ROLL CALL Charles Howell Supervisor Present Louis Bush Councilman Present Bert Hilliard Councilman Present Edward LaVigne Councilman Present Lee Naegely Councilman Present Robert Williamson Town Attorney Present Donald Sharpsteen Highway Supt. Present Jane Bush Clerk Present Visitors: Mmes. Wanda Brink, Viola Miller, Louise Dart; Messrs.. John Maines, Robert Wyatt, Robert Gibbs, Gerald Talandis and Mr. & Mrs. Lempert, James W. Howell, The Supervisor opened the meeting having the clerk take the Roll call: S Letter received from the Lansing Board of Fire Commissioners stating that the Board of Fire Commissioners, voted unanimously, to split the cost of up- dating the Lansing Town Directory with the Town, said total estimated cost to be $4,000.00. Discussion followed. RESOLUTION offered by Mr. LaVigne. RESOLVED, that the Town of Lansing will split the cost of up. dating the Lansing Town Directory with the Board of Fire Commissioners, total estimated cost being $4,000.00. Seconded by Mr. Bush. Sharpsteen, submitted in writing, his approval of the physical aspects and condition of Tripland Terrace and recommended that the Town Board accept Tripland Terrace as a public road with the following stipulations: 1) That written permission be obtained from Robert R. Gibs, Inc. to use said blacktopped area for 'turn- around' purposes until such time as Tripland Terrace has been extended and accepted as a public road, and, 2) That the present private owner of Tripland Terrace agrees to finance the' material cost of a minimal amount of gravel sufficient to fill and level the present existing surface of said road. Discussion followed. RESOLUTION offered by Mr. Bush. RESOLVED, on recommendation of the Town Highway Superintendent that Tripland Terrace to the length of 710' be and the same hereby is accepted as a Town Highway, provided that the conditions set forth in the letter of the Highway Superintendent, dated 2/7/72, are met and a letter is received by the Town Clerk from Town Attorney Williamson approving the deed to said road. (Aye Louis Bush, Councilman Bert Hilliard, Councilman Edward LaVigne, Councilman Lee Naegely, Councilman Charles Howell, Supervisor Carried RESOLUTION offered by Mr. LaVigne: RESOLVED, that the General Plan.prepared under the 701 Program be loaned to citizens of the town for a ninety day period and be it further RESOLVED, that if said book is not returned after ninety days, the borrower will be liable for the $10.00 cost of said book. Seconded by Mr. Naegely. (continued) Carried • • Continued February 8, 1972 RESOLUTION offered by Mr. Hilliard. WHEREAS, the State of New York has appropriated 0.033 acres of land in fee, for purposes connected with the highway system of the State of New York, pursuant to Section 30 of the Highway Law, as shown and described on the above designated map, and WHEREAS, by reason of such appropriation, the Town of Lansing, County of Tompkins, State of New York, will have a claim by reason of the land so acquired and for legal damages by such appropriation, and WHEREAS, it appears advisable Board . . . . for the said Town of Lansing to enter into an Agreement of Adjustment Vote with the State of New York in settlement of this claim, now therefore Edward LaVigne, Councilman be it of RESOLVED, that Donald K. Sharpsteen, Highway Superintendent of the aforesaid Town of Lansing be authorized to enter into an Agreement of Adjustment with the State of New York in the amount of $130.00 for the adjustment of said claim for the property so appropriated, be it FURTHER RESOLVED that said Donald K. Sharpsteen, Highway Superinten. dent of the Town of Lansing or his duly elected successor, as the case may be, be authorized to execute such formal papers as the Attorney General of the State of New York may deem necessary to fully release the State from any claim which the said Town of Lansing may have by reason of such appropriation. Seconded by Mr. Bush. Unanimously carried. Discussion held by the Board regarding town employees who are members of the Retirement System; purchasing credit for military service during World War 11. RESOLUTION offered by Mr. Bush.: BE IT RESOLVED, that the Town Board of the Town of Lansing does hereby elect to provide the benefits of sub - division k of Section 41, sub- division g of Section 43 of the Retirement and Social Security Law and sub- division 4 of Section 243 of the Military Law, all as presently or hereafter amended; and BE IT FURTHER RESOLVED: That this election shall become effective with the payroll period beginning on March 159 1972. Seconded by Mr. LaVigne. Unanimously carried. Attorney Williamson reported that all easements to Bolton Point have been recorded.. All Sewer Dist. #2 easements recorded with the exception of easement of Shulman and Wallace. RESOLUTION offered by Mr. Naegely: RESOLVED, that the Supervisor be and he hereby is authorized and directed to execute an easement on behalf of Lansing Sewer Dist. #2 with Messrs. McDermott, Attorney for the Town of Lansing Highway Association, stating that the members of the Highway Association would be willing to sign the Contract for the year 1972 if they were given one additional holiday in the fall. In the Matter of the increase and improvement of the facilities of Lansing Sewer District No. 1 in the Town of Lansing, Tompkins County, New York, pursuant to Section 202 -b of the Town Law, was discussed by the board. Following discussion, Order adopted to hold a public hearing on the 14th day of March, 1972, 8 :30 P.M., regarding said matter. Said Order attached hereto and made a part thereof. The Order for a meeting to consider increase of facilities - Lansing Water Dist. #1, pertaining'to the acquisition of water mains in Cedar Lane was discussed by the board. Action by the board was deferred.until the Tompkins Co. Health Dept, submits an opinion in relation to said proposed project. The monthly statement of the supervisor for the month of December 1971 was presented and gone over in detail. AUDIT RESOLUTION offered by Mr. LaVigne: RESOLVED that General Fund bills # 16 through # 43 totalling $53,567.87 and Highway Fund bills #11 through # 37 totalling $53,525.77 be and the same are hereby approved for payment, and be it further RESOLVED, that Water Dist. #1, Water Di and Sewer Dist. ##2 bills be and the same are payment.
