has been determined to be in the public interest to provide for
a certain increase and improvement of the facilities: of Lansing Water.
District No. 1 of the Town of Lansing, Tompkins County, New.York, and
WHEREAS, it is now desired to authorize such increase and improvement.
and to provide for the financing of the cost thereof; NOW, THEREFORE,
BE IT
RESOLVED, by the Town Board of the Town of Lansing,. Tompkins County,
New York, as follows:
Section 1. The increase and improvement of the facillitles of

New York, consisting of.the.construction of Rater mains -with meter pit,
pressure reducer and appurtenant facilities and the acquisition of
certain existing facilities at the Tompkins County airport,and from-
Industry Research Park, together with the acquisition of easements or
other rights in land necessary therefor, all as more particularly
described.in the map, plan and report heretofore. prepared in connection
therewith and on file in the office of the Town Clerk, is hereby
authorized at a maximum estimated cost of $255,00.0..
Section 2. The plan for the financing of such specific object
or purpose is by. the issuance of $255,000 serial bonds of said Town,
hereby authorized. to:be issued pursuant to the Local Finance Law..
Secti'on'3. It is hereby determined that the period of probable
usefulness of the aforesaid specific objector purpose is forty
years, pursuant to
.subdivision
1.`of
paragraph a of Section 11.00
of
the Local Finance
Law. It is
hereby.fur.ther.determined
that
the
maximum maturity of the bonds herein authorized to be issued will
exceed five years.
Section 4.
The faith .and credit of said Town of Lansing, Tompkins
County., New York, are hereby irrevocably pledged to: the payment-of the
principal of and interest on such bonds as the same become due and
payable. There shall be annually apportioned and assessed upon the
several lots and parcels of land within said Lansing Water District
No. 1, which.the Town Board shall determine and specify to be especially
benefited..by the improvementan amount sufficient`to pay the principal
and interest of said bonds as the same become due, but if not paid
from such source, all the taxable real property in said Town shall be
subject to. the levy of ad valorem taxes without. limitation as to rate .
or amount sufficient to pay the principal of and interest on said bonds
as the same shall become due.
Sec ion. 5. Subject to the provisions.of the Local Finance Law,
the power to authorize the issuance of and to.sell.bond anticipation
notes in anticipation of the issuance and sale of the serial bonds
herein authorized, including renewals of such notes, is hereby delegated

such terms, form and contents, and shall be sold in such manner as may
be prescribed by said Supervisor, consistent with the provisions of .the
Local Finance Law,
Section 6. The validity of such bonds and bond anticipation notes
if may be contested only if:
1) Such.obligations are .authorized for an object or purpose for
which said Town is not authorized to experid money., or
2). The provisions of law which.should be complied with:at the.
date of .publication of this resolution are not substantially
complied with, .
and an action, suit or proceeding contesting such validity is commenced
within twenty days after the date of such publication, or
3) Such obligations are authorized in violation of.the provisions
of the Constitution.
Section 7. This resolution, which takes. effect immediately',
shall be _published in full in Ithaca Journal ,
the official newspaper together with a notice of the .Town Clerk in
substantially the form provided in Section 81.00.of the.Local Finance Law.
The question of the adoption of the foregoing resolution was
duly put to a vote on roll call, which resulted as follows:
