Said addendum concerns Cayuga Heights consent to accept sewage from Holiday Inn Motel property. RESOLUTION offered by Mr. Naegely: RESOLVED, that the Supervisor be authorized and directed to execute ADDENDUM to Agreement with Village of Cayuga Heights for Sewage Disposal (Lansing Sewer Dist. #2). Meeting adjourned 9:30 P.M. e /ZC� June 29, 1971 The Lansing Town Board held an Executive Meeting as called at the close of the June 22nd meeting. Meeting called to order at 8 P.M. with Supervisor Howell presiding. The results of the postcard poll of property owners in existing Sewer _'Districts 1 and 2 and Study Area 3 in regard to their choices of possible alternatives for their participation in the proposed County Sewer District, was reviewed in detail. The Town Board discussed thoroughly, different proposals in respect to establishing the length of the interceptor line and a County Sewer District boundary. It was the consensus of the board, at this time, that the interceptor line should go to Twin Glens and the sewer district boundary should be at Burdick Hill. July 9, 1971 The Lansing Present Town Board met in Regular Session at the South Lansing Town Hall on July 9, 1971 at 8 P.M. with Supervisor Howell presiding. Present Clerk Present Visitors: Approximately fifty -five persons. The Supervisor called the meeting to order having the clerk take the Roll Call. A copy of the minutes of .the May 27th, June 2nd and June 4th meetings having been furnished to the members of the town board before- hand, the Supervisor asked for a motion to propose corrections of errors or to accept same as submitted. MOTION by Mr. Hilliard and seconded by Mr. Bush that the minutes as submitted by the Town Clerk be approved. Carried (continued) U54 4 Continued July 9, 1971 Donald Worsell presented a sketch of a proposed trailer park for review by the board. Albert Ferris stated that on July 10th he had a man engaged to check his junk yard in the hopes of negotiating to have junk cars removed from his property. Proof of Notice having been furnished, the Public Hearing on proposed Local Law #3, 1971 relating to the erection, construction and alteration of signs in the Town. of Lansing, was called to order at 8:15 P.M. by Charles Howell, Supervisor. The proposed Local Law, Regulating Signs, was read. All persons desiring to be heard, having been heard and no object- ions being made to said local law, the hearing was terminated. The .Town Board at this time discussed the Hearing just held on proposed Local Law #3, 1971, after which time the following resolution was offered for adoption: WHEREAS,.a public hearing has been held on Local Law #3, 19719 as required by law, now therefore be it RESOLVED, by Mr. Naegely, seconded by Mr. Bush, that said Local Law be and the same hereby is adopted, same to be effective after publication and filing as required by the Municipal Home Rule Law. I - BY ORDER OF THE TOWN BOARD Jane Bush, Clerk June 25, 1971 LOCAL LAW NOe 3 - 1971 REGULATING SIGNS TOWN OF LANSING Carried A Local Law relating to the erection, construction, repair, alter- ation and maintenance of signs in the Town of Lansing. Section 1. Legislative Intent: The purpose of this Local Law is to promote and protect the public health, welfare and safety of the Town of Lansing by regulating existing and proposed outdoor advertising, outdoor advertising signs and outdoor signs of all types. It is intended to protect property values, create a more attractive economic climate, en- hance and protect the physical appearance of the community, preserve its scenic and natural beauty and provide a more enjoyable and pleasing community. It is further intended to reduce a sign or advertising distraction and obstructions that may contribute to traffic accidents - and to curb deterioration of natural beauty and community environment. Section 2. Definitions: As used in this local law unless otherwise expressly stated: (a) The term "sign" shall mean any material, structure or device or part %thereof, composed of lettered or pictorial matter for display of an advertisement, announcement, notice, direction, matter or name, and includes sign frames billboards, sign boards, hanging signs, illuminated signs, wall signs, projecting and ground signs. (b) The term "erect" shall mean to build, construct, alter, display, relocated, attach, hang, place, suspend or affix any sign, and shall also include the painting of new exterior wall signse (c) The term "illuminated sign" shall mean any sign illuminated by electricity, gas or other artificial light, including reflective or phosphorescent light. (d) The term "lighting device" shall mean any light, string of lights, or group of lights located or arranged so as to cast illumina- tion on a sign. (e) The term "person" shall mean any person, firm partnership, association, corporation, company, institution or organization of any kind. (f) The term "toUm ordinance officer" shall mean that person delegated by the Town Board with the enforcement of the ordinance of the Town of Lansing. Exception: For the purpose of this local law, the term "sign" does not include signs erected and maintained pursuant to and in discharge of any governmental function, or required by any law, ordinance or governmental regulation. Section 4. General Regulations: The following regulations shall apply to signs in the Town of Lansing. (a) A maximum of two signs for any one business. (b) Any illuminated sign or lighting device shall employ only lights emitting from a light of constant intensity, and no sign shall be illuminated by or contain flashing, rotating, or moving light or lights. Further, no illuminated sign or lighting device shall be so placed or directed so as to permit the beams and lighting to be directed or beamed upon a public street, highway, sidewalk, or adjacent premises, so as to cause glare or reflection that may constitute a traffic hazard or nuisance. (c) Professional name plates and signs denoting the name and address of the occupants of the premises, and signs denoting names of professional business personnel such as doctors, lawyers, and signs denoting places of worship, libraries, museums, social clubs or societies, are permitted. (d) No permit shall be required for any sign not exceeding 6 square feet in area. Section 5. Application for Permit: Applications for permits to be required in duplicate for signs in excess of 6 square deet in area and signs that are not allowed pursuant to Section 2 above. The application shall contain the following information: (a) The name, address and telphone number of the applicant. (b) Location of the building structure, or land on which the sign is to be erected. (c) A sketch showing the description of the sign, and the location of the same on the premises. (d) The written consent of the owner of the building, structure or land upon which the sign is to be erected, in the event the applicant is not the owner thereof. Section 6. Fee: The application for said permit shall be delivered to the Town Ordinance Enforcement Officer with a fee of $5.00. Section 7. Issuance of Permit: It shall be the duty of the T own Ordinance Officer upon the filing of an application_ for a permit to erect a sign, to examine the plans, specifications, and other date submitted to him. If it appears that the proposed sign is in compliance with the requirements of this Local Law and other ordinances of the Town of Lansing, he shall thereafter within five days issue a permit for the erection of said sign. If the Town Ordinance Officer shall refuse to grant said permit, the applicant may appeal the decision to the S ign Board of Appeals as hereinafter set forth. Section 8. Variances: A Sign Board of Appeals as provided herein may grant variances or modifications subject to the procedural requirements set forth in Section 267 of the Town Law. Section 9. Review and Appeal: Any person aggrieved by any decision of the Town Ordinance Enforcement Officer relative to the provisions of this Local Law may appeal to the Sign Board Appeals Board, appointed by the Town Board of the Town of Lansing composed of five members which in hearing and determining appeals as provided herein, shall be subject to the procedural requirements applicable to Boards of Appeal (Town Law, Section 267). Any person aggrieved by any decision of the Board of Appeals may have the decision reviewed by a Special Term of the Supreme Court in the manner provided by Article 78 of the Civil Practice Law and Rules. Section 10. Violations.: Failure to comply with any of the provisions of this Local Law shall be deemed a violation and the violator shall be liable to a fine of $25.00 and in case of continuing violation, every day°s6 continuance thereof shall be and is deemed to be a separate and distinct offense. (continued) continued July 9, 1971 Section 11, Validity: In any section, subsection, phrase, sentence or portion of this Local Law is for any reason held invalid or unconstitu- tional by any Court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions hereof. Section 12. Effective Date: This Local Law shall take effect after filing and publication as required by law. It was the consensus of the Board that if a lighted sign was a nuisance, the Board would request the owner to turn the sign off at a certain hour. Frank Horvath and his Atty. Richard Thaler, spoke to the board regarding his newly constructed road, Maple Drive, that he previously had requested the town to accept. Highway Supt. S harsteen stated that the drainage and gravel problem's will have to be corrected before he will recommend that the Town Board accept as a town road. A letter read from The Lansing Service Club, a temporary name assumed by a newly formed organization made up of delegates from various organizations within the Town, dedicated to the development of the newly acquired land adjacent to the Lansing Town Hall, was read. Proposed long range plans were submitted for discussion. Chairman of the Service Club, Floyd Wilson, discussed map and plans for leveling the field. Councilman Louis Bush felt that test borings of the field should be conducted before any excavation work was started. Following resolution offered: RESOLUTION offered by Mr. LaVigne: RESOLVED, that the Town Highway Department level off field adjacent to Town Hall for two areas for baseball diamonds and an area for ice skating rink. Board to discuss further and inform Mr. Stevenson of their decision. The N. Triphammer and Peruville Roads intersection was again discussed by Co. Commissioner of Public Works Howard Stevenson and the Town Board. Mr. Stevenson stated that Crooked Hill Road, leading to Ludlowville, is being studied by his committee. The proposed County Sewer District was discussed by the Town Board and residents present. Mary persons indicated their willingness to participate in the proposed district if building the interceptor could be delayed, however, it is not known if this approach would even be acceptable to the County Sewer Agency. An informal poll of the, board members, indicated favoring the plan that would include Lansing in the proposed County Sewer District without building an interceptor at the present time, however, no final decision was taken by the board at this time. The Supervisor presented his monthly report and explained same in detail. AUDIT RESOLUTION offered by Mr. Bush, seconded by Mr. Hilliard: RESOLVED that General Fund bills ##176 through #209 totalling $11,547.16 and Highway Fund bills ##131 through ##153 totalling $46,814.43 be and the same are hereby approved for payment, and be it further RESOLVED, that Water District ##1 and Water Dist. #2 bills be and the same are hereby approved for payment.
