Howell at 8:00 o'clock P.M., at the Fire House onle.Oakerest Road on June 22nd, 1973, pursuant to Section 3 -306 of the Village Law. Fourteen persons present. Town Attorney Robert Williamson outlined the legal rules from Village Law and Incorporation for a Village. Objections registered in writing were made to the Petition to Incorporate. the Village of Lansing, by Robert R. Gibbs, Jeanette A. Gibbs, John L. Dart, i Louise G. Dart and Mary Post, 1 Objections were as follows: 1. The petition alleges that the signatures of the petition constitute at least twenty (20 %) percent of the residents of the territory who are qualified to vote for town officers in the Town of Lansing. This allegation fails to meet the requirements of existing Village Law, Section 3 -302 (1) (a) (1), which requires petitioners to constitute at least twenty (20%) percent of "the resident owners of real property in such territory qualified to vote for town officers." Thus, the allegation of the basis on which the petition is signed does not comply with existing Village Law. 2. There is currently an action, Gibbs vs. Howell, on appeal in the New York Court of Appeals. This action is based on a petition substantially similar to the one proposed tonight. Since the same issues are again going to be raised, all proceedings concerning similar petitions should be stayed until the Court of Appeals has determined the issues. 3. This petition proposes to remove an excessive amount of taxable realty, especially commercial realty, from the Town of Lansing, thereby endangering the future economic stability of the Town of Lansing. 4. The proposed incorporation is especially injurious to the objectors since they will be subjected to the burdens of local government disproportionate to any possible benefits. Attorney David Gersh stated that the preceding written objections were of sufficient import to careful investigation of the petition. Requested the hearing be postponed to a later date.
