Present Clerk..:.`.: Present Visitors: Mrs. LeLaurentis, Mrs. Bent, Mrs, Miller, Louis Emmick and Reporter Jeff Frank, The Supervisor called the meeting to order having the clerk take the Roll Call. A copy of the minutes of the April 23rd, April 30th, May 7th, May 10th and May 14th meetings having been furnished to the members of the town board beforehand, the Supervisor asked for a motion to propose corrections of errors or to accept same as submitted. MOTION by Mr. Hilliard and seconded by Mr. LaVigne that the minutes as submitted by the Town Clerk be approved. ORDINANCE No. 10 - 1971 r ORDINANCE REGULATING STREET EXCAVATION ON TOWN ROADS. An Ordinance of the Town of Lansing, County of Tompkins, State of New York, to regulate street excavation on town roads in the Town of Lansing. The Town Board of the Town of Lansing, by virtue of the authority vested in it by law, does hereby ordain and enact as follows. Section 1. It shall be unlawful for any person, firm, company or corporation to make or cause to be made any excavation in or under any street or highway or right of way of the Town of Lansing, without first having obtained a permit issued by the Town Superintendent of Highways. Application for such permit shall be made in writing, shall be signed-by the applicant, and shall be submitted to the Town Superintendent of (continued) U Continued June 11, 1971 Highways. Applicant shall satisfy the Town Superintendent of Highways that he is duly qualified to make such excavation. Each permit, or a re- newal thereof, shall expire on a date no more than six months from the issuance thereof. Section 2. If the application for a permit is granted by the Town Superintendent of Highways, the said permittee, before making any exca. vation in or under any street or highway or right of way in the Town of Lansing, shall deposit two hundred and fifty dollars, cash or certified check, with the Town Clerk of the Town of Lansing. Said moneys, will be refunded upon completion of the work and approval by,the Town of-Lansing Highway Superintendent filed in writing with the Town Clerk. Municipal Corporations shall not be required to make the deposit required by this section. Section 3. No permit shall be issued until applicant has deposited the money as provided in Section 2, and in addition thereto, has filed with the Town Clerk a certificate of publie'liability insurance to idemnify and protect the Town against any loss,' damage or injury which might be incurred by reason of said street excavation or performance of the work incidental thereto. Said insurance shall be in an amount not less than one hundred thousand ($100,000) dollars for any one person, and not less than three hundred thousand ($300,000) dollars for any one accident, and of property damage insurance in the amount of not less than one hundred thousand (p100,000) dollars for any one accident. Section 4. No opening made hereunder shall remain open and un- fLlled for a period longer than three days, unless permission for a longer and stated period be specifically given by the permit,: Section 5. All work shall be under the supervision of the Superintendent of Highways and must be performed to his satisfaction. Section 6. The permittee shall erect and maintain suitable barricades and fences around all of his or its work while excavation or other work is in progress and shall arrange his or its work in such a manner as to cause a minimum of inconvenience and delay to vehicular and pedestrian traffic, and while such opening remains open and unfilled it shall be properly guarded and continuously marked by red flags by day and red lights between sunset and sunrise or as specified by the Highway Superintendent. Section 7. Any violation of the foregoing ordinance shall be deemed an offense, punishable by imprisonment for thirty (30) days or by payment of a fine up to one hundred dollars($100) for each offense, or both. Every violation of any provision of this Ordinance shall be a separate and distinct offense, and in case of continuing violation,. every day's continuance thereof shall be and is deemed to be a separate and distinct offense. Section 8a This Ordinance shall take effect 10 days after -its publication and- posting as required under Section 133 of the Town Laws. Highway Superintendent Sharpsteen reported many pieces of highway equipment is broken down. The Junk Yard Ordinance was discussed. Councilman Louis Bush discussed the junkyard located at 544 Auburn Road, owned by Albert R. Ferris, stating that the junk yard should comply with said ordinance or action taken to impose penalties in violation as ordinance provides, Councilman Lee Naegely also felt that two years of this pending case warranted immediate action. Supervisor Howell to write to Mr. Ferris stating that said junk yard must comply with ordinance within thirty days and Councilman Bert Hilliard to personally contact Per. Ferris = on moving cars etc. ® Mrs. Viola Miller, Planning Board member, spoke regarding question of County Sewer District. Stated that results of post card poll should not be used entirely in board's decision of participation in County Sewer District, that board members could determine what was best for the town.
