TO CONSIDER INCREASE OF FACILITIES FOR SEWER DISTRICT - N0. 2 and any other business that may come before said board. Charles F. Proof of Notice having been furnished, the Public Hearing on the Proposed change and modification in the plan for Sewer Dist. #2, was called to order by Supervisor Charles Howell at 8:15 P.M. Atty. Williamson and Engineer T.G. Miller explained the acquisition of sewer mains constructed, the new proposed construction of sewer mains and appurtenances in regard to area locations and the axquisi. tion of easements. The estimated costs of the project was gone over in detail. Methods of formulas for the paying of said project was also discussed. Arthur.Shull speaking for Ithaca Associates- Parties of Interest requested the following statement be recorded: "I raise bascially the question of cost which I realize is very sensitive, which you've given considerable thought, but we would particularly like to emphasize the point and be sure that in the development of this dis- trict, that we don't end up in the same state as the South Hill District, with cost escalating beyond the real economic return from the facilities and that the cost consequences in installing the facilities be very carefully considered. I feel that the coming of the County District, that we raise the very real problem for the entire south part of the T own of Lansing, of having to cope with the question bf benefit charges for the existence of the sewer services and that the possible result of the very extreme pressures for rapid development of the properties in order to ease the burden of carrying these benefit charges on developed property and that the magnitude expended these charges be very carefully considered. This district will now underwrite sort of the extension of the existing facilities. In the extension of these existing facilities, the district will incur certain fixed costs of the amortized. At a later date the County District will provide these collection or other mains which will become cost in addition to the existing cost service. I am simply saying that as these combined costs are born upon the properties in the district, we may find that in fact that there are additional, additional costs forced by the fact that we will have benefit charges and therefore will have an incentive to develop the properties and that there will be other costs in assoc- iation with -this in terms of roads, schools, fire protection etc., and that we give sufficient way for this point as well as the central planning for the sewers." (continued) U El E E Continued March 19, 1971 135 All persons desiring to be heard, having been heard and no objections being made to said Proposed Order concerning the acquisi- tion and construction on behalf of Lansing Sewer .District No. 2, additional facilities thereof, and appurtenances thereto, the hearing was terminated. At this time, the Town Board discussed the Public Hearings just held in the matter of Sewer District #2, after which time the following action was taken: RESOLUTION - APPROVAL OF CHANGE OF PLANS - LANSING SEWER DISTRICT N0. 2 WHEREAS, the Town Board of the Town of Lansing has conducted a Public Hearing, pursuant to Section 196 of the Town Law, on a proposed modification of the plans for Sewer District No. 2 as shown on a map entitled "Petition Plan - Lansing Sewer District No. 2" - made by O'Brien and Gere, Engineers, June 26, 1965, amended March 1, 1971, by Thomas G. Miller, Engineer, Ithaca New York, which change is in the location of the sewer lines from the east and south of the Ithaca Associates buildings (Howard Johnson) to a location to the north and west of said buildings, and also providing for installation of a pumping station. WHEREAS, no one appeared in opposition to said plans and proposed changes in the original petition planned for Lansing Sewer District No. NOW THEREFORE, be it resolved Town by Mr. Naegely, seconded by Mr. Hilliard, that said modification of the maps and plans and profiles for the Lansing Sewer District No. 2 be and the same hereby approved and BE IT FURTHER RESOLVED that said revised map and profile showing all changes, together with the original maps and profiles shall be care. fully preserved in the office of the Town Clerk and open to inspection by all persons interested. ORDER APPROVING THE ACQUISITION AND CONSTRUCTION OF BEHALF OF LANSING SEWER DISTRICT N0. 21 ADDITIONAL FACILITIES THEREOF, AND APPURTENANCES THERETO, PURSUANT TO SECTION 202 -b OF THE TOWN LAW. A map, plan and report relating to the acquisition and construc tion on behalf of Lansing Sewer District no. 2, of additional facilities therefor, and appurtenances thereto, including the acquisition of necessary easements and lands of premises owned by Lansing Terrace Apartments, Inc. and others, having been prepared by Thomas G. Miller, Licensed Engineer and Surveyor, of Ithaca, New York, and the estimated cost of said projects having been prepared by said engineer, all in accordance with Section 202 -b of the Town Law; and a public hearing having been called by the T own Board on said proposed project which hearing was held on the 19th day of March 1971, at 8 :45 p.m. in the Town Hall, Town of Lansing, New York, and said notice of public, having been duly published, and posted, as required by Section 193 of the T own Law, and said notice having described in general terms the proposed improvement and facilities to be constructed and acquired, and no one appearing and objecting to said proposed improvement, it is ORDERED, that this Board hereby determines that on the hearing of the evidence given thereat, that it is in the public interest to acquire and construct on behalf of Lansing Sewer District #2, the additional facilities therefor, and appurtenances thereto, briefly described as follows: (continued) 2, (continued March 19, 1971 le Acquisition of Facilities From: a. Cornell University and Tompkins County at Tompkins County Airport and Cornell Research Park - 7,000 feet of constructed sewer. b. First Industrial Park Development Corporation - sewer main and pumping station and related facilities parallel to Warren Road, approximately 39100 feet. co Constructed sewer mains of Lansing Terrace Apartments, Inc.., approximately 670 feet. 11. New Construction: a. 3,300 feet of new sewer main to be constructed to serve Graham Road, Wakefield Road and the northern area of the existing district. All of said changes are shown on map entitled "Petition Plan - Lansing Sewer District'--No. 2" O'Brien & Gere, Engineers, dated June 26, 1965, amended March 1, 1971, prepared by Thomas G. Miller, Engineer, Ithaca, New York. That the copy of the map aforementioned, together with the plans, specifications showing said sewer lines to be acquired, constructed and easements to be acquired is on file with the Town Clerk of the Town of Lansing at the Town Hall, said plan showing the estimated cost of said additional acquisitions and construction shall not exceed the amount of $180,000.00 over and above the $:300,000.00 revised total cost of the original project and it is further ORDERED by the Town Board, that the Engineer be and he hereby is authorized and directed to prepare definite plans and specifications of and to make a careful estimate of the expenses, and with the assistance of the Town Attorney, to prepare the proposed contract or contracts Board . needed for the execution of the work and the acquisition of the existing facilities and easements and lands needed, and in conjunction with the Town Board, to cause said dmprovements to be constructed and acquired. NOTICE OF PUBLIC HEARING PLEASE TAKE NOVICE That the Town Board of the Town of Lansing will hold a public hearing in the Town Hall, Town of Lansing on the 19th day of March,' 1971 at 8:15 o'clock in the evening thereof on a proposed change and modification in the plan for Sewer District No. 2 as shown on "Petition Plan — Lansing Sewer District No. 2" — made by O'Brien &Gere, Engineers, June 26; 1965, amended March 1, 1971 by Thomas G. Miller, Engineer, Ithaca, New York.
