HomeMy WebLinkAbout1969-02-21February 21, 1969 The Lansing Town Board met in Regular Session at the Lansing Town Hall on February 21, 1969 at 8 P.M. with Supervisor Dates presiding. ROLL CALL Harris B. Dates Supervisor Present Floyd Ferris Town Justice Present Charles Howell Councilman Present James Kidney Councilman Absent Fred Spry Town Justice Present Donald Sharpsteen Highway Superintendent Present Robert Williamson Town Attorney Present Jane Bush Town Clerk Present Visitors: Mrs. Pohl, James Howell, Peter Craig, James Showacre, Edwin Filmer, Larry Tvoraha, Arnold Volbrecht and Ithaca Journal Reporter Walsh. ® MOTION by Mr. Ferris and seconded by Mr. Spry that the minutes of the January 14th meeting as submitted by the Town Clerk be approved. Carried Correspondence read from Mr. & Mrs. Edward Foster regarding water and sewer...service and zoning regulations. Letter read from State of New York, Department of Transportation, denying request for a lower speed limit on N. Triphammer Road. Studies conducted concluded the marginal development throughout this section generally below the minimum considered desirable to justify an effective lower speed limit than the existing 50 MPH statutory speed limit. Clerk presented applications for licenses to operate Junk Yards from Albert Ferris, Calvin Volbrecht and Rudy Krantz, after which time the following resolution was offered: RESOLUTION offered by Mr. Spry: RESOLVED, that the Town Board of the Town of Lansing hold a Public Hearing on the applications of Albert Ferris, Calvin Volbrecht and Rudy Krantz for licenses to operate Junk Yards. Said Public Hearing to be held on'.the 11th day of March at 8:15 P.M. in the evening thereof at the Town Hall of the Town of Lansing. Seconded by Mr. Ferris. Carried A request was submitted to the Board from Arnold Volbrecht for a Trailer Park Permit for his property on Burdick Hill Road. Following discussion, the following resolution was offered: RESOLUTION offered by Mr. Howells RESOLVED, that the Town Board of the Town of Lansing hold a Public Hearing on the application from Arnold Volbrecht requesting approval to build a Trailer Park on Burdick Hill Road, Said Public Hearing to be held on the 11th day of March at 8:30 P.M. in the evening thereof at the Town Hall of the Town of Lansing. ® Seconded by Mr. Ferris. Carried The Town Board discussed the office of Receiver of Taxes and Assessments as of January 1, 1970. Following discussion, RESOLUTION offered by Mr. Spry: DETERMINATION THAT OFFICE OF RECEIVER OF TAXES AND ASSESSMENTS SHALL BE AN APPOINTIVE OFFICE IN THE TOWN OF LANSING. WHEREAS, the Town Board of the Town of Lansing, has determined that from and after January 1, 19709 it shall be a Town of the first - class, and WHEREAS, Section 12 of the Town Law, requires that in a Town of the first - class, a Receiver of Taxes and Assessments is required to be elected for a term of four years, but provides that office of Receiver of Taxes and Assessments may be an appointive office in said town, and (continued) WHEREAS FURTHER, -said Section 12 of the Town Law states that if se d office of Receiver of Taxes and Assessments is appointive, the Town Board may appoint the Town Clerk of said town as Receiver of Taxes & Assessments for a two year term, NOW, THEREFORE, BE IT RESOLVED, by this Town Board that the office of Receiver of Taxes and Assessments, shall be an appointive office in the Town of Lansing, and be it further RESOLVED, that this resolution is subject to a permissive referendum. Seconded by Mr. Ferris, Carried James Howell, Lansing Water Supt, discussed the bids returned to replace the retainer wall at Esty Point which was damaged due to high water of Cayuga Lake and severe winter weather. Three bids were returned in the amounts of $2,765, $2,627 and $2,400. After discussion the following resolution was offered: RESOLUTION offered by Mr. Ferris: WHEREAS, the retaining wall.at Esty Point on Cayuga Lake was damaged due to the high water of Cayuga Lake and severe winter weather, and WHEREAS, an emergency exists to repair same to protect the health, safety and water supply of the people of Lansing Water District #1, and WHEREAS, bids were obtained to replace said retaining wall in accordance with certain specifications, and WHEREAS, Varga's Backhoe and Bulldozing Service of Ludlowville, N.Y. with a bid in the amount of $2,400 to replace said retaining wall is the lowest responsible bidder meeting all specifications, now therefore be it RESOLVED that this Town Board declares the destruction of the re- taining wall at Esty Point an emergency situation endangering the health, safety and water supply for the people of Lansing Water District #1, and be it further - RESOLVED, that the bid of Varga's Backhoe and Bulldozing Service in the amount of $2,400. to replace said retaining wall be and the same is hereby accepted. Seconded by Mr. Spry. Vote of.-Town Board (Aye) Vote of Town Board., (Aye) Vote of Town Board (Aye -) Vote of Town Board (Aye) Floyd Ferris, Justice Charles Howell, Councilman Fred Spry, Justice Harris Dates, Supervisor Carried Upon recommendation of the Youth Recreation Commission, the following resolution was made: RESOLUTION offered by Mr. Spry.$ RESOLVED, that Beverly Minor of 570 N. Triphammer Rd., be appointed to the Lansing Recreation Commission for a three year term, expiring December 31, 1971. Said appointment to succeed Patricia Hubbell. Seconded by Mr. Ferris, Carried, Peter - Craig, Member of the Lansing Planning Board, stated that the Lansing Improvement Association Newsletter would publish proposed subdivision Rules and Regulations. Planning Board Chairman, James Showacre, reported that State - Federal Planning Funds ( 11701 Program ") had been granted to Lansing and will soon be available. The proposed Subdivision Regulations was discussed. Town Atty. Williamson suggested the Town Board consider approving rather than adopting an Ordinance on same. The Town Board and Planning Board will hold a Joint Meeting on March 3rd at 8 P.M. at the Town Hall to compare and discuss the present Trailer Ordinance and the Proposed Comprehensive Mobile Home Ordinance drafted by the Planning Board, Park Committee to meet on February 28th at 8 P.M. at the Lansing Town Hall. Plans for 1969 Summer Season at Lansing Park to be outlined. Supervisor Dates presented his monthly report and explained same in detail. (continued) 40 0 F RESOLUTION offered by Mr. Howells AUTHORIZING TOWN OF LANSING HIGHWAY SUPERINTENDENT TO EXECUTE MEMORANDUM OF UNDERSTANDING�BETWEEN WATER RESOURCES COMMISSION AND TOWN OF LANSING, WHEREAS, it is necessary, pursuant to the Conservation Law, Part 3 -a of Article 5, the Water Resources of the State are subject to the protection and control of the Water Resources Commission, RESOLVED, Pursuant to Conservation Law, that the authorized and directed to between the Commission and FURTHER RESOLVED, that incorporated in and made a Seconded by Mr. Spry. Section 429 -a, paragraph 4, of the Town of Lansing Highway Superintendent be execute a memorandum of understanding the Town of Lansing, and said memorandum of understanding be part of this Resolution. Carried AUDIT RESOLUTION by Mr. Spry and seconded by Mr. Ferris. RESOLVED that General Fund bills #15 thru #42 totalling $47,397.68 and Highway Fund bills #23 thru #59 totalling $33,034.39 be and the same are hereby approved for payment. If they wish to .reserve facilities,. make_ reservations at the" Lansing Town- Hall,- South - Lansing, New York. r r A Joint Meeting of the Lansing Town Board and Lansing Planning Board was held March 3rd at 8 P.M. at the Lansing Town Hall. Town Board members present were": Harris: Dates, Floyd Ferris,'Charles' Howell, James Kidney and Fred Spry. Planning Board members present were: James Showacre, Peter Craig, Paul Barron, Fred Edmondson and Bernard Ruzicka. Visitors present were: Frederick Steinhardt, Edwin Filmer, Gordon Selden, Ernest Wilkinson, Arnold Volbrecht, Marshall Volbrecht, Samuel Baughman and Reporter Walsh, The proposed Comphrensive Ordinance drafted by the Planning Board, which would regulate mobile homes and trailers, was gone over and discussed by the Boards. Comparisions were made and discussed in detail between the proposed ordinance and the Trailer Ordinance now in effect. Meeting adjourned 10:00 P.M. cz
