HomeMy WebLinkAbout1973-07-171 1 July 17, 1973 89 .The Lansing Town Board met in Regular Session at the South Lansing Town Hall on July 17, 1973 at 8 P.M. with Supervisor Howell presiding. ROLL CALL Charles Howell Supervisor Present Louis Bush Councilman Present Bert Hilliard Councilman Present Edward.LaVigne Councilman Present Lee Naegely Councilman Present Lloyd Sharpsteen Highway Supt, Present Robert Williamson Town Attorney Present Jane Bush Town Clerk Present Visitors: Water Supt. James Howell, Eng. T.G. Miller, Tompkins County Director of Env. Health Stephen F. Herman, approximately twenty visitors. The Supervisor opened the meeting having the clerk take the roll call. A copy of the minutes of May 8th, May 15th, May 21st, June 4th, June 12th, June.l9th and June 22nd meetings having been furnished to the members of the town board beforehand, the Supervisor asked for a motion to propose corrections of errors or-to accept same as submitted. MOTION by Mr. Bush and seconded by Mr. Naegely that the minutes as submitted by the Town Clerk be approved. Carried Proofsof Notice having been furnished, the .Public Hearing to consider the Repeal of Local Law No. 3, adopted July 9, 1971 entitled "Regulating Signs in the Town of Lansing ", and the amendment thereto, being Local Law No. 1 of 1972 entitled "Amending the Sign Local Law of the Town of Lansing ", was called to order by Super- visor Howell at 8:00 P.M. The proposed Local Law was reviewed and discussed.: All persons desiring.to be heard, having been heard, the Public Hearing was terminated at 8:25 P.M. The Board at this time discussed the Hearing just held and the following Resolution was offered: RESOLUTION offered by Mr. LaVigne. WHEREAS, a Public Hearing has been held regarding the proposed adaption=of a Local Law repealing Local Law #3 adopted July 9, 1971 and Local Law #1 of 1972 adopted April 4, 1972 and WHEREAS, discussion was had concerning said Local Law, now therefore be it RESOLVED, that said Local Law be and the same hereby is adopted effective immediately after filing and publication as required by law. Seconded by Mr. Bush. LOCAL LAW NO. 1 - 1973 REPEAL OF LOCAL LAW NO. 3, ADOPTED JULY 99 1971 AND LOCAL LAW #1 OF 1972 ADOPTED APRIL b, 19729 AMENDING SAID LOCAL LAW. Be it enacted by the Town Board of the Town of Lansing as follows: Section 1: Local Law No. 3, adopted July 9, 1971, entitled "Regulating Signs in the Town of Lansing" and Local Law No. 1 of 1972 entitled "Amending the Sign Local Law of the Town of Lansing" be and they hereby are repealed. Section 2: Effective date: This Local Law shall take effect immediately after filing and publication, as required by law. Proof of Notice having been furnished, the Public Hearing to Consider The Increase In Facilities for Lansing Water District #1, was called to.order by Supervisor Howell at 8:10 P.M. 90 continued July 17, 1973 Eng, T.G. Miller reviewed and discussed in detail,`the'proposed items to be included in'the increased. fa,c; l:;ti;es as well as the proposed financial plan to finance same. I - Following reports of Mr. Herman, Mr. Miller and Mr. opened the Public Hearing to persons present desiring to spoke were Mmes. Ann Roscoe, Viola Miller, Barbara Irish Seymour Smidt, James Showacre and Benjamin Richards. All persons desiring to be heard having been heard, terminated at 9 :50 P.M. Howell, Supervisor Howell be heard. Persons Who and Messrs. A.J. Long, the Public Hearing was' The Town Board discussed the Public Hearing just held, followed by a Resolution offered by Mr. LaVigne, who moved its adoption, seconded by Mr. Hilliard, APPROVING THE INCREASE OF FACILITIES OF LANSING WATER DISTRICT #1, at an estimated cost'of $255,000.00. Said Resolution attached hereto and made a part thereof.' RESOLUTION offered by Mr. LaVigne: WHEREAS, the Town of Lansing requested the creation of a position, namely, Assistant Water Superintendent, and- WHEREAS, the Town Board of the Town of Lansing has reviewed and approved, the specifications, dated June 14, 1973, submitted by Hugh Hurlbut, Commissioner of Personnel of Tompkins County in regard to the creation of an Assistant Water Superintendent for the Town of Lansing, said specifications on file in-the Town of Lansing, now therefore be it RESOLVED, that the Town Board of the Town of Lansing approve the creation of the position of Assistant Water Superintendent for the Town of Lansing, and be it further RESOLVED, that a copy of this resolution be forwarded to Hugh Hurlbut,. Commissioner of Personnel of Tompkins County. Seconded by Mr. Naegely. RESOLUTION offered by Mr. Hilliard: Carried RESOLVED, that the Highway Superintendent be authorizedtto hire seven year 'round part -time motor equipment operator positions and five year 'round part -time laborer positions. Seconded by Mr. Bush. RESOLUTION offered by Mr. LaVigne: Carried RESOLVED, that Lee Naegely be appointed to represent the Town of Lansing on the County Sewer Agency and Charles F. Howell.be.appointed as alternate.. Seconded by Mr. Hilliard. Carried Proposals for the 1974 Lansing-Highway Association Contract were submitted to the board by.association representative. Saidpproposal listed items for the board's consideration. Board to meet at a later date to review and discuss proposals. No action taken at this time. RESOLUTION offered by Mr. Bush: RESOLVED, that $1,000.00 be transferred from the Contingent Account A1990.4 to Garage Maintenance and Supplies A5132.44. Seconded by Mr. Hilliard, Carried George Beckwith appeared before the board requesting the town to accept -as a town road,'his newly constructed road running from Rtet. 34B toward the lake. Inasmuch as the N.Y.S. Electric & Gas have a right of way by the roadway already constructed by Mr. Beckwith and any conveyance of this property would be subject to the rights for their electric line as set forth in their easement, the board withheld taking any action on Mr. Beckwith's request. RESOLUTION offered by Mr. Hilliard: RESOLVED, that Highway Superintendent S harpsteen be authorized to attend the N.Y.S. The Town engineer -is hereby directed to prepare definite plans and specifications and to make a careful estimate of the expenses.-and -with the assistance'of the town attorney to prepare. a proposed contract for the execution of the aforesaid work and to.submit the same to this Town Board for its examination and approval. Attorney Mustico, Attorney for McDonald's Restaurant, appeared before the board in regard to sewer service for their newly constructed building on N. Triphammer Rd., requesting the town to either extend the present sewer district or form a new dis- trict. No action taken. Complaint received from Mrs. Martin A. Shapiro regarding the condition of inadequate.drainage existing at Bill Cooke's Cadillac Oldsmobile Inc. at Triphammer Shopping Center. Board requested Highway Supt. Sharpsteen to examine the situation and determine what could be done to rectify the condition. William Cooke of Cadillac & Oldsmobile, Inc. regard to an application previously submitted for Mr. Cooke objected to the board's decision of May dimension from 36' to 31' and not being permitted regular business hours. The board advised Mr. Co Board regarding his objections, appeared before the board in the replacement of a sign. 8th which reduced the over -all to have the sign lights on after Dke to meet with the Planning AUDIT RESOLUTION offered by Mr. Bush: RESOLVED, that General Fund bills #215 through 266 totalling $218,483.17 and Highway Fund bills #142 through #165 totalling $47,518.32 be and the same are' hereby approved for payment, and be it further RESOLVED, that Water District. #1 and Water District #2 bills be and the same are hereby approved for payment.
