HomeMy WebLinkAbout1970-11-30Continued'November 20, 1970 An open discussion was held by Town Board Members and visitors regarding snowmobile operation in respect to an Ordinance or Local Law should the Town Board take action to enact same. The matter of use of roads for snowmobile operation was discussed in detail. Unnecessary noise, operating on private lands, excessive speed were also discussed. Letter received and read from Roderic S. Neno in regard to establishing guide lines to reduce hazards and increase pleasure of snowmobiling in the Town of Lansing. No action taken at this time. On Motion, meeting adjourned to Monday, November 30th at 8 P.M. Public Hearing to be conducted at 8 :00 o'clock P.M. for the purpose of amending Lansing Town Ordinance No. 5, Providing for a partial tax exemption of real property for persons with limited income who are 65 years of age or over. Proof of notice having been furnished by the Town Clerk, the Public Hearing on the Ordinance providing for the amendment of an Ordinance adopted by the Town Board on the 9th day of August 1966, was called to order at 8 P.M. by Supervisor Charles Howell. The proposed Ordinance was read and discussed in detail. No persons desiring to be heard, the Public Hearing was terminated at 8:20 P.M. Following board discussion, resolution offered for adoption: WHEREAS, a Public Hearing has been held for the purpose of amending Lansing Town Ordinance No. 5 dated August 9, 1966, Providing for a partial tax exemption of real property for persons with limited income who are 65 years of age or over, Section 2, Paragraph 49 increasing the yearly income limitation from $39000 to $5,000 and amending same to conform to other changes in the state stature, and WHEREAS, no one appeared objecting to same, now therefore be it RESOLVED, on Motion by Mr. Naegely and seconded by Mr. Bush,.that said Amendment to Ordinance #5, dated August 9,.1966 be and the same is hereby adopted and the Town Clerk be and-she hereby is directed to enter same in the minutes of the Town Board, post same on the Town sign board and publish same in the Ithaca Journal and file affidavits of publishing and posting in her office. (continued) 0 O Continued November 30, 1970 105 ORDINANCE N0. 8- - 1970 An Ordinance of the Town of Lansing, County of Tompkins, State of. New York, providing for the amendment of an Ordinance adopted by this Town Board on the 9th day of August 1966, BE IT ORDAINED, by the Town Board of the Town of Lansing, County of Tompkins, State of New York: Section 1: Section 2 of the Ordinance is hereby amended to read as follows* Section 2: The following requirements must be-met in order to qualify for exemption: 1. Either the husband or wife must be 65 years of age or over on the date the application for said exemption is filed. 2. Title to the property must have been vested in the owner or owners of the property for at least five years prior to the date of the application. 3. The property must be used exclusively for residential purposes and must be occupied in whole or in part by the owner or owners and said property must be their legal residence. 4. The income of all the owners must not exceed $5,000 during the income tax year immediately preceding the date of application. Where the title is vested in either the husband or wife the combined income of the husband and wife may not exceed $5000. "Income" includes all Social Security and Retirement payments, interest, dividends, rental income, salaries or other earnings including income from self - employment. It does not include gifts or inheritances received during the income tax year. The burden of proof is upon the applicants to show eligibility and they may be required to obtain and submit copies of their latest Federal and State Income Tax, Social Security statements, etc. Section 3: Section 3 of said Ordinance shall be amended to read as follows: Section 3. Application for such exemption must be made by the owner or all of the owners of the property on forms prescribed by the State Board to be furnished by the appropriate assessing authority and shall furnish the information and be executed in the manner required or prescribed in said forms and shall be filed in the Assessor's office at the County Office Building, Ithaca, New York, on or before taxable status date. There shall be a new section, Section 3 -a, of said Ordinance to read as follows. At least 60 days prior to the appropriate taxable status date, the assessing authority shall mail to each person who was granted exemptions pursuant to this section on the latest completed assessment roll an application form and a notice that such application must be filed on or before taxable status date and be approved in order for the exemption to be granted. Failure to mail any such application form and notice or the failure of such person to receive the same shall not prevent the levy, collection and enforcement of the payment of the taxes on property owned by such person. Section 49. This Ordinance shall be entered in the Minutes of the Town Board and published in the Ithaca Journal and a copy thereof posted on the Sign Board maintained by the T own Clerk of the Town of Lansing, pursuant to Subdivision 6 of Section 30 of the Town Law and affidavit of publication and posting filed with the Town Clerk. This Ordinance shall take effect January 1, 1971* BY ORDER OF THE TOWN BOARD OF THE TOWN OF LANSING. Proof of notice having been furnished by the Town Clerk, the Public Hearing to consider the increase of facilities on behalf of Lansing Sewer D istrict #11 was called to order by Supervisor Howell, at 8 :30 P.M. The plans, maps, specifications and estimated cost for the acquisition and construction on behalf of Lansing Sewer District No. 1, of additional facilities therefor and appurtenances thereto, consisting of additional sewer mains and appurtenances, and including the acquisition of additional interests in lands through easements over which a portion of said sewer main would be constructed and acquired, were discussed in detail by the Board, Engineer T.G. Miller and persons present. All persons desiring to be heard, having been heard, and no on objecting to said increase of facilities, the Hearing was terminated at 9:30 P.M. (continued) I Continued November 30, 1970 ® At this time, the Town Board discussed the Hearing just held in the matter of the increase of facilities on behalf of Lansing Sewer District ##1. Following discussion, Mr. Hilliard offered the Order Approving the Acquisition and Construction on Behalf of Lansing Sewer District ##1, of Additional Facilities thereof, and Appurtenances thereto, Pursuant to Section 202 -b in the Town Law. The Board agreed that a ten year program, being paid on a benefit basis would be most economical, however, no action was taken at this time.
