The Supervisor opened the meeting having the Clerk take the Roll Call. Proof of Notice having been furnished, the Public Hearing on proposed Local Law #1, 1971 relating to establishing a Board of Ethics for the Town of Lansing was called to order at 8 :00 P.M. by Charles Howell, Supervisor. Atty. Williamson read proposed Local Law #1. All persons desiring to be heard, having been heard and no objections being made to said local law, the hearing was terminated. The Town Board at this time discussed the Hearing just held on proposed Local Law #1, 1971, after which time the following resolution was offered for adoption: WHEREAS, a public hearing has been held on proposed Local Law #1, relating to establishing'a Board of Ethics for the Town of Lansing on January 8, 1971 at 8:00 P.M. in the evening thereof, and WHEREAS, no one appeared objecting to same, now therefore be it RESOLVED, by Mr. Bush and seconded by Mr. Naegely that said Local Law #1, 1971 relating to establishing a Board of Ethics for the Town of Lansing be and the same is hereby adopted. Said hearing to be held at the Lansing Town Hall, South Lansing on the 8th day of January 1971 at 8 P.M. in the evening thereof. December 22, 1970_ _ �, By order of the Town Board 12 -28-70 Jane C. Bush, Clerk Be it enacted by the Town Board of the Totlm of Lansing as follows: Section 1. There is hereby established a Board of Ethics - consisting of three members to be appointed by the Town Board and who shall serve without compensation and at the pleasure of the Town Board. A majority of such members shall be persons other than officers or employees of the Town of Lansing, but shall include at least one member who is an elected or appointed officer or employee of the Town of Lansing. @2. The Board of Ethics shall have the powers and duties prescribed by article eighteen of the General Municipal Law and shall render advisory opinions to the officers and employees of the Town of Lansing with respect to article eighteen of the General Municipal Law and any Code of Ethics adopted pursuant to such article, under such rules and regulations as the board may prescribe. In addition., the board may make recommendations with respect to the drafting and adoption of a Code of Ethics or amendments thereto upon request of the Town Board, 03. This local law shall. take effect upon filing as provided in section twenty - seven of the General Municipal Law. A petition signed by eighty -four Lansing residents was presented to the Town Board., requesting said Town Board to consider presenting a resolution to the County Board of Representatives and the Co. Superintendent of Highways to reconsider the closing of County Road #159 (Crooked Hill Road), for the following. reasons: 1) Fire Safety; 2) Safety, Protection and Welfare of Children; 3) Highway efficiency and safety; 4) Beauty. A resolution which was adopted by officers and members of the Almeda- Lansing Rescue and Fire Company expressing their deep concern over the closing of said road was also read. Discussion held by the board, after which time the following resolution was offered: i (continued) {_ continued January 8, 1971 WHEREAS, the Town Board has been presented with a petition signed by eighty -four persons concerned about the closing of County Road #159 (Crooked.Hill Road), said road having been closed by order of Howard Stevenson, Jr., Tompkins County Commissioner of Public Works, and WHEREAS, it is the belief of this board that said road is essential in the Town Road System for the safety and health of the citizens of Lansing residing in and about said area, and WHEREAS, this board approves and affirms the statements set forth in said petition filed with this board, now therefore be it RESOLVED, on motion of Bert Hilliard and seconded by Louis Bush that this board hereby requests the Tompkins County Commissioner of Public Works to reconsider the closing of said road, and be it.further RESOLVED, that the County make the necessary repairs to said road so it can be opened to the public, and be it further RESOLVED, that the Clerk of this Board forward a certified copy of this resolution, attaching a copy of the resolution passed by the Almeda- Lansing Rescue and Fire Co., to Howard Stevenson, Jr., Commissioner of Public Works and the Tompkins County Board of Representatives. Bush, Clerk Be it enacted by the Town Board of the Town of Lansing as follows: Section 1. Pursuant to the provisions of section eight hundred six of the Gen- eral Municipal Law, the Town Board of the Town of Lansing recognizes that there are rules of ethical conduct for public officers and employees which must be observed if a high degree of moral conduct is to be obtained and if public confidence is to be maintained in our unit of local government. It is the purpose of this local law to promulgate these rules of ethical conduct for the officers and employees of the flown of Lansing. These rules shall serve as a guide for official conduct of the officers and employees of the Town of Lansing. The rules of ethical conduct of this local law as adopted, shall not conflict with, but shall be in addition to any prohibition of article eighteen of the General Municipal Law or any other general or special law relating to ethical conduct and interest in contracts of municipal officers and employees, §2. Definition. (a) "Municipal 'Officer or Employee" means an officer or employee of the Town of Lansing, whether paid or unpaid, including members of any administrative board, commission or other agency thereof. No person shall be deemed to be a municipal officer or employee solely by reason of being a volunteer fireman or civil defense volunteer, except a chief engineer or assistant chief engineer. (continued) 1 0 continued January 8, 1971 (b) "Interest" means a pecuniary or material benefit accruing to a municipal officer or employee unless the context otherwise requi a res. 119 §3. Standards of Conduct. Every officer or employee of the Town of Lansing shall be subject to and abide by the following standards of conduct: (a) Gifts. He shall not directly or indirectly, solicit any gift; or accept or receive any gift having a value of twenty five dollars or more, whether in the form of money, services, loan, travel, entertainment, hospitality, thing or promise, or any other form, under circumstances in which it could reasonably be inferred that the gift was intended to influence him, or could reasonably be expected to influence him, in the performance of his official duties or was intended as a reward for any official action on his part. (b) Confidential information. He shall not disclose confidential informa- tion acquired by him in the course of his official duties or use such information to further his personal interest. ® (c) Representation before one's own agency.. He shall not receive, or enter into any agreement, express or implied, for compensation for services to be rendered in relation to any matter before any municipal agency of which he is an officer, member or employee or of any municipal agency over which he has jurisdiction or to which he has the power to appoint any member, officer or employee. (d) Representation before an agency for a contingent fee. He shall not receive, or enter into any agreement, express or implied for compensation for services to be rendered in relation to any matter before any agency of his municipality, whereby his compensation is to be dependent or contingent upon any action by such agency with respect to such matter, provided that this paragraph shall not prohibit the fixing at any time of fees based upon the reasonable value of the services rendered. (e) Disclosure of interest in legislation. To thereof, a member of the Town Board and any officer or emp whether paid or unpaid, who participates in the discussion to the Town Board on any legislation before the Town Board the official record the nature and extent of any direct or private interest he has in such legislation. the extent that he knows loyee of the Town of Lansing, or gives official opinion shall publicly disclose on indirect financial or other (f) Investments in conflict with official duties. He shall not invest or hold any investment directly or indirectly in any financial, business, - commercial or other private transaction, which creates a conflict with his official duties. (g) Private employment. He shall not engage .in, solicit, negotiate for or promise to accept private employment or render services for private interests when such employment or service creates a conflict with or impairs the proper discharge of his official duties. (h) Future employment, He shall not, after the termination of service or employment with such municipality, appear before any board or agency of the Town of Lansing in relation to any case, proceeding or application in which he personally participated during the period of his service or employment or which was under his active consideration. §4. Nothing herein shall be deemed to bar or prevent the timely filing by a present or former municipal officer or employee of any claim, account, demand or suit against the Town of Lansing, -or any agency thereof on behalf of himself or any member of his family arising out of any personal injury or property damage or for any lawful benefit authorized or permitted by law. ® §5. Distribution of Code of Ethics. The Supervisor of the Town of Lansing shall cause a copy of this Code of Ethics to be distributed to every officer and employee of the Town of Lansing within thirty days after the effective date of this local law. Each officer and employee elected -or appointed thereafter shall be furnished a copy before entering upon the duties of his office or employment. §6. Penalties. In addition to any penalty contained in any other provision of law, any person who shall knowingly and intentionally violate any of the provisions of this code may be fined, suspended or removed from office or employment, as the case may be, in the manner provided by law. §7. Effective Date. This local law shall take effect upon filing as provided in section twenty -seven of the Municipal Home Rule Law. (continued) continued January 8, 1971 WEIER.EAS, the Lansing Planning Board has recommended the appointment of Stephen Farkas, Jr. to said-Planning Board for a seven year term beginning January 1, 1971, now therefore be it RESOLVED, on motion of Mr. Hilliard and seconded by Mr. Bush, that Stephen Farkas, Jr. be appointed to succeed himself for a term of seven years. Carried Supervisor Howell advised the board that the required resolutions to be acted upon for the year 1971 would now be conducted. RESOLUTION offered by Mr. Bush and seconded by Mr. Hilliard: RESOLVED that the Supervisor be authorized and directed to have the town records and justice records audited by Maxfield, Randolph and Carpenter and file his report under (Town Law 181 (3)0 .Carried RESOLUTION offered by Mr. Naegely and seconded by Mr. Bush: RESOLVED that the bonds of public officials be approved as to the amount and company. Carried RESOLUTION offered by Mr. LaVigne and seconded by Mr. Hilliard: RESOLVED that Paul Mikula and Delford Barnes be appointed constables for the year 1971. Carried RESOLUTION offered by Mr. Naegely and seconded by Mr. LaVigne: RESOLVED that Kenneth Tarbell be appointed Multiple Housing Inspector for the year 1971. Carried RESOLUTION offered by Mr. Bush and seconded by Mr. Hilliard: RESOLVED that the supervisor appoint the five Fire Chiefs of the Town of Lansing as Fire gardens. Carried RESOLUTION offered by Mr. Hilliard and seconded by Mr. Naegely: RESOLVED that the attorney for the town be on an as needed biais and that Robert Williamson be consulted as needed. Carried RESOLUTION offered by Mr. Hilliard and seconded by Mr. Naegely: RESOLVED that the town officers and highway superintendent be allowed the sum of 10¢ per mile for the use of their automobiles in the performance of their official duties. Carried RESOLUTION offered by Mr. Naegely and seconded by Mr. LaVigne: RESOLVED that Robert's Rule of Order be followed, however, when special roll call votes are requested, voting to be in alphabetical order and the supervisor voting last. Agenda consists of discussion of present Trailer Park Ordinance, present specifi. cations for roads to be accepted by Lansing Highway System, Eng. T.G. Miller will discuss progress of County Seger Agency in respect to the Town of Lansing, and any other business that may come before said board. Clerk instructed to write Mr. A.C. Petty of the NYS Conservation Dept. requesting a representative from the Department to present to the board, a statistical report on the number of does killed in the area and solutions which can be taken to preserve this animal. Clerk instructed to write County Board of Representatives in regard to our request for longer hours for public use of the County Dump on Caswell Road. AUDIT RESOLUTION by Mr. Bush: RESOLVED that General Fund bills #1 through f17 totalling $12,176.37 and Highway Fund bills #1 through #14 totalling $13 , 65,7 .39 beand the same are hereby approved for payment, and be it further RESOLVED that Water District #1 bills the same are hereby approved for payment. Seconded by Mr. LaVigne RESOLUTION offered by Mr. Bush: and Water District #2 bills be and Carried RESOLVED, that the Supervisor, in lieu of preparing his financial report under (Town Law 29 (10) shall submit to the Town Clerk by March 1, a copy of the report to the State Comptroller required by section 30 of the General Municipal Law.
